PRESENTATION AND PROCLAMATIONS
In Memoriam for Laura Goodly – Mayor Robertson

ORAL COMMUNICATIONS
Pedro Molina addressed the City Council related to an unresolved claim damage case submitted last year along with a release of video footage. He also addressed the City Council related to a red tag complaint with code enforcement on his nearby flower shop.

He expressed his concern with the number of U-Haul trucks parked on the street. He believes the owner of business should have enough parking lot space to provide for his business U-Hauls rather than parking on the street. He asked that the City look into the matter. 0o0

SUBSEQUENT NEED ITEM
City Attorney Eric Vail stated that staff is requesting to add an Item of Subsequent Need to the agenda. That item would be a consideration of a letter opposing proposed Assembly Bill 1000 as this matter arose after the preparation of the agenda and needs immediate action by the City Council. Staff did not become aware of the urgency of the Item until after the agenda was posted.

The urgency for the Item is that Assembly Bill 1000 is going to be heard in the local government committee in the State Assembly tomorrow, and several cities including Rialto has been requested to weigh in either in support or opposition. The recommendation is opposition to the bill.

For that committee to hear your position on it, the City Council needs to act on it tonight.

It will require a four-fifths vote to add. If you decide to add it, it can be placed anywhere on the agenda. A staff report will need to be created. I would suggest as adding it as TAB 3.

SUBSEQUENT NEED ITEM
Council Member Baca is opposed to the motion because the public was unaware of the Notice that had been taken up. If there were any problems, it should have been discussed with the author of the bill to determine if there could be a compromise. The public will not have the opportunity to voice their position in either support of or opposition.

We have the responsibility to allow the Assembly to decide what action they are going to take. If there are any City Council concerns, it needs to be addressed with the author of the Bill. It needs to be discussed with the author prior to opposing it. 0o0
Mayor Robertson asked if any other Council Member wished to add comments. 0o0
Council Member Trujillo stated that he and Assistant City Manager Brown joined a working group within The League of California Cities organization emphasizing on warehouse citing and design. He joined and included City staff to participate.

Several cities are opposing AB 1000 that remove local control. The hearing will take place tomorrow. Some cities have a legislative platform that allow their legislative staff to write correspondence on behalf of their City Council based on their platform. The City of Rialto does not have a legislative platform that staff can reference. Every time there needs to be a legislative letter, it needs to be generated by the City Council, it has to be brought before the body.

Rialto is joining other cities in opposition to AB 1000. One reason for the opposition, is local control and it endangers housing goals, fostering economic workload in the community. This is the State trying to direct the City’s local economic development decisions.

The working group took place on the same day the agenda was posted. 0o0
Council Member Scott stated he opposes AB 1000, which is not a bill the City is voting on. It’s a bill that the Assembly is voting on. He’s had an opportunity to speak to the office of the author of the bill and several Assembly Members in Sacramento.

His main opposition to AB 1000 is the State of California removes local control from cities. If we give up control, we no longer make decisions in our City that are best for our residents. 0o0
Mayor Robertson stated that the point is to make the decision to add to the agenda as a Subsequent Need Item. The Assembly Member has contacted me today to discuss matters, and Mayor Robertson communicated to the Assembly Member her opposition to AB 1000. 0o0

SUBSEQUENT NEED ITEM
Mayor Robertson stated AB 1000 becomes a crippling factor to the Rialto community, County, and small businesses. The bill does not impact all Counties in the State. It impacts San Bernardino and Riverside Counties. This impacts the economic flow and vitality of the community.

She will be advocating the bill that gives resources to small business and independent truck drivers that assists their trucks and equipment come into compliance.

She stated the City should have a legislative platform. They contracted a State lobbyist for that purpose, and they have not seen anything from the lobbyist. 0o0
Council Member Baca stated that the City Council is adding something and the public should have been informed. 0o0
Mayor Robertson emphasized the need for a subsequent need item. The City Council had no way of knowing. The City Council needs to have their voices heard. 0o0
Council Member Baca stated it should have been the responsibility of the lobbyist that was contracted which he voted against. 0o0
Mayor Robertson asked to call for the question.
0o0
Motion by Council Member Scott, second by Council Member Trujillo and carried by a 4-1 vote to add the Subsequent Need Item as TAB 3 to the agenda.

The vote was AYES: Mayor Robertson, Mayor Pro Tem Carrizales, Council Member Scott, Council Member Trujillo.

Motion by Mayor Pro Tem Carrizales, second by Council Member Scott and carried by a 5-0 vote to adopt the Consent Calendar except for F.6. 0o0
F.6
Position Allocation
Council Member Baca stated he believes the new City Manager should have input related to the position allocation suggested in F.6.

He inquired about the two new Assistant City Managers being proposed and asked about other cities comparable with the City of Rialto who also have two Assistant City Managers and how equal their salaries will be. He needs answers before approving. 0o0
Council Member Scott stated he is in favor of the Item and asked if the new prospective City Manager has been conferred on the matter. 0o0
Interim City Manager Garcia, stated yes. The prospective candidate is aware of the City’s organizational topics including on this topic. 0o0
Council Member Scott stated that this item does require First and Second Reading as stated by Council Member Baca. 0o0
Interim City Manager Garcia stated that is correct.
0o0
F.6
Position Allocation
Council Member Scott asked if he had selected the assignment of departments to each Assistant City Manager. 0o0
Interim City Manager Garcia stated he did in conjunction with the prospective new City Manager. 0o0
Mayor Robertson also inquired about the positions’ compensation and expressed her concerns with the absence of position announcement or recruitment for others to be considered. 0o0
Interim City Manager Garcia stated that the process was to not add an additional Assistant City Manager, Assistant to City Manager with the existing City Manager. My goal was to create an additional position and not a third entirely new position. The “Assistant to” would no longer exist.

The economy of scale was to look at the talent and appropriateness of what I had internally and have discussions with the prospective new City Manager. That is the reason for not doing the competitive process.

Another important piece is that it is a zero cost to the City. The City typically has cost savings from salary savings across the board in the general fund.

The subject related to comparability in salary, the existing Manager, and the new proposed, City Manager, at your discretion, will not have the same compensation. They are on a different part of that scale.

The cost is approximately $60,000. The new Assistant City Manager will come in at a lesser amount than the existing one. 0o0
Mayor Robertson expressed concerns with actions and the work chart layout and recommended tabling the Item. 0o0
Interim City Manager Garcia stated the work chart is for the City Council to choose. It is a launch. At the mid-year, it can be rearranged with the new City Manager. 0o0
Mayor Robertson asked when would mid-year discussion take place. 0o0
Interim City Manager Garcia stated it will be in mid-February or March. Not in January. 0o0
Mayor Robertson restated that the Item is a concern for her.

She asked that the Item be tabled for further discussion.

F.6
Position Allocation
Motion by Mayor Robertson, second by Council Member Baca and carried by a 2-3 vote to table the Consent Calendar Item F.6 for further discussion.

Tanya Williams, Assistant to the City Manager, presented staff report to Request City Council Approve a Letter of Opposition for Assembly Bill Qualifying Logistics Use Projects. 0o0
Public Comment
Prince Ogidikpe, with District Representative Assembly Member Eloise Gomez Reyes, addressed the City Council related to TAB 3 and read a statement from her office in support of AB 1000 informing the community of her open-door policy to discuss solutions for this and other issues. 0o0
Joaquin Castillegos addressed the City Council related to TAB3 and is requesting the City Council to write a letter of support and not opposition of AB 1000. He emphasized that pollutions impact families daily. This bill is to protect the lives of the future generations. 0o0
Brenda Parker addressed the City Council related to TAB 3 and is asking that they write a letter of support. She asked what the rush is if the City has already done the damage. There is no square foot to build a warehouse in a safe zone. She stated the City Council is not losing local control. They have taken and abused their local control specifically with the Rialto Specific Plan. She is very disappointed in the City Council. She stated their voices need to be on record, and the City Council still did not listen. The public should have had an opportunity to comment on AB 1000. What happened to Healthy Rialto? She asked that the public be allowed to comment.

TAB 3
Approve Letter of Opposition for Assembly Bill
Public Comment
Lupe Camacho addressed the City Council related to TAB 3. She stated there was plenty of ample time to place on the agenda and move through the proper channels. She asked the Council why they are doing something that clearly the public wants rather than for financial gain. She pleaded to the City Council to reconsider. 0o0
Pedro Molina addressed the City Council related to TAB 3 related to his support for AB1000. 0o0
City Attorney Vail stated this bill first went to print on February 15, 2023, made its way through some committees but died and failed to pass on its first hearing in April 2023. There had been no action on it till January 4, 2024, when the Committee Chair received author’s comments. It wasn’t until January 3, 2024, received author’s comments. And on January 4, 2024, the day our agenda was printed, it was re-referred to the committee on local government and it wasn’t until subsequent to that that we first hear that it would come up for hearing tomorrow. 0o0
Mayor Robertson emphasized that the bill died but had the ability to be brought back. It was surprising there was an action for Subsequent Need.

She asked if it had ever made it out of Committee.
0o0
City Attorney Vail stated it was in Committee to set first hearing on April 27, 2023 but failed passage. Reconsideration was granted but no other action took place until Wednesday, January 3, 2024, when the Committee Chair received author’s comments and a request to reconsider.

On Thursday, January 4, 2024, the day the agenda came out, was the day it was re-referred to the Committee on Local Government and it was subsequent to that that we heard that it was going to be taken up by the Committee tomorrow, January 10, 2024.

Anybody can look up the bill history information at California Legislative information at www.leginfo.legislator.ca.gov. 0o0
Mayor Robertson thanked the public for coming out. She was informed of the Subsequent Need Item by the Interim City Manager Garcia on Friday. Assembly Member James Ramos held a fact-finding meeting and invited the public. She was in the audience unaware of the bill. She made it clear she did not vote for the Pepper Avenue project. It was a majority vote. 0o0
TAB 3
Approve Letter of Opposition for Assembly Bill
Council Member Scott reiterated he is not opposed to restrictions and distances. He does not agree with the way the bill is written. Rialto developed a moratorium to establish distance restrictions between warehouse and residential and schools.

His objection to AB1000 is the State mandating laws that takes away local jurisdiction from cities. The bill is inclusive to San Bernardino and Riverside Counties. He believes it should be a State law and not specifically to a County. He is not in favor the State of California taking away local control. Local control belongs with the City. 0o0
Council Member Baca stated that there have been six warehouse bills before the City Council since he joined in December 2022. He has been opposed and voted against all six. He believes the better option would have been commercial retail in addition to job creation. Warehouses take up land and space. This action is not necessary.

Oftentimes in the State Legislature when a bill is presented, the bill is reconsidered, and amendments are made and fine-tuned. The City already has an Ordinance that is not being followed. The long-term health impacts are great. Before taking the final vote, he wants to revisit the matter. The City’s lobbyist should have informed the City Council. He objects to the Item and will vote no. 0o0
Mayor Robertson asked City Attorney Vail if the City has violated any rules. 0o0
City Attorney Vail stated the City Council has not violated any of procedural rules or the Brown Act. 0o0
Mayor Robertson emphasized that the lobbyist should have provided information, but they had no time to know that it would be placed. 0o0
Motion by Council Member Trujillo, second by Council Member Scott and carried by a 4-1 vote to Approve a Letter of Opposition for Assembly Bill Qualifying Logistics Use Projects.

The vote was AYES: Mayor Robertson, Mayor Pro Tem Carrizales, Council Member Scott and Council Member Trujillo.

NOES: Council Member Baca. ABSTAIN: None. ABSENT: None. 0o0
