A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPROVING PARCEL MAP 20439 FOR THE SUBDIVISION OF ONE (1) PARCEL OF LAND INTO TWO (2) FREEWAY COMMERCIAL PARCELS WHEREAS, the Planning Commission of the City of Rialto, at its meeting of September 8, 2021, approved Tentative Parcel Map 20439 subject to conditions; and WHEREAS, renaissance travel center, lp. (hereinafter the “Subdivider”), has filed Parcel Map 20439 with the City Council of the City of Rialto, (hereinafter the “City”), in accordance with Section 66456 of the California Government Code; and WHEREAS, not all public improvements have been completed by the Subdivider as of the filing of Parel Map 20439, and the Subdivider has requested that the City enter into a Subdivision Improvement Agreement with the Subdivider to secure the cost of public improvement in accordance with Section 66462 of the California Government Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: Parcel Map 20439 is in substantial conformance with the approved Tentative Parcel Map 20439.
Section 2: Requisite conditions associated with Parcel Map 20439 have been satisfied or supported with the necessary bonds for construction improvements.
Section 3: Parcel Map 20439 is in conformance with the General Plan.
Section 4: Parcel Map 20439 conforms to all applicable requirements of the Subdivision Map Act of the State of California.
Section 5: In accordance with Section 66477.1 of the California Government Code, the offers of dedication to the public on Parcel Map 20439 shall be accepted by the City Clerk, subject to improvement, who shall certify acceptance by signature on the map thereof.
Section 6: The City Council hereby approves a Subdivision Improvement Agreement for Parcel Map 20439 with the Subdivider, renaissance travel center, lp., and accepts subdivision improvement securities in conformance with the requirements therein for public improvements. The City Manager is hereby authorized to execute the Subdivision Improvement Agreement on behalf of the City.
Section 7: The City Clerk shall cause to have recorded with the San Bernardino County Recorder the Subdivision Improvement Agreement.
Section 8: Parcel Map 20439 is hereby approved for the purposes therein defined. \\\\
