STATEMENT OF THE
ISSUE:
Recordation of a large lot final map is a requirement of the Disposition and Development Agreement between
the City of Richmond and Winehaven Legacy, LLC
RECOMMENDED ACTION:
AUTHORIZE the Mayor to sign, and staff to record the
large lot final map for the Point Molate Development –
Public Works (Joe Leach 620-5478).
BACKGROUND:
Winehaven Legacy, LLC (the “Subdivider” and “Developer”) has prepared their final map and subdivision improvement drawings for the Point Molate Development Subdivision, a mixed-use community including residential, commercial, open space, and public facilities. This final map does not create the individual parcels of land for homes and businesses; rather, it creates large lots for transfer to other parties.
This map creates 55 lots designated as follows: lot numbers 1 to 44; Parcels M1 to M3; Parcels A to G; and Parcels W1 to and W2. The lots range in size from less than 1 acre to more than 90 acres.
The Vesting Tentative Subdivision Parcel Map (PLN20-057) for the Point Molate Development Subdivision was approved by the City Council with reference to Resolution No. 97-20 on September 8, 2020. In addition, City Council approved a development agreement with the Subdivider in Ordinance Number 23-20 N.S. as well as rezoning of the site in Ordinance Number 22-20 N.S. on September 15, 2021.
DISCUSSION:
Developer has complied with the conditions set forth by the City Council, the Subdivision Ordinance of the City of Richmond and all other applicable State and local laws and regulations to create parcels for development consistent with the previous planning effort. The land is currently owned by the City and the transfer of ownership between the City and the Developer will occur in accordance with the Disposition and Development Agreement.
The lots created by the large lot final map are not intended for development of individual residential or commercial units. These lots will be further subdivided in a future final map process. The lots as shown on the final map are generally designated as to their use. For reference, lots with a numerical value (1, 2, 3, 4, etc.)
May 3, 2022
are intended to be transferred to the Developer to be developed consistent with the approved plan. Lots with an alphabetical letter (A, B, etc.) are intended to be open space. Parcels W1 and W2 are water parcels.
The delineation of Point Molate Development Subdivision as shown in the attached map was prepared by the Developer. The large lot final map is being finalized and shall conform to all applicable regulations in advance of recordation.
Construction of streets, sidewalks, drainage facilities, water services, joint trench, lighting system and landscaping are to be completed and included in the developer’s project. Detailed construction drawings for the backbone infrastructure and the in-tract subdivision improvements are currently under review by the City. The City will not allow infrastructure construction to commence until the following have occurred: the improvement plans are completed to the satisfaction of the City Engineer; the Developer enters into an infrastructure improvement agreement (or subdivision improvement agreement) with the City; and the Developer posts the required bonds for the cash value of the improvements.
The Developer now seeks approval of the large lot final map consistent with the requirements of the approved Disposition and Development Agreement.
