RESOLUTION NO. XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIALTO, CALIFORNIA, ADOPTING SUBSTANTIAL AMENDMENT NO. 1 TO THE FISCAL YEAR 2024–2025 ANNUAL ACTION PLAN; AUTHORIZING SUBMISSION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AND AUTHORIZING ALL ACTIONS NECESSARY TO IMPLEMENT THE AMENDMENT.
WHEREAS, the City of Rialto (City), as an entitlement city, receives Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME) funds annually from the U.S. Department of Housing and Urban Development (HUD) to carry out eligible community development activities benefiting low- and moderate-income residents; and WHEREAS, HUD requires entitlement cities to prepare and adopt an Annual Action Plan (AAP) each fiscal year as a condition of receiving federal funding under the CDBG and HOME programs, consistent with the City’s adopted Five-Year Consolidated Plan; and WHEREAS, on August 13, 2024, the City Council approved the Fiscal Year 2024–2025 Annual Action Plan, which included funding allocations for the Building 500 Rehabilitation Project and the Carl Johnson Center rehabilitation; and WHEREAS, during implementation of the Carl Johnson Center rehabilitation, additional construction needs were identified requiring reallocation of funds to complete the full scope of work; and WHEREAS, staff determined that reprogramming $100,000 in CDBG funds from the Building 500 Rehabilitation Project—on which no funds have been expended—to the Carl Johnson Center project would allow completion of the rehabilitation without increasing total program funding; and WHEREAS, in accordance with HUD regulations and the City’s Citizen Participation Plan, a substantial amendment to the Annual Action Plan requires public notice and a public hearing, and the proposed Substantial Amendment No. 1 was made available for public review and comment for a 30-day period beginning February 11, 2026, through March 13, 2026; and WHEREAS, the City Council conducted a duly noticed public hearing to solicit public comments on Substantial Amendment No. 1 to the Fiscal Year 2024–2025 Annual Action Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF The CITY OF RIALTO AS FOLLOWS:
Section 1. The City Council hereby adopts Substantial Amendment No. 1 to the Fiscal Year 2024–2025 Annual Action Plan, which reallocates $100,000 in CDBG funds from the Building 500 Rehabilitation Project to the Carl Johnson Center rehabilitation project.
Section 2. The City Council hereby authorizes the City Manager or their designee to submit Substantial Amendment No. 1 to the Fiscal Year 2024–2025 Annual Action Plan to the U.S. Department of Housing and Urban Development (HUD).
Section 3. The City Council hereby authorizes the City Manager or their designee to take all actions necessary to implement the programs identified in the amended Fiscal Year 2024–2025 Annual Action Plan.
Section 4. The City Council hereby authorizes the City Manager or their designee to make all conforming modifications and edits, and to execute all implementing documents required by HUD, in a form approved by the City Attorney.
Section 5. This resolution shall take effect immediately upon its passage.
