Attention: City Clerk, City Attorney, Risk Manager, and City Council Re: Amendment/Addendum to Government Tort Claim - Incorporation of April 1, 2023 False Arrest Incident as Part of Ongoing Pattern of Harassment and Retaliation To the City Attorney, Risk Manager, City Clerk, and Members of the City Council:
This Addendum supplements and amends the Government Tort Claim submitted on January 15, 2026 ("Original Claim"), which details a multi-year pattern of unlawful conduct by the City of Rialto and its employees targeting my mixed-use commercial property at 134 01 02
ADDENDUM TO GOVERNMENT TORT CLAIM
South Willow Avenue, Rialto, CA 92376. The Original Claim alleges ongoing violations beginning around June 29, 2022, including retaliatory code enforcement, red-tagging, utility shutoffs, zoning obstructions, defamation, trespass, invasion of privacy, civil rights violations, and a police-involved raid on November 25, 2025.
This Addendum incorporates the April 1, 2023 false arrest (File No. 932303761) by Rialto Police Department Officer Ball (I.D No. 01944) and Smith (I.D No. 2320) as further evidence of the continuing pattern. This incident is linked to the same conduct interfering with my property rights, economic interests, and constitutional protections.
I. DESCRIPTION OF THE APRIL 1, 2023 INCIDENT
On April 1, 2023, at approximately 11:39 AM, I was driving my 2016 Mercedes-Benz C-Class (white, 4-door, VIN: , License: eastbound on Easton
Street, making a left turn onto Ayala Avenue near Renaissance Parkway. Officer Ball initiated a traffic stop for an alleged violation of California Vehicle Code § 21453(c) (turning against a steady red arrow signal).
The citation was baseless and appears to have been pretextual/intentionally targeted:
• The signal changed red mid-intersection while I was already committed to the turn, and | completed it safely and lawfully.
• Officer Ball was positioned facing south (toward my completed turn), with no line of sight to the east-west facing signal heads, making it physically impossible for him to observe the light change.
• I was singled out and stopped despite other vehicles in the intersection performing similar movements without being pulled over.
• The stop was pretextual, as evidenced by Officer Ball's vantage point rendering the alleged violation unwitnessable, combined with the apparent targeting of my vehicle frequently parked at my flower shop property (134 S Willow Ave, Rialto, Ca, 92376) adjacent to the Rialto Police Department (128 N Willow Ave, Rialto, Ca, 92376), making it recognizable to officers.
• Pepe's tow truck was already staged directly in front of my vehicle before any refusal or escalation, indicating a pre-arranged plan to tow and arrest regardless of cooperation.
02 03
ADDENDUM TO GOVERNMENT TORT CLAIM
I requested a supervisor before signing the citation due to these suspicious circumstances.
The request was not honored. Officer Ball proceeded to arrest me without probable cause, used excessive force, treated me aggressively, and did not read me my Miranda rights.
I was first taken to the Rialto Police Department station at 128 N. Willow Ave. (directly next to my flower shop property at 134 S. Willow Ave.) for initial detention and processing (| was denied access to contact my wife or an attorney). I was then transported to West Valley Detention Center. On arrival at West Valley Detention Center, the driver claimed / appeared under the influence of methamphetamine. I was taken to Arrowhead Hospital, where medical staff tested me, found no drugs in my system, provided water and rest, and released me back to custody.
Throughout the process, from morning arrest until evening, I was denied access to contact my wife or an attorney, in violation of Penal Code 5851.5 (right to three calls within three hours of booking) Only one call was allowed at 19:00. My vehicle was towed, damaged, and has remained unusable. The case (No. 9-23 / 932303761) was not prosecuted, and the citation was dismissed. A prior tort claim for this incident (September 28, 2023) is attached as Exhibit X.
I. CONNECTION TO THE ONGOING PATTERN OF CITY MISCONDUCT This arrest fits squarely within the multi-year pattern outlined in the Original Claim:
• Timing and Context: The incident occurred shortly after code enforcement actions began in 2022 at 134 S. Willow Ave. (a flower shop directly adjacent to the Rialto Police Department station at 128 N. Willow Ave.). My vehicle was frequently parked there, making it recognizable to City employees, including police. The arrest appears retaliatory and pretextual, aimed at intimidating me amid escalating disputes over grandfathered non-conforming use rights (pre-2010 light industrial zoning) and SB 6 protections. The initial transport to the local PD station (next to my property) and pre-staged tow further demonstrate familiarity and intentional targeting. • Simitar Violations: Like the other conduct (e.g., unjustified red tags, utility disconnections, the 2025 raid), this involved abuse of authority, selective/pretextual enforcement, civil rights violations (due process, equal protection, unlawful seizure under the Fourth Amendment, denial of right to counsel/telephone calls under Penal Code $ 851.5), intentional infliction of emotional distress, and interference 03 04
ADDENDUM TO GOVERNMENT TORT CLAIM
with property/economic rights. It contributed to the same harms: financial losses (towing/repair costs, lost wages), emotional distress, and obstruction of property use/refinancing.
• Continuing Violation Doctrine: This incident is part of a series of related, ongoing wrongful acts by the City, with at least one (the November 25, 2025 raid) occurring well within any applicable limitations period. Under California law, such patterns may extend timeliness for related events, as they form a single, continuing course of conduct rather than isolated occurrences. (See, e.g., Aryeh v. Canon Business Solutions, Inc. (2013) 55 Cal.4th 1185, recognizing continuous accrual for recurring violations.)
• The property's proximity to the Police Department strengthens the link: Officers likely knew of the code disputes and targeted me accordingly, furthering the City's apparent goal to coerce abandonment or low-value sale of the property.
III. POTENTIAL SPOLIATION OF EVIDENCE
On April 19, 2023, my former counsel (Tomlinson & Prince) issued a preservation letter to Chief Mark Kling (Exhibit Y), demanding preservation of all evidence, including body-worn camera footage (Officers Ball and Smith), dash camera footage, transport vehicle footage, dispatch logs, and citation records. Despite this timely notice (18 days post-incident), key items, including the original citation and potential video evidence, appear missing or destroyed, consistent with the pattern of obstructing accountability.
IV. UPDATED DAMAGES
Original Claim seeks $2,288,888 in conservative, evidence-based damages. Incorporating the April 1, 2023 incident adds:
Damages Incurred to Date (April 1, 2023 Incident):
• Vehicle towing, storage, and repair: $2,500
• Medical expenses (Arrowhead Hospital and other): $1,500 • Lost wages and earning potential: $50,000
• Emotional distress and pain/suffering: $500,000
• Property-related interference (e.g., fear impacting business operations): $100,000 • Legal/administrative costs from prior claim: $10,000
04 05
ADDENDUM TO GOVERNMENT TORT CLAIM
Subtotal: $664,000
Estimated Prospective Damages: Ongoing fear of driving/using the vehicle, compounded emotional harm, and ripple effects on marriage/professional life: $500,000 Total Additional Damages: $1,164,000
Revised Total Claim Amount: $3,452,888 (Original $2,288,888 + Additional $1,164,000).
This remains conservative; full multipliers, punitive damages, or attorney's fees could increase it substantially.

Section 1. Responses to section 3. I was subjected to a traffic stop due to an incident where my tum signal tumed red in the midst of the intersection. I felt unfairly targeted as there were other vehicles in close proximity to me. It is worth noting that I am of Hispanic descent, and my vehicle is registered under my name, which bears a Hispanic identity. To my dismay, I was gulled over, treated with excessive force akin to that of an animal, and denied basic rights throughout the arrest process. Shockingly, I was swiftly incarcerated without the opportunity to exercise my right to legal representation during the proceedings. section 2, Responses to section 5. I want to express the immense impact that the city land Inforcement's mistreatment has had on my life. It is with great sorrow that I recount the exten * the damages inflicted upon me. The physical and emotional toll has been severe, leadingr exorbitant personal life impacts that I have had to bear. This mistreatment has also resulted th ite loss of my wages and diminished my future earning potential, undermining my financhal 3 RIALTO stability and aspirations. The pain and suffering i have endured cannot be quantified, a it hass deeply affected my well-being and quality of life. Additionally, the damages to my property serug as a constant reminder of the injustice inflicted upon me. Moreover, the countless hours, substantial financial resources, and emotional labor expended due to the city police's negligence have taken an immeasurable toll. The resulting financial burden has been overwhelming, with thousands of dollars spent to rectify the consequences of the r actions. It is profoundly disheartening to reflect upon the extent of the harm caused by the city police's actions, and the lasting repercussions it continues to impose on my life.
Section 3. Response to Section 6. I want to convey how deeply this incident has affected my life, with heartfelt empathy for the Immense impact it has had on me. The financial strain caused bir the damages incurred amounts to thousands of dollars, and the weight of this burden still lingers, leaving me struggling to recover even to this day. Beyond the financial aspect, the incident has permeated my personal life, instilling a pervasive fear that lingers whenever I get behind the wheel of my vehicle-the very same vehicle in which I was pulled over and subjected td such mistreatment. The consequences have seeped into my relationships, partcularly my marriage, creating a distressing spiral that has taken Its toll on various aspects of my life, including my professional endeavors. Compounding the emotional distress, / haven't even mustered the courage to drive my car, which remains damaged on my driveway from the day! pall It from the towing wreck yard. This incident has had an immense and lasting impact on my mental well-being, and no amount of money can ever truly heal the wounds it has inflicted.
