FOR: Water Subcommittee Meeting [June 26, 2024] TO: Honorable Water Subcommittee Members
APPROVAL: Tanya Williams, Assistant City Manager
FROM: Toyasha Sebbag, Assistant to the City Manager
Request that the Water Subcommittee Provide feedback to the Office of Energy Infrastructure Safety Underground Safety Board: Notice of Probable Violation: Response due June 28, 2024.

BACKGROUND
The Office of Energy Infrastructure Safety Underground Safety Board (Underground Safety Board) was created by the Dig Safe Act of 2016 to investigate accidents, develop excavation safety standards, and coordinate education and outreach programs.

The Underground Safety Board is made up of nine members appointed by the Governor and Legislature. Members are charged with overseeing the safety of excavations around buried utilities by 1. Coordinating the state’seducation and outreach efforts; 2. Investigating accidents to determine their causes; 3. Setting standards for safe excavation; and 4. Ensuring the state’ssafe excavation laws are followed.

The Underground Safety Board exercises no direct regulatory authority, it cannot issue penalties.

Instead, its enforcement philosophy is to make recommendations to the local agency assigned with regulatory enforcement of laws. Per § 4216.6(d), a local agency, in our case the City of Rialto City Council is the enforcement agency to review possible violations and may issue penalties.

ANALYSIS/DISCUSSION
In May 2024, staff was notified in a letter from the Underground Safety Board of a probable violation stemming from an event that occurred on July 10, 2023. The probable violation claims that the City of Rialto, Rialto Water Services (RWS) as operated by Veolia of North America (Veolia) violated Government Code § 4216.3(c)(1)(A): Failure to provide an electronic positive response before the legal start date and time [to a DigAlert request].

Staff met with Veolia who stated that staff direction and policy was that they were not authorized to go onto private property, not even to mark underground utilities. To ensure that this possible violation does not occur in the future, staff worked with DigAlert to identify that all future tickets located on private property would be marked by Veolia with Response Code 013: Locate area marked up to private property.

The City of Rialto has the right to respond to the Notice of Probable Violation by June 28, 2024.

Response options may be sent via email and require choosing one of the following options:

City of Rialto Printed on 6/20/2024Page 1 of 3
powered by Legistar™
9 File #: WS-24-1519, Version: 1, Agenda #:

1. No Contest. Rialto does not contest the violations or the penalty. Selecting this option will waive our right to request the Board to reconsider its decision or recommendation issued.

2. Contest in Writing. Rialto may contest either the violation, the penalty, or both by providing the Board with written explanations and other records supporting the explanation.

3. Contest in Writing and Request Informal Hearing. Rialto may contest either the violation, the penalty, or both with oral argument at an informal hearing during a public Board meeting.

The Underground Safety Board will conduct a public meeting on July 08, 2024, at 1 p.m. in Sacramento, California to determine whether a violation occurred by the City and whether the penalty proposed in the Notice, which is completing a 4-hour free online education course on DigAlert Notifications is appropriate.

Following the July 8 Underground Safety Board meeting, the City Council will receive a letter with the Board’s findings and recommended corrective action(s).

The City Council may take action to:

1. Approve the Underground Safety Board’s recommendation.

2. Approve an alternative action in line with Government Code § 4216 et seq.

Pursuant to Government Code § 4216.6, violation of Government Code § 4216 et seq. by an operator or excavator may be subject to a maximum penalty of $10,000 for negligent violation, or $50,000 for knowing and willful violation. Knowing and willful violation of Article 2 that results in damage to a gas or hazardous liquid pipeline subsurface installation and that results in the escape of any flammable, toxic, or corrosive gas or liquid may be subject to a maximum penalty of $100,000.

3. Take no action.

Staff is seeking feedback from the Water Subcommittee on how best to respond to the Notice of Probable Violation.

Dear <<Sample A. Sample>>,
Many homeowners are not aware that repairs to the exterior water service and sewer/septic lines that run on their property are the responsibility of the homeowner. Your property at <<Serv_Address1_xxxxxxx>> is not covered with Exterior Water Service Line Coverage or Exterior Sewer/Septic Line Coverage administered by SLWA Insurance Services (SLWA) and issued by Virginia Surety Company, Inc.

The water service and sewer/septic lines buried underground are subjected to changing soil conditions, ground shifting and corrosion, which may cause a sudden breakdown, leaving you responsible for the cost of repair or replacement.

Replacement of these lines can be expensive—costing you thousands of dollars in unforeseen expenses—and that may be hard on a budget.

SLWA is offering eligible homeowners protection for repairs to their water service and sewer/septic lines. So you’re invited to enroll in Exterior Water Service Line Coverage and Exterior Sewer/Septic Line Coverage from SLWA. These voluntary service line repair programs provide repair coverage for your exterior water service or well and exterior sewer/septic lines.

These programs provide a 24-hour emergency hotline, available 365 years to schedule a repair, and have no deductible.

Benefit Amount: U p to $8,500 per service call with as many service calls as you need for covered water service line repairs Up to $8,500 per service call with as many service calls as you need for covered sewer/septic line repairs Property Address:

— Important —
Take action to help protect the exterior water service and sewer/septic lines on your property. Complete and return the enclosed form or call SLWA at 1-844-257-8796 to accept this optional coverage. Coverage begins 30 days after your form is processed.

During this 30-day review period, you can decide if coverage is right for you. Choose protection starting for as little as $6.33 per month to help protect your lines from the high cost of covered repairs. This program is managed by SLWA, and no public funds were used for the mailing of this letter. For fastest processing, please visit www.slwofa.com.

Please respond within 30 days.

Important Questions & Answers
This description of coverage, exclusions and conditions is not the actual contract; the actual contract will be sent to you within approximately 10 business days after we receive your Form.

What am I responsible for?
As a homeowner, you are responsible for your exterior
water service line and exterior sewer/septic line.

Does my homeowners insurance cover this?
Most basic homeowners insurance policies do not cover
repair or replacement due to normal wear and tear of
these lines.

Does this coverage include well lines?
Yes, coverage provides for repair or replacement of either water service or well lines, as explained in the “What’s covered” section.

Who is eligible for coverage?
To be eligible, you must own both the residential structure and the land it is located on. You are not eligible if your home is a recreational vehicle or otherwise intended to be moved; your property is used for commercial purposes;
you know of any current problems with your system(s)
prior to enrollment; your entire system(s) is shared with a 3rd party or covered by a homeowners; association or the like; or your exterior sewer/septic line failed a smoke or dye test, camera inspection or any other proactive test
without resolution.

What should I know about this coverage?
What’s covered: Coverage provides, up to the applicable benefit limit, to repair or replace the following that have experienced an operational failure, for which you have sole responsibility, that are damaged due to normal wear and tear, not accident or negligence. Exterior Water Service Line Coverage: The water line from your utility’s
responsibility or external wall of your well casing to the external wall of your home. Repair or replacement of non- functioning stop boxes, shut-off valves, pressure reducing valves and backflow prevention devices is also covered.

Exterior Sewer/Septic Line Coverage: The sewer line from the external wall of your home up to your utility’s
responsibility, or septic line from the external wall of your home up to the point of connection to the septic tank on your property, including branch drains from the point they exit the home to the point they re-enter the home.

Not covered: Damage from accidents, negligence or
otherwise caused by you, others or unusual circumstances and the following product-specific exclusions: Exterior Water Service Line Coverage: Frozen lines, branch lines, any tanks or appliances. Additional exclusions apply.

Exterior Sewer/Septic Line Coverage: Septic/collection tanks; leaching fields; grinder pumps; backflow prevention devices; non-conforming drain lines; or branch lines.

Additional exclusions apply. Costs on covered repairs may exceed the benefit limit, in which case you pay the
difference between the cost and the benefit limit. See full Terms and Conditions with complete coverage and
exclusion details prior to enrolling by calling
1-844-257-8796 or going to www.slwofa.com. Disputes
resolved by arbitration, without class action or jury trial, unless otherwise stated in your full Terms and Conditions.

When can I make a service call?
Your plan(s) starts 30 days after your Form is processed.

You can make a service call immediately after your plan(s) starts. During the initial 30-day review period you will receive the Terms and Conditions to help you decide if
coverage is right for you. Upon renewal/reactivation (if applicable), there is no review period and you can make a service call immediately.

What is the cancellation policy?
Cancel any time by calling SLWA Insurance Services at
1-844-257-8796 or visiting www.slwofa.com. You will not be charged during the review period (if applicable). If you cancel within 30 days of your start date, you will get a full refund (less claims paid, where applicable). Cancellations after the first 30 days will result in a pro-rata refund (less claims paid, where applicable).

What is the term of my service agreement?
The plan is annual. Unless you cancel, your plan
automatically renews annually at the then-current renewal price with your same payment terms.

What is E-Z Pay?
E-Z Pay is a paperless and stress-free way to pay for your coverage. Payments are automatically debited from the
bank/checking account of your choice as your payment
becomes due, at no additional cost.

Who is SLWA Insurance Services?
SLWA Insurance Services is an independent company,
separate from your local utility or community. SLWA
Insurance Services is not a licensed contractor and uses a network of pre-screened and licensed contractors to
complete repairs as the plan administrator for Virginia Surety Company, Inc. If you would prefer not to receive solicitations from SLWA, please call 1-844-257-8796.

aplican exclusiones adicionales.

D. Source Water Total Dissolved Solids (TDS)
Veolia has a goal of maintaining an acceptable blended TDS level between all its sources. This goal is achieved by shifting production to or from the lowest TDS wells or purchased low TDS water while adhering to the overall water supply strategy and meetin g system demands. The TDS was 233 mg/L for the month of April as compared to 233 mg/L in March. The TDS levels are below the secondary maximum contaminant level requirements.

VII. OPERATIONS UPDATE
The overall operational strategy is to meet the daily water demand. The City of Rialto water system has six operational wells, one of which is owned by the Count y of San Bernardino and operated by Veolia; Oliver P. Roemer Treatment Plant (OPRTP), which is jointly owned by the City (25%) and West Valley Water District (WVWD); purchased water through the Baseline Feeder (BLF) system from San Bernardino Valley Munici pal Water District (SBVMWD); and, if required to meet demand, additional water can be 47 supplied by the City of San Bernardino (CSB) through the BLF for emergency supply only with no guarantee of actual delivery. Water produced from City Well 4A discharges into the BLF and its production is included in deliveries from that shared transmission line when City Well 4A is in service.

The overall pumping strategy is based on adjudicated rights, well availability, remediation requirements, and quality of source, c ost to operate, and varying weather conditions. TDS effluent concentrations for the City of Rialto WWTP are taken into consideration when operating the facilities and water sources.

A. Operational Wells
All wells were operational.

B. Valve Activity
On the basis of information collected in 2019, Veolia now has a baseline assessment of all valves and has initiated a new cycle of valve exercising . 60 valves were exercised for the month of April.

Unit 2's cleanout was overflowing. The spill
ran down the complex to the storm station
on the property. The storm station pumps
were tripped, so no sewer reached the city
right of way. I notified Tim Sun of Rialto Code
Enforcement, the Supervisor, and the
property owner. I was informed that a
plumber was on the way and would open the
line and clean the sewer spill. The call ended.

ET
4/17/2024 827 W Tullock I received a call from customer service stating that the residents at 813 and 827 said
that manholes on the street were
overflowing. When I arrived at 10:58, I
discovered this area was new construction,
and we did not have maps. We figured out
the direction in which the flow went out. We
were able to clear the blockage at 11:50 AM.

The blockage was caused by contractors
leaving debris in the downstream manhole.

PH, ET,

BVO, ZG

4/19/2024 324 N Plam Ave A manhole overflows on the property down an alleyway. The blockage was caused by
excessive grease in the line from upstream
restaurants. The blockage was cleared, and
the area was washed down and vacuumed
up.

PH, BVO
4/25/2024 258 W Shamrock A resident reported a sewer line blockage. I called the admin at the wastewater plant to
translate it into Spanish for the resident. I
informed the resident that the sewer line
was clear, the blockage was in the lateral,
and they would need to call a plumber to
resolve the issue.

BVO
4/27/2024 813 Tullock The HOA plumber called to report an overflowing manhole. Upon inspection,
several manholes were slightly surcharged.

Blockage was downstream on Idylwild again.

Once the blockage was cleared, the flow was
restored. The pipe in the manhole is
scheduled for repair due to contractor error
during the tie-in.

BVO
4/29/2024 1302 N Riverside A call for a slow-running sewer. The line running in front of the church was clear.

Upon further investigation, the problem was
determined to be lateral needed cleaning.

BVO

4/30/2024 750 E Rialto #8 False alarm, not a sewer problem but a broken water line.
