2 H2S Monitoring for the City of Richmond
Overview
Sonoma Technology understands that the ongoing goal of this project is to provide the public with high-quality and reliable data in real time on ambient Hydrogen Sulfide (H2S) concentrations around the City of Richmond water treatment plant. We will perform several main project elements to meet this goal:
• Upgrade the database to a modern cloud-based solution. Performing this task ensures continued high uptime by leveraging Amazon Web Services (AWS) and our Insight© data management system. Upgrading the database and operating it in a cloud environment has become the industry standard and is necessary to reduce maintenance costs. • Upgrade and operate a robust data communication system that ensures high-quality and complete data are continuously available in real time. The current communications system is based on 3G, which is being phased out.
• Upgrade and operate a real-time public website that clearly displays the H2S data and puts data concentration values into context such that data are properly interpreted by the public. • Provide opt-in alerting to the public in the case that a high measured H2S concentration is detected.
• Operate and maintain the instruments following standard operating procedures (SOPs) to ensure very high data recovery rates.
• Support the City of Richmond by providing data and expert interpretation on demand.

Our SOW and costs provide all equipment as a lease to the City such that Sonoma Technology is fully responsible for all equipment throughout the project’s duration. We have assumed that this contract will be for three years with an option to extend for an additional two years.

Background
Sonoma Technology became involved with H2S monitoring at the Richmond WWTP in 2017 when we replaced the old failing network of five sites with a newer network that included two H2S monitoring sites and one meteorology site (wind, temperature, relative humidity). Additionally, we developed a website (Figure 1, available at https://richmondwpcp-h2s.org/) and notification system to inform the public about these data. We installed the H2S Air Quality (AQ) monitoring system during FY 2018, with official operations beginning in early 2018. The monitoring system consists of two Galvanic H2S 3 lead-acetate tape-based monitors installed at the north and south fencelines of the facility. One meteorological sensor is collocated with the monitor at the north fenceline. Data from all measurements are fed into a database for real-time quality control before display on a public-facing website (Figure 1). This quote is for continued operations of the current system for an additional three years, and includes an option to extend another two years beyond that.

Figure 1. The current public-facing website showing hydrogen sulfide and wind data. The public can sign up for alerts when the H2S concentration exceeds 60 ppb.

4 Technical Approach
Sonoma Technology’s H2S monitoring approach provides an “end-to-end” solution that includes instrument operations and maintenance; automated data ingest and quality control; additional review of the auto-screened data by our analysts/technicians on a daily basis; upgrade and operation of a public website and alert system; and communication with the public. Our approach to major project components is discussed below.

Local Operational Support. For the last five years, we have operated and maintained the measurement systems at the Richmond WWTP with greater than 95% uptime. Site visits are conducted to replenish the analyzer consumables (lead acetate tape, electrolyte), conduct calibration of the sensors, and respond to any outages. Our automated alerting system notifies our technicians when outages occur so that they may be addressed, usually within 24 hours. Additionally, we perform daily data reviews to ensure the instruments are producing high-quality data.

Data Systems. A central system provides an efficient and effective way to store and integrate data from different sites and/or instruments. Sonoma Technology’s Data Management System (DMS) can handle the large volumes of data that will be generated in this project. The DMS has built-in systems to automate data processes, perform data averaging, and ensure timely, high-quality data. The DMS is used to automatically quality-control data, detect outliers and problems, generate reports, and create alerts. The auto-screening and graphical capabilities are used for continuous examination of data quality. The DMS feeds auto-screened data to our field operations website and notification system to inform project staff. This constant flow of information helps us keep the instruments operating and minimizes downtime, thus maximizing data completeness. The operations website shows maps and time-series plots of measured pollutants and wind data. The website is reviewed every day by our analysts/technicians.

In addition, the DMS stores quality-control flags, rationales for any changes, and other chain-of- custody information (i.e., raw data are preserved as well as all changes) to identify data that should be removed from the data set or modified, and to indicate why the data were removed or modified.

Currently, the database and public website are hosted within Sonoma Technology’s data center present in our Petaluma office. Given recent advances in cloud-based data services, we strongly recommend transitioning the existing database and website to the cloud, utilizing AWS. Upgrading to a cloud-based system ensures maintainability with industry best practices, which will ensure continued high-uptime reporting to the public website, as well as lower operational costs.

Public-Facing Website. A reliable 24/7 operational data system is needed for a public data display and reporting system. We propose to upgrade the website to seamlessly interface with the upgraded, cloud-based DMS.

Sonoma Technology operates dozens of real-time data systems hosted by cloud providers. We regularly conduct security checks, perform backups of the data systems and website, and build in 5 redundancy using virtual cloud systems. The public website provides visual display of real-time data every 5 minutes from the air monitoring network’s DMS. The real-time data displays are created by automated procedures that ingest, store, process, and quality assure (QA) each incoming data set.

The data products from the DMS are then transmitted to the public-facing website in real time (defined here as 10 minutes or less). We have demonstrated greater than 99% uptime for the public website to date.

Alerting. A key aspect of the public website is an opt-in notification system that is integrated with the data collected by the air monitoring network. The notification system is integrated with the air monitoring system and can automatically generate and issue air alerts when concentrations of H2S are elevated or within a specified range established by air quality scientists and City of Richmond staff. The notification system helps increase awareness of air quality levels, allowing the public to take actions to protect their health.

Technical Support for Data Delivery and Interpretation. Historically, Sonoma Technology has supported the City of Richmond regarding data requests by the BAAQMD as well as the public.

Additionally, we have supported WWTP staff in the interpretation of monitoring data. As part of the QA process, we have conducted annual reviews of the data to ensure the proper functioning of the system.

Contractor shall perform in accordance with generally accepted professional practices and standards of Contractor's profession. In the event that City, in its sole discretion, desires the removal of any person employed or retained by Contractor to perform services hereunder, such person shall be removed immediately upon receiving notice from City.

11. Business License
. Contractor shall obtain a Richmond Business License
before performing any services required under this Contract. The failure to so obtain such license shall be a material breach of this Contract and grounds for immediate termination by City; provided, however, that City may waive the business license requirement in writing under unusual or extraordinary circumstances without necessitating any modification of this Contract to reflect such waiver.

12. Termination Without Default. Notwithstanding any provision herein to the contrary, City may, in its sole and absolute discretion and without cause, terminate this Contract at any time prior to completion by Contractor of the project or services hereunder, immediately upon written notice to Contractor. Contractor may terminate this Contract at any time in its sole and absolute discretion and without cause upon 30 days' written notice to City. In the event of termination by either party, Contractor shall be compensated for: (1) all authorized work satisfactorily performed prior to the effective date of termination; (2) necessary materials or services of others ordered by Contractor for this Contract, prior to receipt of notice of termination, irrespective of whether such materials or services of others have actually been delivered, provided that Contractor is not able to cancel such orders. Compensation for Contractor in such event shall be determined by City in accordance with the percentage of the project or services completed by Contractor; and all of Contractor's finished or unfinished work product through the time of the City's last payment shall be transferred and assigned to City. Additionally, in the event of such termination, the City may proceed with the work in any reasonable manner it chooses.

13. Termination in the Event of Default. Should Contractor fail to perform any of its obligations hereunder, within the time and in the manner provided or otherwise violate any of the terms of this Contract, City may immediately terminate this Contract by giving written notice of such termination, stating the reasons for such termination. Contractor shall be compensated as provided in Section 12 of these General Conditions; provided, however, there shall be deducted from such amount the amount of damage, including attorney's fees, expert witness fees and costs, if any, sustained by City by virtue of Contractor's breach of this Contract. Additionally, in the event of such termination, the City may proceed with the work in any reasonable manner it chooses.

14. Conflict of Interest. Contractor acknowledges, represents and warrants that Contractor shall avoid all conflicts of interest (as defined under any federal, state or local statute, rule or regulation, or at common law) with respect to this Contract. Contractor further acknowledges, represents and warrants that no City official or employee has any economic interest, as defined in Title 2, California Code of Regulations §§ 18703.1 through 18703.5, with Contractor that would invalidate this Contract. Contractor acknowledges that in the event that Contractor shall be found by any judicial or administrative body to have any conflict of interest (as defined above) with respect to this Contract, all consideration received under this Contract shall be forfeited and returned to City forthwith. This provision shall survive the termination of this Contract for one (1) year.

15. Indemnification.

(a) If this Contract is a contract for design professional services subject to California Civil Code Section 2782.8(a) and Contractor is a design professional, as defined in California Civil Code Section 2782.8(b)(2), Contractor shall hold harmless, defend and indemnify the City, its officers, agents, employees, and volunteers from and against any and all claims, damages, losses, and expenses including attorneys’ fees arising out of, or pertaining to, or relating to the negligence, recklessness, or willful misconduct of the Contractor, except where caused by the active negligence, sole negligence, or willful misconduct of the City. To the fullest extent permitted by law, Contractor shall immediately defend and indemnify the City and its officers, agents, employees, and volunteers from and against any and all liabilities, regardless of nature or type, that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the Contractor, or its employees, agents, or subcontractors.

Liabilities subject to the duties to defend and indemnify include, without limitation, any and all claims, losses, damages, penalties, fines, and judgments; associated investigation and administrative expenses; defense costs, including but not limited to reasonable attorneys’ fees; court costs; and costs of alternative dispute resolution. Contractor’s obligation to General Conditions/EJ/TE 01-19-11 7 of 13

indemnify applies unless it is finally adjudicated that the liability was caused by the sole active negligence or sole willful misconduct of an indemnified party.
(b) If this Contract is not a contract for design professional services subject to California Civil Code Section 2782.8(a) or Contractor is not a design professional as defined in California Civil Code Section 2782.8(b)(2), Contractor shall indemnify, defend, and hold harmless the City, its officers, agents, employees and volunteers from any and all claims, suits, or actions of every name, kind and description, brought forth on account of injuries to or death of any person or damage to property arising from or connected with the willful misconduct, negligent acts, errors or omissions, ultra-hazardous activities, activities giving rise to strict liability, or defects in design by Contractor or any person directly or indirectly employed by, or acting as, the agent for Contractor in the performance of this Contract, including the concurrent or successive passive negligence of the City, its officers, agents, employees or volunteers.
(c) It is understood that the duty of Contractor to indemnify and hold harmless includes the duty to defend as set forth in Section 2778 of the California Civil Code. Contractor shall be obligated to defend, in all legal, equitable, administrative, or special proceedings, with counsel approved by the City, the City and its officers, agents, employees, and volunteers, immediately upon tender to Contractor of the claim in any form or at any stage of an action or proceeding, whether or not liability is established. An allegation or determination that persons other than Contractor are responsible for the claim does not relieve Contractor from its separate and distinct obligation to defend under this Section 15. The obligation to defend extends through final judgment, including exhaustion of any appeals. The defense obligation includes an obligation to provide independent counsel if Contractor asserts that liability is caused in whole, or in part, by the negligence or willful misconduct of an indemnified party. (d) The review, acceptance or approval of the Contractor’s work or work product by any indemnified party shall not affect, relieve or reduce the Contractor’s indemnification or defense obligations. This Section 15 survives completion of the services or the termination of this Contract.

The provisions of this Section 15 are not limited by, and do not affect, the provisions of this Contract relating to insurance.
(e) Acceptance of insurance certificates and endorsements required under this Contract does not relieve Contractor from liability under this Section

Contractor acknowledges that under § 2.60.070 of the Municipal Code ("Living Wage Ordinance"), Contractor shall promptly provide to City documents and information verifying its compliance with the Living Wage Ordinance. Also as prescribed in § 2.60.070, Contractor shall notify each of its affected employees with regards to the wages that are required to be paid pursuant to the Living Wage Ordinance.

Any assignment by Contractor of any or all of its rights under this Contract without first obtaining City's prior written consent shall be a default under this Contract.
