FROM: Marcus L. Fuller, P.E., P.L.S., Public Works Director/City Engineer Request the City Council/Rialto Utility Authority to approve a Final Construction Work Authorization in the amount of $384,020 to Rialto Water Services for the Digester No. 1 Wall Cap and Coating Project, Concession Agreement Project S1.1.
(ACTION)
BACKGROUND:

The City of Rialto Wastewater Treatment Plant (WWTP) operates with two anaerobic digesters (Digester No. 1 and No. 2) where solids removed from the wastewater after the primary and secondary treatment processes are pumped to the two enclosed concrete tanks. There, the solids are heated and mixed for about 20 days to further break them down. The two Digesters are a critical part of the treatment process, and having two Digesters in operation provides redundancy and reliability at the WWTP. However, Digester No. 1 has been out of service for many years, and it is important to complete modifications to it to return it to service.

On May 6, 2008, the City Council authorized staff to enter into a contract with Siemens Water Technologies (Siemens, now known as Evoqua Water Technologies) for the procurement and City of Rialto Printed on 9/4/2014Page 1 of 4

Technologies (Siemens, now known as Evoqua Water Technologies) for the procurement and installation of two digester covers for a not to exceed cost of $1,508,800. Subsequently, a Purchase Order was issued to Siemens Water Technologies in the amount of $1,333,800 for the purchase and installation of the two covers. A copy of the May 6, 2008, staff report is included as Attachment 1.

On February 28, 2012, the City Council and the Rialto Utility Authority (RUA) awarded a construction contract to Environmental Logistics, Inc., to remove the existing fixed cover on Digester No. 1; this work was completed in July 2012.

On March 27, 2012 the City Council and the RUA took several actions related to approval of a Concession Agreement with Rialto Water Services, LP, (RWS) assigning operation and maintenance of the City’s water and sewer utilities to RWS. Pursuant to Schedule C “Existing Capital Improvement Projects To Be Completed By The City Of Rialto” of the Concession Agreement, two pre-existing capital improvement projects listed were specifically excluded from the Utility Facilities Improvements or capital Improvements for which RWS has responsibility for the design or construction. One of the capital improvement projects listed on Schedule C is:

Dystor at Digester #1 Retrofit
The City previously replaced the old Digester #2 cover with a Dystor cover by Siemens in 2008.

The Dystor cover provides a storage capacity of approximately 96,000 cubic feet and is fitted at the top of digesters and anchored to the concrete rim of the 72 feet diameter, 34 feet tall digester reservoirs. The Digester #1 cover is scheduled for replacement by the City as soon as the Phase I testing and commissioning is successfully completed. The scope of work for the installation of the Dystor on Digester #1 includes demolition and removal of the existing cover.

Concessionaire will not be performing the work described above, but Concessionaire will be required to coordinate with the City and its contractor and operate the Wastewater Treatment Plant in a manner that reasonably facilitates the installation of the Dystor on Digester #1. The replacement process will require draining the Digester #1 vessel and diverting all solids flow to the Digester #2 by Concessionaire during the construction. Typical replacement schedule is 4-6 weeks preparation and drainage cycle and 3-4 weeks installation and commissioning.

On July 9, 2013, the City Council approved an eighth amendment to the Wastewater Treatment Plant Operations and Maintenance Agreement with Veolia Water West Operating Services, Inc. (Veolia).

This agreement with Veolia was initially approved by the City Council on April 29, 2003, (the 2003 Service Agreement), and established Veolia as the operator of the City’s wastewater collection system and wastewater treatment plant. The 2003 Service Agreement was superseded by the Concession Agreement approved in 2012; however, the eighth amendment to the 2003 Service Agreement with Veolia maintained limited responsibilities with Veolia related to sludge disposal, and coordination of the City’stwo pre-existing capital projects identified in the Concession Agreement (including the Digester No. 1 project).

ANALYSIS/DISCUSSION:

Following removal of the cover on Digester No. 1, staff coordinated with Siemens to schedule installation of the Dystor cover that was previously purchased in 2008. However, after an inspection of Digester No. 1 by Siemens, Siemens advised staff that the condition and thickness of the existing City of Rialto Printed on 9/4/2014Page 2 of 4

File #: 14-657, Version: 1
of Digester No. 1 by Siemens, Siemens advised staff that the condition and thickness of the existing wall was insufficient to structurally support installation of the Dystor cover. Typically, a Dystor cover is mounted on the top edge of the Digester wall, and anchored to a smooth concrete rim with a minimum thickness of 12 inches. The existing wall at Digester No. 1 is less than 11 inches, and has some damaged edges which makes the condition unsuitable for the Dystor installation. Photos of the existing Digester No. 1 wall are included as Attachment 2 . Siemens recommended that the City structurally modify the existing wall by constructing a concrete cap on which the Dystor cover can be installed.

Based on this direction, staff had an engineering design prepared for the structural modifications to the Digester No. 1 wall, and had initially intended to assign this as a pre-existing project to Veolia under their amended 2003 Service Agreement. However, given the modifications required to Digester No. 1 to facilitate installation of the Dystor cover, staff requested that RWS initiate these modifications as a new project under the Concession Agreement, pursuant to Section 6.10(b), which states:

Authority may initiate a Capital Project by submitting a written request to Concessionaire identifying a proposed Wastewater Facility modification and the specific reasons for such requested Capital Project. Authority and Concessionaire shall confer regarding the need for such Capital Project, alternatives to the requested Capital Project, and potential impacts of such Capital Project on performance of the Wastewater Facility.

Also, to take advantage of the fact that Digester No. 1 is out of service, staff requested that RWS also include installation of a protective coating within the interior of the Digester that is exposed to acidic gases above the sludge (the top 4 feet of the Digester).

RWS agreed to incorporate this work as a new capital improvement project under the Concession Agreement, identified as Project S1.1. On May 5, 2015, RWS submitted a Conceptual Design Report (CDR) for Project S1.1, which was subsequently reviewed and approved by staff on May 8, 2014. A copy of the CDR is included as Attachment 3 . Final specifications and contract documents were prepared by RWS and approved for construction. Veolia solicited a bid of $295,400 from DN Tanks, a contractor that specializes in this type of construction on concrete tanks. The total cost of Project S1.1 is determined by applying the construction cost amount as a percentage for certain project implementation costs identified in the Concession Agreement, as follows:
·· Contingency (10%)
·· Project Development (1%)
·· Detailed Design and Permitting/Bidding Support (6%)
·· Construction Phase Engineering Services (5%)
·· Project Management Services (8%)
Therefore, a total of 30% is applied to the construction cost to compensate RWS for all project design and implementation costs in delivering the project. Pursuant to Section 6.3(c) of the Concession Agreement, RWS has submitted a request to the City for issuance of a “Final Construction Work Authorization” (or FCWA), in the amount of $384,020; a copy of the FCWA is included as Attachment 4.

Upon approval of the FCWA, RWS will proceed with construction of a concrete collar around the top of Digester No. 1 to provide a 14 inch wide smooth concrete surface for the future installation of the Dystor cover, and will also apply an elastomeric coating of the top 4 feet of the Digester No. 1 City of Rialto Printed on 9/4/2014Page 3 of 4

Dystor cover, and will also apply an elastomeric coating of the top 4 feet of the Digester No. 1 interior. The total not to exceed amount of the FCWA is $384,020.

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act (CEQA). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15302 “Replacement or Reconstruction,” of the CEQA Guidelines, a Class 2 project consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The replacement of the existing cover at Digester No. 1 is considered a Class 2 project, and is categorically exempt from CEQA. A Notice of Exemption was previously filed in 2008, and is included as Attachment 5.

GENERAL PLAN CONSISTENCY:

Approval of this action complies with the City of Rialto General Plan Goal and Policies:

Goal 3-9: Upgrade and maintain an improved wastewater system with adequate plant efficiency and capacity to protect the health and safety of all Rialto residents, businesses, and institutions.

Policy 3-9.2: Evaluate the wastewater disposal system routinely to ensure its adequacy to meet changes in demand and changes in types of waste.

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report.

FINANCIAL IMPACT:

Sufficient funding in the amount of $384,020 for the Digester No. 1 Wall Cap and Coating Project, Concession Agreement Project S1.1, is budgeted and available in the Wastewater Fund Account No. 660-500-7860-3001-140501.

RECOMMENDATION:

Staff recommends that the City Council/Rialto Utility Authority approve a Final Construction Work Authorization in the amount of $384,020 to Rialto Water Services for the Digester No. 1 Wall Cap and Coating Project, Concession Agreement Project S1.1.

S1.1 Digester No. 1 Wall Cap and Coating Project

Introduction
In 2010 The City of Rialto purchased Dystor inflatable lids for the two existing digesters, Digester No. 1 and Digester No. 2. Digester No. 2 is a conventional concrete structure that provided enough room on the top of the wall to allow the Dystor lid to be mounted. Digester No. 1 is a pre-stressed wire wrapped tank that has thinner walls that does not have enough room to mount a Dystor lid. Observations at the site also indicate that the existing piping inside the digester has been exposed to the elements for an extended period of time and needs to be recoated, the top of the digester exposed to digester gas should be coated to prevent damage to the digester wall, the existing man-ways need to be rehabilitated and recoated, and the seal at the bottom of the tank has squeezed out of the joint and needs to be replaced. In order to have a reliable digester, the following improvements to the tank are proposed (as described in S1.1):
• Construct a cap on top of the existing tank wall that has sufficient width to allow the installation of a Dystor lid.
• Prepare and coat, with a suitable coating, the interior piping. Install blind flange on open interior pipe.

• Prepare and coat the top 4ft+- of the interior wall.
• Rehabilitate the two access ways into the tank interior.

• Remove and replace the accessible portions of the seal at the bottom of the tank. (no picture provided)

Conceptual Design

Construct Cap on top of tank
• Construct a 1ft high by 1.2ft wide cap on top of the existing digester wall. Install vertical dowels into the existing wall to support the cap. See Appendix A for wall details and Appendix B for calculations.
• Patch spalled concrete at the inside top surface of the tank wall as required for the installation of the wall cap and chipping, cleaning and patching of exposed reinforcing steel at the top interior surface of the tank wall.

Interior Piping Coating and Access Way Rehabilitation
• Furnish and install one new blind Flange.
• Clean and prepare interior piping and two access hatch frames and doors, including sandblasting as required, to provide a sound surface for the application of an epoxy coating. Coat the ferrous surfaces of the pipe, blind flange and access hatch frames with an epoxy coating.

Interior Digester Wall Coating
• Remove back any embedded steel items from the surface of the wall as required including chipping and patching of concrete to restore the wall surface. • Clean by high pressure water blast the top 4’ of the tank wall, after wall cap installation. • Incidental remedial work required to the tank wall including minor patching to provide a sound surface for the application of an elastomeric coating.
• Apply CIM 1000, an asphalt extended urethane coating to the top four feet of the tank wall after the wall cap has been installed.

Remove and Repair Seal Around Bottom of Tank Floor
• Remove existing joint sealant at floor/wall joint as accessable. • Perform incidental remedial work to the floor /wall joint to provide a sound surface for the application of an elastomeric coating.
• Dry the tank interior and apply CIM 1061 reinforced with polyester scrim to the floor/wall joint.

Governmental Approvals Required
• None identified.
