James:

A 3:30 p.m. email about staff making a recommendation to the City Council that the City terminate its construction contract with Angotti & Reilly at 4:00 pm?

I thought we were going to be discussing “next steps,” according to your email from August 12, 2022, not staff recommending termination of the construction contract? Further, why would staff say in its staff report that Angotti & Reilly “has not been responsive to the Contract requirements for Builder’s Risk Insurance,” when staff has confirmed on several occasions that Angotti & Reilly was not responsible for obtaining builder’s risk insurance, most recently by Yader Bermudez who sent an email to Angotti & Reilly stating that “Laura will follow up with a copy of the City’s Builder’s Risk Insurance”?

This feels like a double cross. Angotti & Reilly was asking about builder’s risk insurance to protect the City’s property and the materials and equipment used on the project, and didn’t want to risk not being able to get builder’s risk insurance (if the City has no builder’s risk coverage, as it appears it does not), by starting physical work on the project.

Please let me know why staff would do this.

GDM
