Good Evening Mayor Butts, City Council, City Government Officers, Richmond City Employees Under Labor Union Contract (Police-Fire-Teachers-Prosecutors-Public Defenders-Social Services, There is a very large collection of citizens, undocumented members of society and previously classified persons with negative connotations of prior behaviors that have been forced into an unprecedented commonality never actually achieved in the history of civilization. Mankind's quest for the hope of freedom through self-government has been met with vigorous resistance since the beginning of time. The Constitution of the United States of America has never faced as serious of a threat than what America is experiencing at this moment in time.

Yes, this is being documented later in the day than I had originally anticipated and planned for today. Dr.

Martin Luther King was just one of so many that sacrificed their lives to ensure our society would be able to worship as one chooses, and the individual to be recognized by the character of the individual, not the color of one's skin. We have been waiting for authorization to name and identify a couple recent contacts excited, capable, willing and able to join our efforts to assist Richmond leaders in the continued fruitful operation of Richmond's city businesses.

Presently Richmond is in a complete state of confusion and misdirection, most notably due to constant, consistent and paralyzing frivolous, partisan and unconstitutional actions that will only cease under threats of aggressive and unending litigation. Advisors are hampering any attempts to resolve any issue.

The court of public opinion and the persistent harassment of the heckler's veto has stymied and frozen almost any hope of resolving any issues presented for consideration.

Very soon we should be able to secure legal assistance from throughout the State of California, as we unite all 58 counties together!! We have been spending over a year attempting to get your attention and acknowledgement of our efforts to help. Your city records have preserved our constant efforts for transparency and accountability. 3rdpb.com
is the Richmond solution. And the means by which all
solutions are pre-funded and secured.

Respectfully,
Joseph Anthony Toth
PS: One of the major principals to maintaining a free society is the independence of our local police forces. The John Birch Society has advocated this core principle based upon the destruction of so many other attempts at self-governance, safety and prosperity. Our Police Partners have been slandered, vilified and morally desecrated by Mayor Butt's spiteful, hateful and the disgusting character assassination directed at out department.

Dear Council Members,
I support maps 201 & 202 on the agenda and oppose maps 101,102,106, 106b and 203.

I have
owned my home for 38 years on Macdonald Avenue, and lived in this neighborhood for most of my life.

Maps 201 & 202 keep our East Richmond neighborhood in the same council district with the North and East neighborhoods and results in a district that is geographically contiguous with "communities of interest" and easily identifiable boundaries.

Retaining this
district should allow the city to achieve districts overall with balanced populations under the 2020 census.

Our East Richmond neighborhood is predominantly east from San Pablo Avenue to the city border, an area also served by the Richmond Heights Neighborhood Council.

We see
ourselves with similar interests with the North and East neighborhoods, in a district represented in maps 201 & 202.

We do not have common neighborhood interests with areas represented by the Fairmede/Hilltop, Hilltop Green, Quail Hill, Greenridge Heights, May Valley, El Sobrante Hills, Greenbriar, Carriage Hills (North & South) or Countryside neighborhoods, as they are geographically distant from where we live, in very different communities.

Dividing us from our immediately contiguous North & East neighbors

and
putting us in the same district as the Richmond neighborhoods surrounding El Sobrante are represented in maps 101, 102, 106, 106b and 203, which I oppose.

Thank you for your consideration,

Dear Council Members,

Please continue to keep our East Richmond neighborhood in the same council district with the North and East neighborhood.

I am a resident

of this this neighborhood and I worked as a Partnership Specialist for the US Census 2020 so I understand and value the importance of keeping neighborhoods connected.

Our East Richmond neighborhood is predominantly east from San Pablo Avenue to the city border, an area also served by the Richmond Heights Neighborhood Council.

There is plenty of evidence that efforts are being made to change district layouts so that only the "right people" can be gathered together to win elections and determine policies that serve their interests.

East Richmond being kept with the adjoining North & East neighborhoods keeps the district contiguous,

keeps communities together to express their desires,

and keeps populations
balanced.

Leave it as-is.

Hi-
I live in Richmond Heights, just off Barrett above San Pablo. I've been looking at the proposed redistricting maps and can't figure out why we would be in the same district as over the hill.

I'll cut/ paste the concerns as noted, but wanted to add my personal message that the new map doesn't seem to make sense to me.

Thanks for considering those of us who live here.

I am writing in support of Map 102 as I understand it was developed collaboratively by Neighborhood Councilsand best aligns neighborhoods with common interests.

Map 102 groups the high severity fire zones in one district and does a better job of keeping Hilltop and the Iron Triangle together.

In my opinion Map 102 does the best job of
keeping neighborhoods intact and is also clearly better than the existing map.

Re: Richmond City Council Redistricting 2020 Census
Dear Mayor and Richmond City Council:

We are a group of Neighborhood Councils (NCs) that serve the predominantly Latino and African-American areas of northern, central and southern Richmond. We are respectfully requesting the City Council adopt the draft district map 102 as part of the Redistricting 2020 Census.

National Demographics Corporation (NDC) states there are four criteria that a district map should achieve: 1) districts should be geographically contiguous; 2) neighborhoods and communities should not be divided; 3) boundaries should be easily identifiable; and 4) districts should be compact.

While NDC says the current map met the letter of the law, we believe it violated the spirit of the law and that our proposed map 102 better represents what the community legally deserves.

Our proposed map addresses the following three major issues and eliminates the disenfranchisement of the Black and Brown communities of Richmond that exists under the current district boundaries.

1. Prioritizes keeping neighborhoods and business districts whole and in one single city council district versus broken up in large pieces among two or more districts.

Currently the Iron Triangle, Park Plaza, and the Hilltop neighborhoods are broken up into large pieces among two different districts. Breaking up these neighborhoods into different districts has resulted in fractured city council representation that does not adequately address • the neighborhood’s concerns. This issue is exacerbated by Districts 2, 3, and

4.currently not having filled seats, and neighborhoods have large areas with no one officially to turn to on the City Council. Our proposed map reunites these neighborhoods.
• Similarly, in our proposed map the 23rd Street, Hilltop, Southside, and

Shoreline business corridors now each reside within a single district, with the San Pablo Avenue corridor remaining split between two districts.

2. Prioritizes keeping communities with common interests together wherever possible.
• Map 102 keeps predominantly Black and Brown sections of Richmond (e.g., Central and near North Richmond) together and most of the Southside in one district. It also joins wealthier areas with shared shorelines interests (e.g., Point Richmond, Marina Bay and the Southwest Annex) into one district.

3. The districts should be kept compact as required by state law. • Currently, District 2 is scattered over an area that is too large, includes several neighborhoods that do not have common interests (Hilltop, Shields- Reid, Santa Fe, and Point Richmond), and is joined via a thin stretch of land with no residents.

We are looking to your leadership and authority to address this significant injustice that is occurring to the Black and Brown communities of Richmond. We would like to request a meeting with you to ensure that this map is implemented and to answer any questions you may have.

Our East Richmond neighborhood is predominantly east from San Pablo Avenue to the city border, an area also served by the Richmond Heights Neighborhood Council. The Council of Business and Industries' supports the communities' selected map # 102.

This provides clear borders and boundaries of interest and has kept the Neighborhood Council geographic areas together as much as possible to provide continuity.

The community members map provides a reunification of neighborhoods that were splintered in the previous map.

It demonstrates the need to support equity
and diversity -

Hispanics, Blacks and whites each have two (2) majority districts which are faily comparable and more uniform in the percentage representation with this reorganization.

********************************************************************

Good Evening Mayor and Councilmembers -
I am a 22-year resident of Richmond and am writing in support of Map 102.

As many of you know, I have participated in every single public hearing since 2019 and have strongly advocated for a map that supports our neighborhoods and communities.

As you’ve heard from several Neighborhood Council (NC) representatives tonight and via email, this map represents the efforts of a broad coalition of NCs that serve predominantly Latino and African-American areas of northern, central and southern Richmond.

This map addresses several issues with the current map and eliminates the disenfranchisement of the Black and Brown communities of Richmond that exists under the City’s current district boundaries and in my opinion provides the best map to serve our City at large for the next ten years.

Specifically, this map:

Provides Hispanics, Blacks and Whites each with two majority Citizen Voting Age Population % districts and they are all fairly comparable; Hispanics having a majority in Districts 1 and 6; Blacks in Districts 2 and 3; and Whites in Districts 4 and 5.

This map prioritizes keeping neighborhoods and business districts whole and in one single district.

It reunites the Iron Triangle, Park Plaza and Hilltop neighborhoods.

No neighborhood council is split across more than 2 districts.

Similarly, it reunites the 23rd St, Hilltop, Southside and Shoreline business corridors.

This map also prioritizes keeping communities with common interests together where possible.

For example, it keeps predominantly Black and Brown sections of Richmond together as well as most of the Southside in one district.

It also unites East Richmond Heights with May Valley and nearby neighborhoods who have shared concerns over wildfire safety.

This map corrects the current District 2 issue of using a skinny stretch of land with no residents to join diverse neighborhoods with few if any common interests - specifically Hilltop, Parchester Village, Shields-Reid, Santa Fe and Point Richmond.

Maps 201 and 202 continue to use this technicality to meet a requirement for a district to be contiguous and best serves the RPA.

This map predominantly uses distinct and natural boundaries.

A few key distinctions between map 102 and the next two closest maps 106b and 203 are that:

Maps 106b and 203 splits the North & East NC into 3 districts.

Maps 203 continues to fragment predominantly Brown & Black NCs and business corridors like 23rd St.

We are looking to your leadership and authority to address the current injustices that occur to the Black and Brown communities of Richmond with the current map. We want elected leaders who will place the desires of the majority of our neighborhoods over their own seat and political interests. As Madalyn Law nicely stated, this is a map that was created by the people, for the people.

Thank you.

Respectfully,
Leisa Johnson

Please continue to keep our East Richmond neighborhood in the same council district with the North and East neighborhood.

Our East Richmond neighborhood is predominantly east from San Pablo Avenue to the city border, an area also served by the Richmond Heights Neighborhood Council.

Keeping East Richmond with the immediately adjoining North and East neighborhood results in a district that is geographically contiguous and compact with "communities of interest " and easily identifiable boundaries.

Retaining this district should allow the city to achieve districts overall with balanced populations under the 2020 census.

Dear Council Members,
My husband and I are long time residents of the North and East Neighborhood - since 1997. We have concerns about the proposed redistricting. We strongly suggest keeping our East Richmond neighborhood within the same council district as the North and East. Our neighborhood is mostly east from San Pablo Avenue to the city border, an area also served by the Richmond Heights Neighborhood Council. Retaining this district will allow the city to achieve districts with overall balanced populations under the 2020 census. Aligning East Richmond with the North and East neighborhood results in a district that is contiguous with easily identifiable boundaries.

I have lived on Key Blvd between MacDonald and Barrett since 1984. I believe that I have the most common interest with neighbors who are contiguous with that geography which is the North and East neighborhood. I hope that the redistricting can permit that proximity to continue for the next 10 year. Thank you for your consideration.

Dear Ms. Jimenez and Council Members,
Please continue to keep our East Richmond neighborhood in the same council district with the North and East neighborhood.

Of all the maps currently under consideration only Map 201 and Map 202 do so. When the City of Richmond districts were created we had to fight hard to make the council understand that our East Richmond neighborhood would be harmed and not get adequate representation if it was joined with a neighborhood in the Carriage Hills/El Sobrante area. Our needs are very different.

Dear City Council,
I live in the Richmond Heights neighborhood. I have lived in my current home, 3 blocks east of San Pablo Avenue, since 1987. The Richmond Heights neighborhood is right across San Pablo Avenue from the North and East neighborhood. Both neighborhoods are currently within district 6 for purposes of electing our representative on the Richmond City Council who is Claudia Jimenez. I have in the recent past served for over 10 years as the secretary of the Richmond Heights Neighborhood Council. Our Neighborhood Council discussed the upcoming redistricting process at our meeting this past Thursday, January 13. The people present expressed their desire that when the Council district boundaries are redone to comply with the 2020 census, our neighborhood remain in the same district with the North and East Neighborhood. Please do not put us in a district with the far-away San Pablo Dam Road corridor. We do not have as many common interests with them as we do with the North and East neighborhood who share with us the San Pablo Avenue corridor.

Thank you for your consideration.

Dear Council Members,
Please continue to keep our East Richmond

neighborhood in the same council district with the
North and East neighborhood.

Retaining this district should allow the city to achieve districts
overall with balanced populations under the 2020 census.

Thank you for your consideration,

Re: Comments re: “AN URGENCY ORDINANCE, PURSUANT TO GOVERNMENT CODE SECTION 65858, BY THE CITY COUNCIL OF THE CITY OF RICHMOND,

ESTABLISHING A TEMPORARY MORATORIUM ON THE ISSUANCE OF

BUILDING PERMITS

REQUIRING SEWER CONNECTIONS TO THE KELLER BEACH SANITARY SEWER; AND DECLARING THE URGENCY THEROF”
Five observations are made regarding the survey report, the analysis of failures and record drawings included with this agenda item:

1. Per the report, the aged (~62+ years) sewer line located along the shoreline has evidence of intrusion of sand and noticeable scaling. The route of sand into the line fails to note that most likely, dirt consisting of local sandstone, clay and shale from broken laterals that has decayed to only the denser “sands” remaining in the line. Other debris intrusions would, over time, erode or dissolve leaving only what is called “sand.” Thus the failures (attributed to laterals) are not well defined by what is remaining in the sewer pipe. Known “breaks” should be fixed in order to limit liability to contamination lawsuits by such parties as “Bay Keepers.” Failure to promptly act may have negative consequences.

2. A cured in place repair (repair option 1) is a known, justifiable “repair” to an existing system. On the contrary, a new replacement sewer line may be facing multiple regulatory hurdles that can be avoided by making repairs with technologies that are defined, have good replacement histories and are financially feasible. Sewer taxes that are paid yearly should have had some forward planning for maintenance and repairs over the years. As well this repair would have a distributed life span that would have costs allocated over that time, as well as a future fund for the next repair/replacement program.

3. The figure of the “Keller Beach Line” has a known error in sewer main locations that has been brought to the attention of Engineering and Planning Department since May of 2021. Attached is a survey, stamped and signed by a registered surveyor and presented to City Engineering and Planning Department on August 5, 2021. This survey, based on “50foot interval, pot-holed” investigation of actual sewer line, proved that the record used by City of Richmond as would be shown on the figure found on page 507 of the January18, 2022 agenda item is flawed. Said record portrays a sewer “main” privately installed by Del Olsen and Anthony Murphy (2008-2009.) As shown on page 507, the City record places the branch line approximately 30 feet west of the true line location.

The City Council should not accept flawed records for agenda items. Such inaccurate descriptions would legitimize errors causing potential lawsuits. This error of sewer location could easily cause future multiple problems (as all incorrect information usually does.)

4. A portion of the figure “Keller Beach Line” page 507 showing the area of Santa Fe and Western Drive is enlarged and attached with this communication. When compared to the attached true survey(dated 8/04/2021), the northern (6” - 235') branch line figure “Keller Beach Line's” location flaw is strikingly evident. If the City Council amends this agenda item to incorporate the correct sewer line location by adopting of the attached survey dated August 5, 2021, that would suffice to update and correct the record.

5. The moratorium for building permits does not account for the time for construction layout and installation which would most likely consume no less than 100 days. Thus, any moratorium would have no bearing on the progress of sewer main repairs to a well known issue and is a damaging delay to future and current development of infill lots. attachments

Mr. Satre,

Thank you for your email and your inquiry. The Keller Beach Sewer Assessment agenda item, which includes a staff report and the engineer’s assessment, will be heard at the 1/18/22 Council meeting and should be available on the City’s website this afternoon.

I can’t speak to information you received previously regarding hydraulic capacity of the line. I’m uncertain if Mr. Davidson knew of the line’s condition in 2009. What I am certain is that the line’s current condition is nothing short of dire. It has clearly exceeded its life expectancy and an alternative solution is required. The report includes photographs, commentary of sags, inaccessible pipes and manholes and excessive degradation of the internal pipe coating.

As I’m sure you’ll review, the report presents two VERY HIGH LEVEL, PRELIMINARY alternatives with pros/cons of each. The condition of this line is the basis for the Sewer Moratorium, also being presented at the 1/18/22 Council meeting.

Upon your review of the report, I would suggest any planning/building appeal letter be addressed to Lina and cc: me.

Sincerely,

Also, SB9 now allows most of the lots in the area to be split and second homes built as well as ADUs.

Practically every home and property owner in the area would be impacted by a moratorium.

To Joe Leach,
Joe, there is most likely an engineering report leading to this allegation of the sewer service along the shoreline main being of limited capacity or in need of repairs/upgrading.

In
2009City Engineer Richard Davidson sent me an email stating that the Santa Fe to Western branch sewer main had ample capacity to also handle two additional services coming from the east side of Pacific Avenue.

There is likely to be 5 to 10 more homes that would tie into either Santa Fe or Western Drive. Both lead to this main sewer "tributary" line that is partially exposed at low tide.

What has changed since 2009 other than that line was most likely installed around 1955 and there could be obstructions, pump issues, etc.

Thank you in advance, Joe.

Rodrick I Satre, REA

Hi Lina,

Just to confirm, are you saying that the moratorium may or may not be heard on the 18th? Or are you saying that the proposed language for the moratorium will not be known until the hearing? If it is the former, can you please send us the proposed language of the moratorium?

If we want to write a letter to the Council, who should we send it to and when do we need to send it by so that they have it before the meeting?

Thank you, Brad

Hi Brad:

Sorry for the confusion. Public hearing items are heard first based on the order of the agenda and the moratorium is in new business, so the order of the agenda won’t have this issue resolved.

Hi Lina,

I have copied Rudi on this email so that he can let you know if this works for him.

Regarding the moratorium, can you please clarify what you mean by the sentence below?

We are anticipating the moratorium being heard on January 18; however, it would not be heard in advance of this item so we won’t know the final approach the council will take in regard to the moratorium.

Thank you, Brad

All,

I am requesting your agreement via email to move the public hearing related to this appeal to February 1, 2022 City Council meeting. While there is a meeting scheduled for 1-25, these meetings are reserved for study session items. We are anticipating the moratorium being heard on January 18; however, it would not be heard in advance of this item so we won’t know the final approach the council will take in regard to the moratorium.

Can you please reply to my email stating your agreement? Thanks,
Lina
