Certification and Order Coverage
This Clean Water Act (CWA) section 401 Water Quality Certification (Certification) and Order is issued to the City of Richmond (City; Permittee).

Pursuant to CWA section 404, the Permittee requested authorization to fill and discharge to waters of the U.S. from the U.S. Army Corps of Engineers (Corps), Regulatory Branch under a Nationwide Permit (NWP). The Corps issued a letter on December 20, 2022, provisionally notifying the Permittee that the Flood Risk Reduction in the Rheem Creek Watershed Project (Project) may be authorized under NWPs 7 (Outfall Structures) and 27 (Aquatic Habitat Restoration, Enhancement and Establishment Activities) pursuant to CWA section 404 (33 USC § 1344 et seq.
) (Corps File No. 2022-00042S).

The Permittee applied to the San Francisco Bay Regional Water Quality Control Board (Water Board) requesting Certification verifying the Project does not violate State water quality standards. The application for Certification was received on October 13, 2022. The following sections are derived from the Application.

1. Project
The California State Coastal Conservancy (SCC) awarded American Rivers and its project partners, The Watershed Project and Restoration Design Group (RDG), a grant to work with the local community, the City, and others to identify ecological approaches that address flooding in the Rollingwood neighborhood. The Rheem Creek at Rollingwood Flooding Assessment (RDG, May 15, 2020) summarizes the cause of flooding and potential solutions based on resident surveys, topographic surveys, historical research, hydraulic modeling, and site observations.

The Project, which will implement measures to reduce flood risk and enhance wildlife habitat, is based on the findings of the flood assessment and will remove invasive species and excessive sediment, grade a geomorphically stable channel, and plant native riparian vegetation to shade out invasive plants and improve creek habitat.

1.1 Site Description
The Project reach forms the approximate border between the City’s Fairmede neighborhood and the Rollingwood neighborhood in unincorporated Contra Costa County (lat. 37.966355, long. -122.332559). After flowing through the Project site, the Creek flows northwest through the cities of San Pablo and Richmond and into the San Francisco Bay (Bay) in the vicinity of the Dotson Family Marsh. The Creek corridor is approximately 30 feet wide and bordered by private homes on both sides. Richmond residents living in the Fairmede neighborhood own the Creek as their backyard property lines extend past the south side of the Creek. Water from the Creek has been flooding adjacent neighbors and nearby streets to the south on an annual basis for decades. The flood assessment completed in 2020 determined there are two primary causes for the flooding: (1) deposition of sediment sufficient to completely fill the channel in some areas, and (2) invasive, high-roughness vegetation growing along the bed and banks of the Creek between the intersection of Annapolis Avenue and Moyers Road on the upstream end, and Contra Costa College on the downstream end.

The Creek includes open water habitat, emergent wetlands, and ruderal riparian vegetation along the ban
ks. Details of the existing vegetation types are included in the Application.

1.2 Project Description
The Project will include grading and excavating sediment along approximately 1,200 linear feet (LF) and clearing vegetation and replanting along approximately 1,500 LF of the Creek respectively. Two storm drains that convey street runoff to the Creek will be replaced: (1) a 12- inch pipe extending from Greenwood Court to the Creek will be replaced with a 24-inch pipe; and (2) a 12-inch pipe extending from Greenwood Drive will be replaced with a 12-inch pipe and inlets at both locations will be replaced. Sediment will be removed from the culvert beneath Fordham Street. Six trees, including five riparian trees (four willows and an ash), will be removed and replaced with approximately 176 native riparian trees ranging in size from D40 to 15 gallon, plus willow poles, native seed mix, and native ground cover container plants. The Project will be implemented as shown on the plans, Flood Risk Reduction in the Rheem Creek Watershed, Cities of Richmond & San Pablo, 90% Plan Set (RDG, Inc., November 30, 2022), and as discussed in the Flood Risk Reduction in the Rheem Creek Watershed, Design Basis Report (RDG, February 7, 2022), with minor revisions to include invasive plant removal, sheet mulching, and weeding within the central reach of the Creek upstream of Fordham Street where sediment removal will not occur.

Water Diversion: In-stream grading will be limited to the dry season (April 15 to October 31) to the maximum extent feasible when the stream flows are lowest. Water diversion will likely be necessary and dewatering details will be developed and submitted to the Water Board before the start of construction.

2. Impacts to Waters of the State
The Water Board has independently reviewed the Project record to analyze impacts to water quality and the environment and designated beneficial uses within the Project’s watershed. The San Francisco Bay Basin Water Quality Control Plan (Basin Plan) defines the beneficial uses of waters of the State. The Basin Plan assigns the following beneficial uses to the Creek: warm freshwater habitat, wildlife habitat, and water contact and non-contact recreation.

2.1 Fill and Discharge
The Project will temporarily impact approximately 0.23 acre along 1,200 linear feet (LF) of the Creek below the ordinary high-water mark. Within this area approximately 0.1 acre of other waters will be impacted, and 0.13 acre of emergent freshwater wetlands will be removed. The wetlands, which have formed on sediment deposits that will be removed, will be converted to open waters. The impact area includes a non-Corps jurisdictional swale located as shown on

Figure 4, Sheet 2- East, Biological Assessment, Rheem Creek Ecological Solutions Project (LSA, January 2022). Approximately 900 cubic yards of sediment will be excavated and hauled offsite to an approved upland disposal site. Temporary impacts to riparian habitat along the upper Creek banks will occur over an additional 0.55 acre during removal of invasive vegetation and approximately six riparian trees. The Project will permanently impact approximately 0.13 acre of emergent freshwater wetlands with instream vegetation removal and 0.007 acre of other waters for placement of 195 cubic yards of rock scour protection at the replaced storm drain outfalls.

3. Mitigation
To mitigate for the Project’s permanent and temporary impacts to State waters, the Permittee will implement the restoration plan as shown on Sheets L-4.0, L-4.2, L-4.3, L-4.4, and L-5.0 included in the Flood Risk Reduction in the Rheem Creek Watershed, Cities of Richmond & San Pablo, 90% Plan Set (RDG, Inc., November 30, 2022). Restoration work includes planting of Water Quality Certification and Order Place ID 885993 Flood Risk Reduction in the Rheem Creek Watershed Project RM 451029

native riparian trees and plants in accordance with the schedule shown on the above noted plan sheets. The planting plan has been designed to avoid use of large trees in the vicinity of utilities in the Project vicinity (overhead power lines and a sanitary sewer). The overall goal is to enhance riparian tree canopy cover that is expected to reduce growth of instream vegetation that can contribute to flow impedance and flooding. Post-construction activities include maintenance and monitoring as described in the Maintenance Plan, Flood Risk Reduction in the Rheem Creek Watershed (RDG, October 11, 2022) (Maintenance Plan) and the Monitoring Plan, Flood Risk Reduction in the Rheem Creek Watershed (RDG, October 11, 2022) (Monitoring Plan). The intent of the Maintenance Plan is to provide guidance to the Permittee and/or its representatives regarding maintenance of the new plants and restored Creek channel.

The Monitoring Plan includes Project goals and objectives and vegetation and channel morphology success criteria. Although some monitoring will occur every year, monitoring results will be reported after years 1-5, 7, 9, and 10. Until the riparian tree canopy develops to provide shade over the Creek, adaptive maintenance may include removal of instream vegetation or sediment on a periodic basis during the 10-year monitoring period after consultation with Water Board staff and approval by the Executive Officer. Under post-Project conditions the site will remain closed to the public as private property under a public utility easement and managed jointly by the Permittee and adjacent property owners.

The Project will include development and implementation of a construction stormwater pollution and prevention plan to avoid and minimize construction-related water quality effects. The plan will identify specific best management practices (BMPs) for each construction activity to eliminate or minimize the potential for the discharge of polluted stormwater or unauthorized non- stormwater into the Creek.

4. California EcoAtlas
Regional, state, and national studies have determined that tracking of mitigation and restoration projects must be improved to better assess the performance of these projects, following monitoring periods that last several years. To effectively carry out the State’s Wetlands Conservation Policy of no net loss to wetlands, the State needs to closely track both losses and successes of mitigation and restoration projects affecting wetlands and other waters of the State. The Water Board must also track project performance in Bay Area creeks subject to routine repair and maintenance activities, such as recurring instabilities. Therefore, we adopted the digital interactive mapping tool called EcoAtlas.
[1] EcoAtlas is a web-based tool that
integrates maps, project plans, site conditions, restoration efforts, and other elements on a project-by-project basis based on data inputs. Accordingly, we require the Permittee to upload their Project information to EcoAtlas with the Project Tracker tool at https://ptrack.ecoatlas.org (see Condition 13). The San Francisco Estuary Institute developed EcoAtlas and mai ntains detailed instructions for Project Tracker on its website at https://ptrack.ecoatlas.org/instructions.

5. CEQA Compliance
Pursuant to the requirements of the California Environmental Quality Act (CEQA), as lead agency the City of Richmond filed a Notice of Exemption (NOE) for the Project on December 8, 2020. The Project is categorically exempt from CEQA pursuant to CEQA Guidelines section 15333 for small habitat restoration projects (State Clearinghouse No. 2022050390). The Water Board, as a responsible agency under CEQA, concurs that the exemption is appropriate and

6.5 Mitigation and Monitoring Requirements

16. Mitigation Im plementation. The Permittee shall implement the mitigation work as described in the Mitigation section of this Certification. Plants shall be irrigated by hand during the establishment period to ensure survival and growth. Rock used at the culvert outlets shall be kept to the minimum necessary to prevent scour at the discharge location and shall be set within the bed and bank to conform with contours upstream and downstream of the rock, with no bed or bank discontinuity. Project impacts and mitigation plantings shall occur during the same construction season;

17. Mitigation Monitoring & Maintenance. The Per
mittee shall monitor the Project’s
mitigation areas for a minimum period of ten years to assess development of channel morphology and the health, vigor, and canopy cover of riparian vegetation plantings.

Annual assessments of stream conditions, to include sediment accumulation or channel erosion shall be performed, with monitoring conducted at approximately the same time each year during the low flow season, and at least twice during high flows in the first three years of monitoring, and once during high flows in the last two years of monitoring. Vegetation and geomorphic monitoring shall be performed at a minimum of eight cross-sections along the Project reach, and visual observations at locations between the cross-sections shall be made to document areas where conditions differ significantly from the monitored cross sections. If monitoring indicates the mitigation efforts have not adequately compensated for Project impacts, the Permittee shall document these observations in the annual reports and make remedial action recommendations, as necessary. If high flow events indicate a need for adaptive management of stream morphology, then measures shall be proposed and implemented in consultation with Water Board staff. If monitoring demonstrates that plants/trees are on a trajectory to meet the performance criteria at the end of five years and no replanting is required due to lack of survival, then monitoring during the last five years may be limited to Years 7, 9 and 10. If replacement plantings are necessary then vegetation monitoring shall be performed each year and the monitoring period shall be extended accordingly;

18. Annual Monitoring Reports. The Permittee shall submit annual monitoring reports, acceptable to the Executive Officer, by January 31 after monitoring years 1-5, and years 7, 9, and 10. The first monitoring year commences in the calendar year after completing the mitigation plantings. At the time of this Certification the mitigation completion is anticipated in 2023. Therefore, monitoring of mitigation areas shall begin in 2024 and the first annual monitoring report shall be due on January 31, 2025, unless the Project is completed at a different time. The annual reports shall summarize each year’s monitoring results and include detailed information on the geomorphic conditions in the Creek and riparian planting survival and growth, including canopy cover. The annual reports shall compare data to previous monitoring years and describe mitigation stream evolution and any need for adaptive management measures to ensure progress in meeting, and conforming to, the Project goals of increased riparian functions and flood protection. The annual reports shall include the status of long-term management measures as described in Condition 21, and shall also include, but not be limited to, the following:
a) Photographs: The annua
l reports shall include photographs taken during the
monitoring year from the photo-documentation points specified in Condition 12.

Water Quality Certification and Order Place ID 885993 Flood Risk Reduction in the Rheem Creek Watershed Project RM 451029

Page 9 of 13 ends

The photographs shall include captions that state the photograph’s point of view, photo-documentation point location, and date photographed. b) Environmental Drivers: Each monitoring report shall describe precipitation events or periods of drought that occurred at the site during the monitoring year. The effects of the Project and environmental drivers (e.g., precipitation events, drought events) on site conditions shall be described in reference to the monitoring year’s precipitation events. Irrigation of planted riparian vegetation is acceptable providing at least two years of monitoring for attainment of performance criteria occur after irrigation is terminated.

If adverse impacts to waters of the State are observed during the monitoring period or if riparian vegetation is not developing as anticipated, additional mitigation may be required by the Executive Officer, including but not limited to extension of the monitoring period. The annual report shall reference AMR_451029_Flood Risk Reduction Rheem Creek and shall be submitted via email to RB2- [email protected] and the Water Board staff responsible for 401 certifications in Contra Costa County. Annual reports may also be submitted in hard copy to the attention of 401 Certifications Reports (see the address on the letterhead);

19. Performance Criteria. The pri
mary ecological goals of the Project are to allow
improved flood flow conveyance and create effective riparian shade canopy cover over the Creek to reduce the likelihood of in-channel vegetation establishment that would reduce flood conveyance. The Project also anticipates evolution of the channel morphology in the sediment removal areas to mimic existing active channel dimensions and floodplain development at other locations within the Creek.

Development of instream complexity may be limited and governed by future sediment supply. To evaluate performance the Permittee shall conduct monitoring to assess success of the riparian habitat growth, channel shading, and topographic changes in and adjacent to the channel. Reconfiguration of physical features within the channel (floodplain, meandering within the corridor, etc.) are expected and are acceptable providing such changes do not adversely affect flood conveyance, bank stability, structural integrity, or Creek habitat quality and function. Tree survival by species shall be >80% and bare ground shall be <75%, <60%, <40%, <30% and <25% at the end of the first five monitoring years. Tree survival and bare ground shall be sustained at >80% and <25% at the end of the 10-year monitoring period. Development of canopy cover shall be monitored, quantified, and reported in the annual reports. The primary geomorphic performance criterion for channel morphology is stability (no excessive bed or bank erosion or sedimentation), provision of flood flow conveyance, and increased complexity of channel morphology;

20. Notice of Mitigation Monitoring Completion. Wit
hin 30 days of confirming that the
Project’s mitigation has been completed and performance criteria have been met, the Permittee shall submit, acceptable to the Executive Officer, a Notice of Mitigation Completion that references NMMC_451029_Flood Risk Reduction Rheem Creek.

This report shall be submitted via email to [email protected] and t
o the Water Board staff responsible for 401 certifications in Contra Costa County.

Any proposed material change in operation shall be reported to the Executive Officer at least 30 days in advance of the proposed implementation of any change. Changes to discharges include, but are not to be limited to, significant new soil disturbances, proposed expansions of development, or any change in drainage characteristics at the Project site. For the purpose of this Order, this includes any proposed change in the boundaries of the area of wetland/waters of the State to be impacted; Rationale: Condit ions 26 and 27 are necessary to ensure compliance with the permit and applicable conditions (CWC section 13264).

28. Submittal of Reports. Where this Certification requires submittal of reports, including plans, reports, or related information, the submitted reports shall be acceptable to the Executive Officer;
Rationale: This c ondition is necessary to ensure compliance with the permit and applicable conditions (CWC section 13267).

29. Individual Waste Discharge Requirements. Should new information come to our attention that indicates a water quality problem with this Project, the Water Board may issue Waste Discharge Requirements pursuant to CWC sections 13263 and/or 13377 and 23 CCR section 3857;

30. Expiration. This O
rder shall continue to have full force and effect regardless of the expiration or revocation of any federal license or permit issued for the Project;

6.7 Standard Conditions

31. Certification and Order Modification. This Order is subject to modification or revocation upon administrative or judicial review, including review and amendment pursuant to CWC sections 13320 and 13330 and 23 CCR section 3867;

32. Hydroelectric Facilities. This
Order does not apply to any discharge from any
activity involving a hydroelectric facility requiring a Federal Energy Regulatory Commission (FERC) license or an amendment to a FERC license, unless the pertinent certification application was filed pursuant to 23 CCR subsection 3855(b) and that application specifically identified that a FERC license or amendment to a FERC license for a hydroelectric facility was being sought;

33. Application Fee. This
Certification and Order is conditioned upon full payment of the required fee, including annual fees, as set forth in 23 CCR section 3833. The Project’s Application and Project fee of $645, calculated using the 2021-2022 Water Quality Certification Dredge and Fill Application Fee Calculator, Category D – Ecological Restoration and Enhancement Projects, was received by the Water Board on February 14, 2023;
Water Quality Certification and Order Place ID 885993 Flood Risk Reduction in the Rheem Creek Watershed Project RM 451029

Page 12 of 13 ends

34. Annual Fee Invoice. In accordance with 23 CCR section 2200, the Permittee shall pay an annual fee to the Water Board each fiscal year (July 1 – June 30) until Project construction and mitigation activities are completed and an acceptable Notice of Project Mitigation Monitoring Completion is received by the Water Board (Note: the Annual Fee may be changed by the State Water Board; at the time of Certification it was $365 per year). Annual fees will be automatically invoiced to the Permittee. The Permittee must notify the Water Board when mitigation is complete with a final report in order to request termination of annual billing.

Rationale: Condit
ions 31-34 are standard conditions that “shall be included as conditions of all water quality certification actions” (23 CCR section 3860(a)).

In addition to the information noted above, these conditions are individually required to ensure compliance with narrative water quality objectives in the Basin Plan, the state anti-degradation policy (State Water Board Resolution No. 68-16), the California Wetlands Conservation Policy (Executive Order W-59-93, Basin Plan Chs. 4 and 5), and Water Board policies for the protection of wetlands and waters (Basin Plan Ch. 4, including Ch. 4.23).

The conditions above are individually authorized as noted above and by 23 CCR sections 3838 and 3859 and CWC Div. 7, Ch. 4, Article 4, Waste Discharge Requirements.

This Order applies to the Project as proposed in the application materials and designs referenced above in the conditions of Certification. Be advised that failure to implement the Project in conformance with this Order is a violation of this Certification. Any violation of Certification conditions is a violation of State law and subject to administrative civil liability pursuant to CWC section 13350. Failure to meet any condition of this Certification may subject the Permittee to civil liability imposed by the Water Board to a maximum of $10,000 per day of violation or $10 for each gallon of waste discharged in violation of this action. Any requirement for a report made as a condition to this Certification is a formal requirement pursuant to CWC section 13267, and failure or refusal to provide, or falsification of such required report, is subject to civil liability as described in CWC section 13268. The burden, including costs, of these reports bears a reasonable relationship to the need for the report and the benefits to be obtained.

Should new information come to our attention that indicates a water quality problem with this Project, the Water Board may issue Waste Discharge Requirements.

If you have any questions concerning this Order, please contact Kathryn Hart of my staff via email to [email protected] or by phone at (510) 622-2356. All future
correspondence regarding this Project should reference the RM No. indicated at the top of this letter.

Sincerely,
__________________________

Regulatory Division

Subject: File Number SPN-2022-00042S

Ms. Mary Phelps
City of Richmond
450 Civic Center Plaza
Richmond, California 94804
[email protected]

Dear Ms. Phelps:

This correspondence is in reference to your submittal of August 1, 2022, concerning Department of the Army (DA) authorization for the Flood Risk Reduction in the Rheem Creek Watershed project. The project will alleviate chronic flooding of the Rollingwood neighborhood along Rheem Creek located at the intersection of Moyers Road and Annapolis Avenue downstream to just past the intersection of Fordham Street in the City of Richmond, Contra Costa County, California (Lat.: 37.966355° Long.: - 122.332559°).

Work within U.S. Army Corps of Engineers’ (Corps) jurisdiction will include clearing, grubbing and excavating along approximately 1,200 linear feet (approximately 38,310 square feet, 0.88 acre) of the Rheem Creek. Approximately 900 cubic yards of sediment will be excavated and hauled offsite to an approved upland disposal site. and replanting with native vegetation along approximately1,500 linear feet of the creek. The project will temporarily impact approximately 38,310 square feet (0.88 acre) of Rheem Creek due clearing and grubbing and the excavation and removal of approximately 900 cubic yards of sediment. The project will permanently impact 0.13 acre of in stream emergent wetlands. The 12-inch storm drain that flows from Greenwood Court into the creek will be replaced with a new 24-inch storm drain requiring the permanent fill discharge of 195 cubic feet of rip rap below ordinary high water of Rheem Creek. The failing retaining wall will also be replaced by reconstructing the existing bank. All work shall be completed in accordance with the plans and drawings titled “USACE File #SPN-2022-00042, Rheem Creek Restoration Project, Between Fordham Street and Greenwood Drive, Richmond, Contra Costa County, California, May 11, 2023, in 28 sheets,” provided as enclosure 1.

Section 404 of the Clean Water Act (CWA) generally regulates the discharge of dredged or fill material below the plane of ordinary high water in non-tidal waters of the United States, below the high tide line in tidal waters of the United States, and within the lateral extent of wetlands adjacent to these waters. Section 10 of the Rivers and - 2 -
Harbors Act (RHA) generally regulates construction of structures and work, including excavation, dredging, and discharges of dredged or fill material occurring below the plane of mean high water in tidal waters of the United States; in former diked baylands currently below mean high water; outside the limits of mean high water but affecting the navigable capacity of tidal waters; or below the plane of ordinary high water in non-tidal waters designated as navigable waters of the United States. Navigable waters of the United States generally include all waters subject to the ebb and flow of the tide; and/or all waters presently used, or have been used in the past, or may be susceptible for future use to transport interstate or foreign commerce.

Based on a review of the information in your submittal the project qualifies for authorization under Department of the Army Nationwide Permits (NWPs) 7 for Outfall Structures and Associated Intake Structures and 27 for Aquatic Habitat Restoration, Enhancement and Establishment Activities (86 Fed. Reg. 73522, December 27, 2021), pursuant to Section 404 of the CWA of 1972, as amended (33 U.S.C. § 1344 et seq.).

To be eligible for authorization, the project must be in compliance with the terms of the NWP, the general conditions of the Nationwide Permit Program, and the San Francisco District regional conditions cited on our website
(www.spn.usace.army.mil/Missions/Regulatory/Permitting/Nationwide/). You must also be in compliance with any special conditions specified in this letter for the NWP authorization to remain valid. Non-compliance with any term or condition could result in the revocation of the NWP authorization for your project, thereby requiring you to obtain an Individual Permit from the Corps. This NWP authorization does not obviate the need to obtain other State or local approvals required by law.

You s
hall comply with all terms and conditions set forth by the “Clean Water Act Section 401 Water Quality Certification and Order for the Flood Risk Reduction in Rheem Creek Watershed Project, Contra Costa County,” issued by the San Francisco Bay Regional Water Quality Control Board on March 13, 2023 (enclosure 3). You shall consider such conditions to be an integral part of the NWP authorization for your project.

In order to ensure compliance with this NWP authorization, the following special conditions shall be implemented:

1. Heavy equipment shall be used in Corps jurisdiction only where necessary and shall be removed from the site at the earliest opportunity.

2. All appropriate best management practices shall be implemented throughout the project site to help minimize sediment disturbance and suspension within the water.
- 3 -

3. A post construction report shall be submitted 45 days after the conclusion of construction activities. The report shall document construction activities and contain as-built drawings (if different from drawings submitted with application) and include before and after photographs.

4. You shall implement the Flood Risk Reduction in Rheem Creek Watershed - Mitigation Plan dated March 15, 2023, and provide annual monitoring reports for five years by December 31 of each year.

5. If at any time it appears that success criteria will not be met, then you shall develop contingency measures and provide them to the Corps for review and approval prior to implementation.

6. Your responsibility to complete the required compensatory mitigation as set forth in Special Condition 4 will not be considered fulfilled until you have demonstrated mitigation success and have received written verification from the U.S. Army Corps of Engineers.

You may refer any questions on this matter to me telephone at (415) 503-6778 or by e-mail at [email protected]. All correspondence should be addressed to the Regulatory Division, South Branch, referencing the file number at the head of this letter.
