21 SECTION 1. The Planning Commission hereby specifically finds that all of the facts set forth 22 in the recitals above of this Resolution are true and correct and incorporated herein. 23 SECTION 2. Based on substantial evidence presented to the Planning Commission during 24 the public hearing conducted with regard to the SPA, including written staff reports, verbal testimony, 25 project plans, other documents, and the conditions of approval stated herein, the Planning 26 Commission hereby determines that SPA satisfies the requirements of Government Code Sections 27 65358 and 65453 and Section 18.78.060I of the Rialto Municipal Code pertaining to the findings 28 which must be made precedent to amending a Specific Plan. The findings are as follows:
-2-
1 That the proposed Specific Plan Amendment is consistent with the goals and policies 2 of the General Plan and its purposes, standards and land use guidelines; and 3 This finding is supported by the following facts:
4 The application to change the specific plan zoning designation of the Site to Commercial 5 Pedestrian (C-P) within the Foothill Boulevard Specific Plan. The proposed C-P zoning designation is consistent with the Specific Plan Overlay land use designation and will serve 6 to facilitate the Development.
7 Furthermore, the Project is consistent with Goal 3-1 of the Economic Development Element 8 of the General Plan, which encourages strengthening and diversification of the economic base and employment opportunities, while maintaining a positive business climate. The change in 9 the Specific Plan land use designation of the Site from R-MU to C-P will lead to the 10 development of a commercial building on land that has remained historically under-developed and without any commercial or residential uses under the current zoning. 11 That the proposed Specific Plan Amendment will help achieve a balanced community 12 of all races, age groups, income levels and ways of life; and 13 This finding is supported by the following facts:
14 The Project will facilitate the development of a 3,596 square foot Car Wash building, drive- 15 thru lane, and vacuum station aisle with required parking and landscaping, which will provide 16 new jobs across various wage and education levels available to all races, age groups, and ways of life.
17 That the proposed Specific Plan Amendment results in development of desirable 18 character, which will be compatible with existing and proposed development in the 19 surrounding neighborhood; and
20 This finding is supported by the following facts:
21 The Project will facilitate the development of a high-quality car wash facility. The 22 proposed development is consistent with existing commercial developments to the east, south, and west of the Site and other recent commercial developments within the Foothill 23 Boulevard Specific Plan area.
24 The immediate area is predominantly designated for and developed with commercial uses, 25 and as a result, there are no sensitive land uses adjacent to or across the street from the Site.

The project is not expected to negatively impact any uses since measures, such as landscape 26 buffering, are incorporated into the site design.
27 That the proposed Specific Plan Amendment contributes to a balance of land uses that

4. 28 will enable local residents to work and shop in the community in which they live; and -3-
1 This finding is supported by the following facts:
2 The Site has remained undeveloped. The development of the Site will provide a service not 3 readily available in the general area and will enable local residents to utilize the car wash. The C-P zoning designation will maintain consistency with the surrounding area and provide job 4 opportunities for those living in existing residential areas within the City. 5 That the proposed Specific Plan Amendment respects the environmental and aesthetic 6 assets of the community consistent with economic realities; and 7 This finding is supported by the following facts:
8 The proposed project on the Site is considered infill and is exempt from the California 9 Environmental Quality Act. The Site is currently undeveloped, surrounded by other 10 commercial uses, and is not known to be habitat to any threatened or endangered species.

Additionally, development of the proposed car wash will add architectural aesthetic, meeting 11 or exceeding design guidelines of the Specific Plan, to the intersection consistent with the other existing commercial developments in the area.
12 13 6. That the proposed Specific Plan Amendment incorporates, where feasible, active and passive energy conservation measures.
14 This finding is supported by the following facts:
15 16 The development, enabled by the Project, is required to meet or exceed California Building Code Title 24, Part 6 Energy Efficiency Standards. This will be achieved through the 17 implementation of features such as, but not limited to, energy efficient windows, energy 18 efficient heating and cooling systems, and water efficient landscaping. 19 Environmental Assessment Review No. 2023-0035) determined that the SECTION 3.
20 project is categorically exempt (Class 32) as infill development in accordance with the California 21 Environmental Quality Act (CEQA). The project site is less than five acres, substantially surrounded 22 by existing development, and is not habitat for any threatened or endangered species. Staff 23 recommends that the City Council direct the Planning Division to file the necessary documentation, 24 such as the Notice of Exemption, with the Clerk of the Board of Supervisors for San Bernardino 25 County.
26 SECTION 4. The Planning Commission hereby recommends that the City Council approve 27 SPA No. 2023-0001 to change the specific plan zoning designation of the Site from Residential Mixed 28 -4-
1 Use (R-MU) to Commercial Pedestrian (C-P) within the Foothill Boulevard Specific Plan, in 2 accordance with the applications on file with the Planning Division, subject to the following 3 conditions:
4 5 SPA No. 2023-001 is approved changing the specific plan zoning designation of approximately 2.17 acres of land (APN: 128-011-32) located at the northeast corner of 6 North Linden Avenue and Foothill Boulevard, described in the legal description attached as Exhibit A ("Site"), within the boundary of the Foothill Boulevard Specific Plan. 7 8 City inspectors shall have access to the Site to reasonably inspect the Site during normal working hours to assure compliance with these conditions and other codes. 9 3. Notwithstanding anything to the contrary contained herein, the Applicant shall not be liable to the City Parties under this indemnity to the extent the 24 Damages incurred by any of the City Parties in such Action(s) are a result of the City 25 Parties' fraud, intentional misconduct or gross negligence in connection with issuing the Entitlements.
