Re: Insurance Requirements for Richmond BTA Community Center Project

Dear Mr. Reilly:

We received your email inquiring about the City’s insurance coverage and the request to add your company as an additional insured. We will not comply with your request. The builder’s risk insurance is intended to cover the City of Richmond and its property. It does not cover the contractor, as that would violate all the principles of risk transfer to add the contractor as an insured to any city policies. Further, as required by contract, the City of Richmond must be added as an additional insured to your general liability policy.

To reiterate, the contractor’s/builder’s risk coverage provides coverage to the City’s property. It does not cover your property or the subcontractor’s property. It is the contractor’s responsibility to provide coverage for their, or the subcontractor’s, property.

Based on the foregoing, your options are:

1. Angotti & Reilly, Inc. provides general liability insurance and designates the City of Richmond as an additional insured, as discussed and outlined in the contract requirements, and start the project immediately.

or

2. Angotti & Reilly, Inc. complies with the contract and provides the builder’s risk policy (which the City agreed to waive since we have builder’s risk insurance for the City’s property).

If you choose not to comply with the terms of the contract, the City of Richmond must move on to the next responsive bidder.

Please provide us with your response by 5:00 p.m. on July 26, 2022.
