A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO APPROVING THE TENTATIVE AGREEMENT FOR A SUCCESSOR MEMORANDUM OF UNDERSTANDING (DEAL POINTS) AND THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF RIALTO AND THE RIALTO FIRE MANAGEMENT ASSOCIATION (“RFMA”) FOR THE PERIOD OF JULY 1, 2016 THROUGH JUNE 30, 2017.
WHEREAS, THE City of Rialto has and continues to recognize the Rialto Fire Management Association (RFMA) Bargaining Unit as the sole exclusive bargaining agent for the City employees designated as being in the RFMA bargaining unit (“Bargaining Unit”) for all matters concerning wages, hours, and working conditions; and WHEREAS, the most current Memorandum of Understanding (“MOU”) between the City and RFMA expired on June 30, 2016; and WHEREAS, the City labor relations representatives and RFMA representatives have successfully met and conferred to negotiate a successor MOU between the parties pursuant to both the Meyers-Milias-Brown Act (“MMBA”), Government Code Section 3500 et seq., and the City’s Employer-Employee Relations Resolution, codified in Ordinance No. 1506; and WHEREAS, RFMA representatives held a meeting on July 19, 2016 with their members to vote on the details of the agreed upon successor MOU between the City and RFMA. Members agreed to the terms of the negotiated successor MOU; and WHEREAS, MMBA Section 3505.1 provides that if a tentative agreement is reached, then the governing body shall vote to accept or reject the tentative agreement within 30 days of the date it is first considered at a duly noticed public meeting, and that if the tentative agreement is adopted, the parties shall jointly prepare a written memorandum of understanding; and WHEREAS, the City’s and RFMA’s representatives have jointly prepared and executed the attached Tentative Agreement for a successor MOU (deal points) between the City and RFMA for the period July 1, 2016 through June 30, 2017, subject to City Council determination and approval, which is made a part hereof by this reference; and WHEREAS, the City’s and RFMA’s representatives have jointly prepared the attached successor MOU between the City and RFMA for the period July 1, 2016 through June 30, 2017, subject to City Council determination and approval, which is made a part hereof by this reference; and WHEREAS, once approved by the City Council, the MOU becomes a binding agreement between the City and RFMA.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rialto, California, as follows:
Section 1. The above recitals are all true and correct and incorporated herein by this reference.
Section 2. The City Council approves the Tentative Agreement for a Successor MOU between the City and RFMA for the period July 1, 2016 through June 30, 2017, a copy of which is attached hereto as Attachment 1.
Section 3. The City Council approves the successor MOU between the City and RFMA for the period July 1, 2016 through June 30, 2017, a copy of which is attached hereto as Attachment 2.
Section 4. The City Clerk shall certify as to the passage and adoption of this Resolution and shall cause the same to be effective as required by law.
