DISCUSSION:

Pursuant to Paragraph ¶31.c of the 2018 Settlement Agreement between the City of Richmond and Baykeeper, the City is required to replace or repair at least two (2) miles of Grade 5 gravity sewer per year, based on a five (5) year rolling average.

In order to achieve this goal, the City is required to allocate annual capital funding to cover the cost of these mandated repairs.

On October 17, 2022, the proposal was posted to BidsOnLine, and thirty-four (34) prospective bidders downloaded the bid information. On October 26, 2022, a mandatory walk-through was conducted with Veolia staff and eleven (11) participants. On November 22, 2022, four (4) bids were received from (in alphabetical order): Cratus, Inc., D’Arcy and Harty Construction, Inc., Glosage Engineering Inc., and W.R. Forde and Associates.

The bids received were as follows (in alphabetical order):

Contractor Contractor Bid Amount
Cratus, Inc. $2,245,945
D’Arcy and Harty Construction, Inc. $1,319,500

technical firms (V.W. Housen & Associates and Questa Engineers) also submitted acceptable proposals to provide compaction testing and engineering services during construction for this project for a total amount not to exceed $54,522 (project cost, plus mark-up, plus contingency and mark-up). As such, the task authorization for the project shall not exceed $2,075,622 [Project cost of $1,370,500, plus 16.5 percent mark-up of $226,133, plus 30 percent contingency of $478,990)].

Due to unforeseen conditions that may be experienced in the field, the City is requesting a significant contingency amount of 30 percent. This is so that the project will progress on time in order to meet the demands of the Baykeeper Settlement Agreement.

City staff is requesting City Council adopt the resolution approving the issuance of a task authorization to Veolia in the amount of $1,596,633 with an authorized contingency of 30 percent for a total contract not to exceed $2,075,622.
