GRANT OF EASEMENT
PUBLIC UTILITY
THIS INDENTURE, made by and between RICHMOND COUNTRY CLUB, a California non-profit corporation, hereinafter called the Grantor, and CITY OF RICHMOND, a municipal corporation organized and existing under the laws of the State of California, hereinafter called the Grantee,
WITNESSETH:
THAT the Grantor, for a good and valuable consideration, the receipt and sufficiency whereof are hereby acknowledged, hereby grants to the Grantee and to its successors and assigns an easement for any and all public service purposes including, but not limited to, the construction and maintenance of poles, wires, and conduits, for gas lines electric lines, telephone lines, and television facilities, public utilities and appurtenances to all the above, over, under or across all that certain real property designated as “Public Utility Easement” (“PUE”) and situated in the City of Richmond, County of Contra Costa, California, described in Exhibit “A” and shown in Exhibit “B”, both attached hereto and made a part thereof. The above-mentioned easements shall remain open and free from buildings and structures and their appurtenances, except for irrigation systems and their appurtenances, lawful fences and walkways.
TO HAVE AND TO HOLD, all and singular, the rights above described unto the Grantee and the Grantee's successors and assigns forever.
