STATEMENT OF THE
ISSUE:
The City Attorney requires approval of a first amendment to the agreement with Goldfarb & Lipman to ensure
appropriate legal representation and advice on land use matters, including litigation, as wells as CEQA and SB
330 claims as directed by the City Attorney.
RECOMMENDED ACTION:
APPROVE a First Amendment to the Legal Services
Agreement with Goldfarb & Lipman to continue to advise
and represent the City of Richmond, and its officers,
agents, and employees on matters pertaining to land use litigation, CEQA, and SB 330 claims as directed by the
City Attorney, in an amount not to exceed $75,000, for a total contract amount of $375,000, and extending the
term to June 30, 2025 – City Attorney’s Office (Dave

DISCUSSION:
To ensure the City continues to receive specialized advice and appropriate legal representation in land use litigation as well as CEQA and SB 330 claims, the City Attorney is requesting an amendment to the legal services agreement with Goldfarb & Lipman. The firm is on the City Attorney’s current approved Request for Qualifications (RFQ) list.
Goldfarb and Lipman has been providing advice and representing the City in land use litigation since June of 2021. The law firm has the experience and expertise necessary to continue to advise and represent the City of Richmond in pending and future land use litigation.
The City Attorney’s Office requests approval of this first amendment to the legal services agreement with Goldfarb &Lipman which will increase the compensation in an amount not to exceed $75,000 and extend the term to June 30, 2025. Rates for Goldfarb & Lipman are as follows: Partner, $390 per hour and Associate, $345 per hour.
