Dear Chair Tucker and Members of the Planning Commission:
Levin Richmond Terminal Corporation, Richmond Pacific Railroad Corporation and Levin Enterprises, Inc. (Levin) support the proposed Amendment of ordinance No. 05-20 N.S., Richmond Municipal Code Article 15.04.615 (Ordinance), scheduled for consideration by the City of Richmond (City) Planning Commission as Agenda Item 2, PLN21-427, on December 2, 2021.
We are pleased that the City, Levin and other parties reached agreement on settlement of litigation challenging the Ordinance, subject to the City Council's adoption of the proposed Amendment. Although Levin maintains that coal and petcoke operations at the Terminal are not a source of harmful fugitive dust emissions, this settlement will address the City's concerns while protecting the jobs of our employees by providing additional time to transition to other We look forward to continuing opportunities to provide good-paying jobs and contribute to the well-being of our community.
