A RESOLUTION OF THE RIALTO UTILITY AUTHORITY OF THE CITY OF RIALTO, CALIFORNIA, RATIFIES ACCEPTANCE OF STATE WATER RESOURCES CONTROL BOARD WATER AND WASTEWATER ARREARAGE PAYMENT PROGRAM FUNDING AND EXTENDED WATER AND WASTEWATER ARREARAGE PAYMENT PROGRAM WHEREAS, on March 4, 2020, in response to the COVID-19 pandemic, the Governor of California declared a state of emergency; and WHEREAS, COVID-19 had an impact on local employment and the loss of jobs; and WHEREAS, Rialto water and wastewater ratepayers experienced hardship paying their ongoing water and wastewater bills; and WHEREAS, as authorized by staff, Rialto Water Services (RWS)/Veolia applied for funding assistance to the State Water Resources Control Board (“SWRCB”) pursuant to the Water and Wastewater System Payments Under the American Rescue Plan Act of 2021 adopted by Assembly Bill 148 (the “Act”) and the Extended Water and Wastewater Arrearage Payment Program (Program); and WHEREAS, the SWRCB accepted and approved $402,237.74 for water and $5,677,933.19 for wastewater for the Water and Wastewater Arrearage Payment Program; and WHEREAS, staff returned unused funds of $13,168.01 from water and $28,843.59 from wastewater to the SWRCB for actual and administrative costs of accounts with balances paid prior to the disbursement of the SWRCB funds; and WHEREAS, on July 10, 2023, Governor Newsom signed a budget trailer bill extending the Water and Wastewater Arrearage Payment Program Relief Period from June 16, 2021, to December 31, 2022; and WHEREAS, on December 13, 2023, as authorized by staff, RWS/Veolia applied for funding assistance of $1,824,579.14 from the SWRCB’s California Extended Water and Wastewater Arrearage Payment Program; and WHEREAS, the disbursement of the SWRCB’s California Extended Water and Wastewater Arrearage Payment Program funds is scheduled to begin immediately after approval of the application by the SWRCB.
NOW, THEREFORE, BE IT RESOLVED, by the Board of the Rialto Utility Authority as follows:
Section 1. The foregoing recitals are true and correct and incorporated herein by this reference.
Section 2. Ratifies the acceptance, disbursement, and return of the Water and Wastewater Arrearage Payment Program funds.
Section 3. The Rialto Utility Authority Board hereby authorizes and directs the Executive Director, or designee to accept $1,824,579.14 from the SWRCB’s California Extended Water and Wastewater Arrearage Payment Program and apply funds received from the Program to specified customer accounts as bill credits within sixty (60) days of receipt per the Program Guidelines.
Section 4. The Rialto Utility Authority Board further authorizes and directs the Executive Director, or designee to return any funds not credited to customer accounts to the SWRCB within six (6) months of receipt.
Section 5. The City will comply with all applicable requirements of the Act and the corresponding SWRCB conditions of payment and Program Guidelines including, but not limited to, documentation and reporting and payment plan requirements.
Section 6. This Resolution shall take effect from and after the date of its passage and adoption.
