result of the exercise by City of its full rights of ownership use, reuse, or assignment of the documents and materials hereunder. Any use, reuse or assignment of such completed documents for other projects and/or use of uncompleted documents withou t
specific written authorization by the Consultant will be at the City’s sole risk and without liability to Consultant, and Consultant’s guarantee and warranties shall not extend to such use, reuse or assignment. Consultant may retain copies of such docum ents for its own
use. Consultant shall have the right to use the concepts embodied therein. All subcontractors shall provide for assignment to City any documents or materials prepared by them, and in the event Consultant fails to secure such assignment, Consultant shall
indemnify City for all damages resulting therefrom.

6.4 Confidentiality and Release of Information.

(a)

All information gained or work product produced by Consultant in performance of this Agreement shall be considered confidential, unless

such information
is in the public domain or already known to Consultant. Consultant shall not release or disclose any such information or work product to persons or entities other than City without prior written authorization from the Contract Officer.

(
b)

Consultant, its officers, employees, agents or subcontractors, shall not, without prior written authorization from the Contract Officer or unless requested by the City Attorney, voluntarily provide documents, declarations, letters of support, testimony
at depositions, response to interrogatories or other information concerning the work performed under this Agreement. Response to a subpoena or court order shall not be considered “voluntary” provided Consultant gives City notice of such court order or sub
poena.

(c)

If Consultant, or any officer, employee, agent or subcontractor of Consultant, provides any information or work product in violation of this Agreement, then City shall have the right to reimbursement and indemnity from Consultant for any damages
, costs and fees, including attorney’s fees, caused by or incurred as a result of Consultant’s conduct.

(d)

Consultant shall promptly notify City should Consultant, its officers, employees, agents, or subcontractors be served with any summons, complaint, s
ubpoena, notice of deposition, request for documents, interrogatories, request for admissions or other discovery request, court order or subpoena from any party regarding this Agreement and the work performed there under. City retains the right, but has n o
obligation, to represent Consultant or be present at any deposition, hearing or similar proceeding. Consultant agrees to cooperate fully with City and to provide City with the opportunity to review any response to discovery requests provided by Consulta nt.

However, this right to review any such response does not imply or mean the right by City to control, direct, or rewrite said response.

ARTICLE 7.

ENFORCEMENT OF AGREEMENT AND TERMINATION

7.1 California Law.

This Agreement shall be interpreted, constr
ued, and governed both as to validity
and to performance of the Parties in accordance with the laws of the State of California.

Legal actions concerning any dispute, claim, or matter arising out of or in relation to this Agreement shall be instituted in t
he Superior Court of the County of San Bernardino, State of California, or any other appropriate court in such county, and Consultant covenants and agrees to submit to the personal jurisdiction of such court in the event of such action.

In the event of li
tigation in a U.S. District Court, venue shall lie exclusively in the Central District of California, Eastern Division.

7.2 Disputes; Default.

In the event that Consultant is in default under the terms of this Agreement, the City shall not have any obligat
ion or duty to continue compensating Consultant for any work performed after the date of default. Instead, the City may give notice to Consultant of the default and the reasons for the default. The notice shall include the timeframe in which Consultant m
ay cure the default. This timeframe is presumptively thirty (30) days, but may be extended, though not reduced, if circumstances warrant. During the period of time that Consultant is in default, the City shall hold all invoices and shall proceed with pay
ment on the invoices only when the default is cured. In the alternative, the City may, in its sole discretion, elect to pay some or all of the outstanding invoices during the period of default. If Consultant does not cure the default, the City may take n ecessary steps to
terminate this Agreement under this Article. Any failure on the part of the City to give notice of the Consultant’s default shall not be deemed to result in a waiver of the City’s legal rights or any rights arising out of any provision o f this Agreement.

7.3 Retention of Funds.

Consultant hereby authorizes City to deduct from any amount payable to Consultant (whether or not arising out of this Agreement) (i) any amounts the payment of which may be in dispute hereunder or which are
necessary to compensate City for any
losses, costs, liabilities, or damages suffered by City, and (ii) all amounts for which City may be liable to third parties, by reason of Consultant’s acts or omissions in performing or failing to perform Consultant’s o
bligation under this Agreement. In the event that any
claim is made by a third party, the amount or validity of which is disputed by Consultant, or any indebtedness shall exist which shall appear to be the basis for a claim of lien, City may withhold from

any payment due, without liability for interest because of such withholding, an amount sufficient to cover such claim. The failure of City to exercise such right to deduct or to withhold shall not, however, affect the obligations of the Consultant to ins
ure, indemnify, and protect City as elsewhere provided herein.

7.4 Waiver.

Waiver by any Party to this Agreement of any term, condition, or covenant of this Agreement shall not constitute a waiver of any other term, condition, or covenant. Waiver by any

Party of any breach of the provisions of this Agreement shall not constitute a waiver of any other provision or a waiver of any subsequent breach or violation of any provision of this Agreement. Acceptance by City of any work or services by Consultant sh
all not constitute a waiver of any of the provisions of this Agreement. No delay or omission in the exercise of any right or remedy by a non -
defaulting Party on any default
shall impair such right or remedy or be construed as a waiver. Any waiver by eith er Party
of any default must be in writing and shall not be a waiver of any other default concerning the same or any other provision of this Agreement.

7.5 Rights and Remedies are Cumulative.

Except with respect to rights and remedies expressly declared to

be exclusive in
this Agreement, the rights and remedies of the Parties are cumulative and the exercise by either Party of one or more of such rights or remedies shall not preclude the exercise by it, at the same or different times, of any other rights or remedies for the same default
or any other default by the other Party.

7.6 Legal Action.

In addition to any other rights or remedies, either Party may take legal action, in law or in equity, to cure, correct, or remedy any default, to recover damages for a ny
default, to compel specific performance of this Agreement, to obtain declaratory or injunctive relief, or to obtain any other remedy consistent with the purposes of this Agreement.

7. 7

Termination Prior to Expiration of Term.

This Section shall govern a
ny termination of this Contract except as specifically
provided in the following Section for termination for cause. City reserves the right to terminate this Contract at any time, with or without cause, upon thirty (30) days’ written notice to Consultant,

except that where termination is due to the fault of the Consultant, the period of notice may be such shorter time as may be determined by the Contract Officer. In addition, the Consultant reserves the right to terminate this Contract at any time, with o
r without cause, upon sixty (60) days’ written notice to City, except that where termination is due to the fault of the City, the period of notice may be such shorter time as the Consultant may determine. Upon receipt of any notice of termination, Consult ant
shall immediately cease all services hereunder except such as may be specifically approved by the Contract Officer. Except where the Consultant has initiated termination, the Consultant shall be entitled to compensation for all services rendered prior

to the
effective date of the notice of termination and for any services authorized by the Contract Officer thereafter in accordance with the Schedule of Compensation or such as may be approved by the Contract Officer, except as provided in Section 7.3. I n the event the
Consultant has initiated termination, the Consultant shall be entitled to compensation only for the reasonable value of the work product actually produced hereunder. In the event of termination without cause pursuant to this Section, the t erminating Party need not

15 Revised 11/11/2021

7. 8

Termination for Default of Consultant.

If termination is due to the failure of the Consultant to fulfill its obligations under this
Agreement, City may, after compliance with the provisions of Section 7.2, take over the work and prosecute the same to completion by contract or otherwise, and the Consultant shall be liable to the extent that the total cost for completion of the services required hereunder exceeds the compensation herein stipulated (provided that the City shall use reasonable efforts to mitigate such damages), and City may withhold any payments to the Consultant for the purpose of set

8.2 Conflict of Interest.

Consultant covenants that neither it,

marital status, national origin, ancestry, or other
protected class.

8.4 Unauthorized Aliens.

Consultant hereby promise
s and agrees to comply with all of the provisions of the Federal Immigration and Nationality Act, 8

U.S.C.A. §§

1101,
et seq
., as amended, and
in connection therewith, shall not employ unauthorized aliens as defined therein. Should Consultant so employ s

SCOPE OF SERVICES

Consultant shall
provide
:

A) Establishing a two
-
part citywide accessibility plan in accordance with
requirements of Title II,

§35.150 of the Americans with Disabilities Act (ADA). The two parts of this accessibility plan shall be for

areas within the City of Rialto Right of Way and for City of Rialto Public Facilities.

B) Revising and expand City of Rialto Standard Drawings and g eneral notes to
address conflicts with

federal and State regulations and codes for accessibility and provide design and construction tools for

improved access at major intersections and

C) Provide guidelines for use by engineers in the preparation for plan s for
improvements in the public

right of way
.

Specifically, Consultant shall provide those services as outlined in its proposal dated November 22, 2021
, included on the following pages.

A. 1
Understanding

Sally Swanson Architects, inc. (SSA) understands that the city of rialto, california, located in San Bernardino county,

seeks a professional firm to conduct a Scope of Work that includes

•

Public Right
-
of
-
Way and,

•

Public Facilit
ies Americans with Disab
ilities Act (ADA) Transition Plan This Scope of Work will establish a two -
part City
-
wide accessibility plan; revise and expand the City of Rialto Standard Drawings and general notes to address conflicts with federal and state regula
tions and codes and prov
ide guidelines for engineers for
improvements in the public right
-
of
-
way.

Further, it is understood that this is a Statement of Qualifications submittal, as “price is not evaluated as part of the evaluation criteria”. The City of R
ialto will negotiate the

terms and conditions of the contract with the
selected firm.

A.2
Methodology

The City of Rialto Scope of Services as outlined in the Request for Qualifications (RFQ) is quite clear and SSA will meet or exceed all requirements
of the contract. The pro
ject approach is flexible and will be tailored precisely to fit the City’s needs and resources.

Critical Elements

Following are the elements and benefits of the City’s manageable and living ADA Transition Plan document. The Access

Compliance Assessment S
urvey will provide the City with:

•

A list of existing accessibility barriers describing each barrier and recommendation of a removal solution

•

A preliminary cost estimate for removal of each barrier

•

A priority assigned to each ba
rrier

•

A schedule for barrier removal

•

Designation of a person responsible for barrier removal

•

The ability to “check
-
off” mitigated barriers

•

The ability to easily demonstrate steps taken toward removal of all barriers to acc ess.

At a minimum, SSA, if s
elected, will be responsible for providing the services described below:

Task 1. Oversee the Development and Execution of the ADA Transition Plan

Sally Swanson Architects, Inc. (SSA) plans to attend at least four meetings wi th City staff and an ADA advis
ory
group, including an initial kick
-
off meeting; interim progress meetings shall be at approximately 50%, 75%, and 90% completion. SSA will also attend and present the ADA Transition Plan to the City Council at a public meeti ng.

SSA will attend a kick
-
off

meeting with the City to confirm the scope of work before advancing Tasks. SSA will identify all materials required to furnish a transition plan and coordinate with key City personnel, and other stakeholders, as required. SSA

will coordinate involvement o
f various stakeholders to include appropriate City
staff, disability advocacy groups, and the general public throughout the process.

a. Administration and Management

Upon award of the contract, SSA will begin the process of reviewing background informati
on and documents as
well as planning, coordinating and scheduling a Project kick -
off. Many project components discussed here
regarding contacts, project schedule and communications will be agreed upon prior to an official proj ect kick
-
offvia email and phon
e conversations. SSA will manage its team including other administrative functions and overall Project activities consistent with the direction from the City of Rialto in order to meet the Project schedule and budget during th
e course of services.

SSA will coordinate with the City of Rialto, other government agencies and other affected parties as required throughout the duration of the Project. The SSA Project Team will arrange to meet via virtual conference technology, at the City of Rialto discr
et
ion, with the City staff and other appropriate stakeholders to review, refine, and finalize the scope of work, programmatic evaluations, and completion schedules, as well as project communications, final deliverables and overall project strategies and go
al
s.

Project Schedule

SSA will use Microsoft Project to develop schedules including critical tasks. SSA will prepare, monitor, and update progress schedule beginning at the kickoff meeting and ending at City’s acceptance of the final report for the Proj
ec
t. Schedule will indicate significant milestones and the critical path for the Project. SSA will notify City if there are delays in any phase or Task of the Project. In such cases, SSA will make up the schedule in subsequent Tasks of the Project or provi
de

information to City substantiating a time extension. The schedule will be maintained and kept updated at all times and will be updated each time progress and milestones are changed. In addition, the progress schedule will be updated no less frequently t ha
n after each task is complete.

Invoicing

SSA will submit monthly invoice payments with a progress report summarizing partially or completed scope of

work for processing.

QA/QC

QA/QC routines begin before the mission. It is the first management a ct
ivity to ensure that a process, item, or
service is of the quality expected by the user, as well as to create management controls that address planning, implementation and review of data collection activities. Subsequent QA/QC activities provide routines

a
nd
consistency checks to ensure project integrity, correctness, and completeness.Concurrent with the compilation of the report, all drawings and data will be reviewed and double -
checked for accuracy and viability. The ADAAG,
ADAS and the California Build
in
g Code cited will be verified and the barrier location examined to ensure accuracy and the highest quality report.

Because SSA does not utilize sub consultants when conducting ADA Transition Plans, SSA can better control accuracy in the collection and c
om
pilation of the data and quality of the final report. Only SSA staff will be conducting the process.

SSA will QA/QC all materials prior to submittal to the City of Rialto.

b. Coordination with Local Groups Representing Persons with Disabilities

SSA wi
ll coordinate with the city of rialto for public outreach to local, regional groups that represent persons with

disabilities.

c. Attend Kick
-
Off, Interim Progress and Final Completion Meetings

The kick
-
off meeting is the opportunity for the City s
taff a
nd SSA staff to review and refine the scope of work,
completion schedules, as well as project communications, final deliverables and overall project strategies and goals. SSA will record and distribute Meeting Minutes to ensure project -
wide understan
ding a
nd accord of all
decisions taken at the kick
-
off meeting. At the City discretion, the kick
-
off meeting can be conducted via virtual

conference technology.

SSA will schedule Interim and final completion meetings (via virtual conference technology at

the C
ity discretion)
to be conducted with designated City staff at 50%, 75% & 90% completion to review anticipated Tasks and schedule, review available information and needs, and address any outstanding questions regarding the project continuing to move f
orward

raised by City or SSA.

Deliverables include:

Four (4) staff meetings and (1) City Council meeting. Digital copy of monthly project status updates. Presentation and meeting materials to be included in this task. Digital copy of meeting minutes.

Task 2. Accessibility in Public Rights
-
of
-
Way (PRoW)

a.

Inventory Review

Prior to performing the physical survey of City Public Right -
of
-
Way, SSA will prepare a rating system for the non
-
compliant items to facilitate identifying and cataloging the t ype and severity of distress to be used in data
collection for City’s review and

approval.

SSA will also review the City’s available inventory list and GIS data to confirm locations of sidewalk, curb ramp and pedestrian signals adjacent to approximately 2
80 centerline miles of streets. Upon completion of the
inventory review, SSA wil
l confirm the final PRoW elements inventory counts with the City before beginning subsequent physical survey.

b.

Physical Surveys of City PRoW (Estimated 560 Miles Sidewalks,

10,360 CRs, 1,658 Pedestrian
Signals, the final counts of PRoW elements will be

re
-
evaluated with the City during contract
negotiation.)

For the pedestrian infrastructure inventory of the Public Rights -
of
-
Way, SSA proposes to use a unique but proven
prop
rietary technology to document barriers and prioritize improvements where they a re most needed. Similar
technology, originally developed through a pilot program with the Federal Highway Administration (FHWA), has been implemented for the field inventory of

pedestrian facilities in many other cities. The device is designed to measure t
he sidewalk surface at a rate of thousands of records per second capturing highly accurate information about slope and small surface variations identifying deviations from requ ired ADA standards and other applicable
technical requirements codes. A notebook

computer on the surface profiler offers an interactive, real -
time
display during data collection.

For sidewalk cross
-
slopes, running slopes, vertical changes in level and obs tructions, the measuring equipment
provides a location and precise measurement o
f the barriers. Since most of the operation of this equipment is automated, the data collection will be consistent throughout the project area. This methodology has been used s
uccessfully on previous projects, saving immeasurable time and money while provi ding a superior deliverable
for our clients. The data collected will be stored in a geodatabase which will form an optional deliverable for this project.

SSA’s Accessibility S
urveyors will collect the required information for the curb ramps and traffic si gnals
throughout the City
-
owned streets. A data collection checklist, based on ADA and DOT requirements as well as PROWAG recommendations, will be pre
-
programmed into handheld
data collectors. Using traditional measuring
and smart
-
level equipment, Accessib
ility Surveyors will enter data directly into the data collectors.

SSA will use handheld computers to input measurements in the field and identify the precise geographic locat ion
of the pedestrian features. Data collection, data validation, and linking to

location and digital photo files will
happen automatically as the Accessibility Surveyors enter data and move from point to point. The Accessibility Surveyors will access the
data entry and validation forms and aerial photography along with right -
of
-
way,
utility,
topographic, or other feature data sets pre
-
loaded on the data collectors for easy reference in the field. This is very important as the logistics for the day’s work w
ill be identified on the map to keep the project on schedule and to minimize the

possibility of missing an important feature in the field.

c.

Draft Pubic Right
-
of
-
Way Access Compliance Assessment Reports

Once review of the field data is complete; SSA wi
ll originate the Draft Physical Survey Reports / Access Compliance Assessment Reports (ACAR) identifying each physical element within the City’s Public Right -
of
-
Way
that constitutes a code violation or other
wise hinders or prevents access to persons with d
isabilities.

SSA will present
draft Public Right
-
of
-
Way survey reports
and re
cord feedback
from the City team.

SSA will plan and
facilitate review
meetings via virtual
conference
technology with the City staff as required to assure their familiarity

with the draft reports developed under the plan and
address any questions or commen
ts in a timely manner.

Each ACAR will include, but is not limited to the following:

•

Executive summary;

•

As
-
built dimensions as it relates to ADA and other relevant code/guideline access;

•

Barrier Severity Rating (relative level of impact to access);

•

Prioritization & Severity

Rating;

•

Reference to code defining the barrier to access;

•

Proposed solution(s) to

eliminate the barrier;

•

Individual conceptual cost estimate for each solution;

•

Digital photograph(s) of each barrier to access;

•

Reference drawing/map showing the locatio
n of the barrier.

d. Final Public Right
-
of
-
Way Access Compliance Assessment Reports

SSA will incorporate all comments and prepare final Public Rights -
of
-
Way survey

reports. The survey reports will
be included in the ADA Transition Plan report to b
e completed under a subsequent Task.

Deliverables include:

City’s Public Right
-
of
-
Way Access Compliance Assessment Reports in PDF format.

Task 3. Accessibility in City

Owned and Operated Facilities

a. Inventory Review

SSA will review the inventory, previous studies, and planned capital improvement projects that may modify existing facilities. SSA will review the complete City inventory to confirm which facilities prov ide public access
and are not required to be surveyed
. SSA will review each facility indetail to determine what area of the facility are subject to public accommodation and are required to be surveyed, and which areas are not considered public accommodatio
ns and are not required to be surveyed.

SSA will wor
k with City staff, including City’s legal counsel and/or Risk Management staff when appropriate, to determine if City
-
owned facilities leased or used by other entities are required to be covered under th e Physical
Survey Task and the Transition Plan. This
determination will be made prior to performing physical surveys.

Upon completion of the inventory review, SSA will deliver a final facility inventory before beginning subsequent physical survey.

b. Fac
ility Diagrams

SSA’s site and facility reports will
include schematic site and floor plans (provided to SSA by the City) on 8.5” x 11” sheets to facilitate locating barriers identified in the ADA Transition Plan. These key drawings correspond to items in
the ADA Transition Plan.

c. Physical Surveys of City

Buildings & Parks per RFQ Attachment E

SSA will conduct surveys of all City buildings & parks, on the inventory list to identify and locate all physical barriers to access. SSA will be responsible for
determining and identifying the applicable accessibil
ity standards
and codes under which features will be measured and confirm the standards and codes with the City prior to performing the surveys.

Interior:

Survey will

i
nclude all interior areas accessible to and by the general public (and select employee areas where there may be an opportunity to develop program alternatives and options for value engineering); entrances and exits; interior paths of travel; lobbies; pub
li
c counters; seated waiting areas; public telephones (including TTY); drinking fountains; elevators; platform lifts; doors and gates; access to and through all rooms and spaces; corridors, hallways and vestibules; restrooms; room identification signs; are
as

of rescue assistance; assembly areas; assistive listening systems; and alarms.

SSA will determine specific features to be surveyed as required and as applicable under the accessibility standards and codes. Field surveys of facility/buildings (including interiors, accessible parking, passenger drop -
off
and loading zones, pedestrian
pa
thways, restrooms, etc.) shall include the collection and precise documentation of field data for accessibility elements at each site identified in the scope of work. For City parks, SSA will conduct surveys to include paths, parking lots, restrooms, ame
ni
ties, sport and play areas to identify and locate all
physical barriers

to access.

Field survey assessments will be done in the most unobtrusive manner possible to afford the least disruption to the City’s business. SSA field survey staff will use the ap
plicable current code standards; the updated 2010
regulations of Title II of the ADA, the Americans with Disabilities Act Accessibility Guidelines (ADAAG), and the 2019 edition of the California Code of Regulations/Title 24 and as applicable, the Califor ni
a Building Code (CBC).

Elements required to be accessible and covered by the surveys will include the following:

Site Exterior:

-
of
-
way; accessib
le

parking spaces; passenger drop
-
off and loading zones; walks and sidewalks; curb
ramps; other ramps; way
-
finding signage; exterior elevators, lifts and where paths of travel from public transit or public parking serve the facility.

d. Draft Buildings & Parks Access Compliance Assessment Reports

Once review of the field data is complete; SSA will originate the Draft Physical Survey Reports / Access C
om
pliance Assessment Reports (ACAR) identifying each physical element within the public areas of City facilities that constitutes a code violation or otherwise hinders or prevents access to persons with disabilities.

Each ACAR will include, but is not lim
it
ed to the following:

•

Executive summary;

•

As
-
built dimensions as it relates to ADA and other relevant code/guideline access;

f. Draft Monitoring Database in Excel and Grievance Procedure

Once review of the field data is complete, SSA’s technical staff will handle the important task

of d
ata entry. SSA
has developed an excellent computer
-
based tool, which provides a variety of accessibility functions. SSA’s FileMaker database is a relational database program that assembles, organizes and maintains field survey data; maintains records
of as
-
built conditions (actual measurements), code requirements (required measurements), conceptual cost estimates, and recommendations for solutions for the removal of non -
compliant access barriers.

The program will also generate the access compliance sur vey r
eport.

The FileMaker database will list the identified barriers in a report format that cites all deviations from applicable accessibility requirements contained in the 1991 (revised in 1994) Americans with Disabilities Act Accessibility Guidelines a
nd 20
10 Americans with Disabilities Act Accessibility Standards and the International Building Code, as well as California Building Code 2019. The format will allow sorting of recorded information by location, type, severity, category, cost of identified b
arrie
rs, etc.

This flexible tool can be easily modified to handle specific client requests and sorting functions; for example, listing the associated costs of updating non
-
compliant hardware at building entrances within a particular facility.

All building

and
parks data is exportable and compatible with a variety of formats including Microsoft Excel (*.xls), Access (*.dbf) and Adobe Acrobat (*.pdf).

The inventory database will be submitted as a draft for City review and comment, and comments shall be inco
rpora
ted into the final version.

In addition, SSA will develop and share a Grievance procedure for resolving discriminatory claims.

SSA will also train designated City staff in the following area:

•

Using and maintaining the database

•

Implementing the Gri
evanc

Task 5. Public Outreach/
Meetings

SSA will assist the City of Rialto in hosting outreach events, and soliciting input from stakeholders, per ADA §35.150(d)(1) during the development of the transition plan: “ …
A public entity shall provide an opportunit
y to
interested persons, incl
uding individuals with disabilities or organizations presenting individuals with disabilities, to participate in the development of the transition plan”

a. Administration Including Presentation, Agenda, Materials & Minutes

Pu
blic Outreach Meeting Conting
ency Plan

Social distancing and sheltering in place are the new normal, but public vetting of the Transition and Self -
Evaluation plan is still required by law. Even if the world returns to ‘normal’ anytime soon, it’s likely tha t
communities of people with
disabilities may not want to attend in
-
person gatherings because they may be more
susceptible to

ongoing health issues.

In order to help the City to meet its legal obligations for public vetting of this Transition Plan, Sally

Swanson
Architects proposes
the following Virtual Town Hall Contingency Plan that can be implemented at the City’s discretion.

SSA will host “virtual” Town Halls along with online surveys that can be noticed to the public through the City’s marketing cha
nnels (e.g. websites, newslet
ters, email blasts).

Virtual Town Hall

•

Set up virtual town hall meetings via Zoom Webinar.

•

Anyone who wishes to participate will need to register (for security, to ensure participants can access, and to support subsequent

follow up if needed).

•

Zoom Town Hall meetings will feature ASL and live captioning provided by the City.

•

City and SSA will c
o
-
facilitate the Town Halls, presenting an overview of Transition Plan findings and offering an opportunity for public comment.

•

SS
A will moderate participation to ensure all questions are addressed, and all who wish to have an opportunity to comment are in
vited to do so.

•

•

During Zoom Town Halls, participants will be invited to use video conference features such as:

•

o Raise hands
(to make comments or ask questions).

•

o Chat box (to make comments or ask questions).

•

o Q&A.

•

Meetings will be recorded and m
ade available for later viewing, if the City wishes.

•

Anyone who is unable to attend may submit a public comment via email, in wri ting, or by
phone.

•

Meeting organizers document all comments made by participants

Surveys

•

SSA will develop a post
-
town

halls survey to be sent out to participants after town halls, if the City

wishes.

Share the Results

•

Create short reports with the data, results and input from the online surveys and virtual town halls input.

•

Share reports with the public.

•

Thank community members for their participation and ensure that their feedback will be

part of the final

repor
ts.

Task 7. City Programs and Services (Optional)

At the City’s direction, SSA will evaluate municipal codes, master plans, programs, city contract language, and activities for compliance with ADA and California accessibility requirements.

a. Identify Programs and Services and Associated Policies and Procedures

SSA will review City policies, documentation, and program procedures to identify issues which may be discriminatory to people with disabilities. The review will include City poli cy documents that affect the public.

This evaluation will factor in current le
vel of program accessibility, including eligibility requirements, participation requirements, facilities used eligibility, staffing, transportation, communication, emergency proc
edures and grievance procedures

for accessibility.

SSA will identify and obt
ain all necessary documents and materials to conduct the audit process and survey. SSA will review existing City documentation, departmental and facility rules and regulations, p lanning documents and
any other written policy documentation provided by the C ity and identified as relevant by SSA. SSA will assist the City in identifying the documents and materials needed for review that the City is to furnish and request such document
s and materials from the City.

SSA will assist the City in developing the too
ls and procedures needed to conduct a Self
-
Evaluation and
implement recommendations in accordance with the guidelines and requirements of the Americans with Disabilities Act.

b. Selecting Key Personnel Including Orientation Meeting

SSA will coordinate

with designated key City staff to orient staff with the Self -
Evaluation process, including type
of information that will be requested in staff surveys and how the information wi ll be used for the Self
-
Evaluation. SSA will assist the City in identifying wh
at staff/departments shall be considered as key staff to coordinate with.

SSA meets with designated key City staff via virtual conference technology (at the City discretion) to orient
staffon the Self
-
Evaluation process, including types of information tha
t will be requested in staff surveys and how
the information will be used for the Self
-
Evaluation.

•

SSA assists the City in identifying what staff/departments will be considered as key staff to attend
the meeting.

•

SSA administers a staff survey to evaluat
e the level of program accessibility within each City
department.

tional information that may be helpful in the evaluation of City -
wide and program
-
specific
policies, practices and procedures.

•

If needed, SSA ma
y conduct brief phone or in
-
person interviews with survey respondents to discuss
initial find¬ings and follow
-
u
p with additional questions, if necessary.

•

Finally, SSA drafts a report and recommendations for the City to review.

•

Following City review, disc
ussion and integration of public comment, SSA prepares a final survey document.

SSA understands that some sur
vey respondents may not have in
-
depth knowledge of the ADA and accessibility
concepts, and that some Cities may have heightened sensitivity to th is process. SSA ensures that, throughout the
entire survey process, SSA is available to answer any questions, a nd work closely with the City to ensure
maximum comfort and security with the process and results.

SSA will incorporate all comments and
prepare final survey documents. SSA will
be fully responsible for distributing and
collecting the survey and results; City
will only provide administrative support
on an as
-
needed basis upon requ
es
t. SSA
will notify the City if there is no responsiveness or delays in receiving surveys from City staff. SSA will also discuss with

each staff member their responses to the survey questions.

SSA will administer a staff survey to evaluate the level of program accessibility within each City department. SSA will be responsible to determine the format and contents of the survey in order to conduct a complete and comprehensive Self
-
Evaluation, ho
we
ver, it is anticipated that the staff survey will consider such information as eligibility requirements, participation requirements, and facilities used, staff training, transportation, communications, notifications, public meetings, use of contracted se rv
ices, purchasing, maintenance of
accessible features, and emergency procedures.

SSA will submit a draft of the survey for City review, allow for comments, and then prepare final survey documents.
