Lease Agreement - Richmond Police Activities League
FINANCIAL IMPACT: There is no financial impact. The expected lease revenue is negligible, and although it is not anticipated to cover the cost of administering the lease, that cost is also
anticipated to be negligible.
PREVIOUS COUNCIL
ACTION:
October 5, 2010
STATEMENT OF THE
ISSUE:
In 1997, the City of Richmond provided redevelopment
funds to the Richmond Police Activities League (“RPAL”) for the purpose of purchasing property and constructing a gymnasium for RPAL. At the time, the project was
approved with a condition of approval requiring RPAL to construct and maintain appurtenant parking facilities. The parties contemplated that RPAL would use this site,
located at 175 23rd Street, to construct and maintain the required parking facilities. Approval of the lease
agreement would facilitate successful completion of this project.
AGENDA
REPORT
February 15, 2022
RECOMMENDED ACTION:
ADOPT a resolution approving the lease agreement
between the City of Richmond and the Richmond Police
Activities League (“RPAL”) (as lessee), for the
construction and maintenance of a parking lot and an
option for a community garden and supportive programs
at 175 23rd Street, for a ten (10) year term with two (2) successive five (5) year option periods, at an annual rate of $1.00 per year – City Manager’s Office (Craig Murray 510-307-8188).
DISCUSSION:
In 1997, the City of Richmond provided redevelopment funds to RPAL for the purchase and construction of a new gymnasium. As a condition of approval of the plans for the gymnasium, RPAL was required to provide appurtenant parking facilities to accommodate the visitors to the gymnasium. At that time, RPAL and City staff anticipated that the site at 175 23rd Street would be used as the location of the parking lot. However, the parties did not enter into a transaction to provide RPAL with legal title to use the property until 2010. RPAL has operated an unimproved Parking Lot at this location since City Council approved a first lease on October 5, 2010. The RPAL agreement expired this year, and they are interested in completing the parking lot improvements as well as potentially operating a community garden and culinary programs.
To complete the project and comply with the terms of its design approval, RPAL seeks to enter into a lease for the use of 175 23rd Street for the construction and maintenance of a parking lot, and option for a community garden and supportive programs. The approval of a lease is the first step in the process of constructing the parking lot. When moving forward on the garden project, RPAL will thereafter need to submit the appropriate plans to the Community Development Department and seek the appropriate approvals and necessary permits before commencing construction.
RPAL has met with City Manager’s Office staff to discuss improvement plans and to enter a lease for the proposed site improvements. City staff has also recommended, and RPAL has accepted , to extend the boundaries of the lot and garden area to include the downslope areas on 22nd and 23rd Streets as well as the tip of the property as it extends to the underpass. RPAL would be responsible for the irrigation as well as electric utility services and site security. Additionally, RPAL has met with many neighboring community organizations such as Neighborhood Councils and the Family Justice Center to coordinate support for the proposed programs at the location.
Since the proposed lease does not contemplate improvement demolition or development, it would not trigger disposition provisions of the new State of California Surplus Property Law AB 1486.

As a non -profit social service organization, with a 35 -year history of service providing significant public benefits to the Richmond community, City staff recommends the City enter into the lease for a ten (10) year term with two (2) successive five (5) year option periods at a rate of $1.00 per year.
