It will provide firm commitments of Measure J funding for specific projects through June 30, 2021, and the I-80 Central Interchange Phase 2 project (“Project”) is included in the Measure J expenditure plan for Capital Projects; and

WHEREAS, a City Council resolution authorizing the city manager to execute Amendment #1 to the Real Property Services Agreement with the County of Contra Costa for Real Property Right of Way Services for the construction of the Central Avenue at Interstate 80 (I-80) Local Road Improvement Project is needed to increase the agreement in an amount of $1,000,000 for a total of $1,050,000; and

WHEREAS, the IS/MND included a Mitigation Monitoring and Reporting Plan (Section 5 of Exhibit A) which addresses the potential impacts of the proposed project. The IS/MND identified potential impacts in the areas of Biological Resources, Cultural Resources/Tribal Cultural Resources, Geology, Hazardous Materials and Noise. Mitigation measures were adopted to ensure that these potential impacts are avoided or reduced to less- than-significant levels; and

NOW, THEREFORE, BE IT RESOLVED that, after hearing all interested persons and considering all relevant evidence, the Council finds and determines as follows:

1. The Final IS/MND (Exhibit A), consisting of the Draft IS/MND and the Responses to Comments document, and the MMRP (Section 5 of Exhibit A), have been completed in accordance with the requirements of the CEQA, and the State CEQA Guidelines (14 Cal. Code Regs Section 15000 et.seq);

3. The Final IS/MND for the Project has been reviewed and found adequate by the City Council prior to authorizing the initiation of the bidding process for the work, and the Final IS/MND reflects the independent judgment and analysis of the City; and

4. The Final IS/MND for the Project identifies potentially significant effects on the environment; however, revisions to the Project and incorporation of the mitigation measures in the Project will reduce any and all significant adverse environmental impacts to a less-than-significant level.
