RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, APPOINTING JOHN ROSSI AS INTERIM UTILITIES DIRECTOR WHEREAS, the City Council of the City of Rialto (“City”) proposes to, and hereby does by this resolution, enter into an employment agreement with John Rossi, a retired CalPERS annuitant, to serve as the City’s Interim Utilities Director commencing October 7, 2024 which agreement is attached hereto as Exhibit “A”; and, WHEREAS, Government Code section 7522.56 and 21221(h) of the Public Employees’ Retirement Law permits the governing body to appoint a CalPERS retiree to a vacant position requiring specialized skills during recruitment for a permanent appointment, and provides that such appointment will not subject the retired person to reinstatement from retirement or loss of benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and, WHEREAS, there is a vacancy in the position of Utilities Director for the City of Rialto; and WHEREAS, John Rossi has substantial experience in water, wastewater and the management and oversight of municipal utilities. .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RIALTO DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby incorporates the above recitals herein by reference.
SECTION 2. The City Council hereby appoints John Rossi as interim Utilities Director effective October 7, 2024 pursuant to the authority provided under Government Code sections 21221(h) and 7522.56, during the active recruitment for a regular appointment to the Utilities Director position, to provide the critically-needed, specialized skills necessary to run the Utilities Department.
SECTION 3. The City Manager or Acting City Manager is authorized to execute an employment agreemetn for interim Utilities Director services with John Rossi on behalf of the City of Rialto that such agreement is consistent with the terms set forth in this resolution.
SECTION 4. The City Council approves the Employment Agreement between the City and John Rossi attached hereto as Exhibit “A” and authorizes the City Manager or Acting City Manager to execute the Employment Agreement.
