account string 01917090-400218-PM902. Fiscal Year

STATEMENT OF THE
ISSUE:

To sustain security services at Point Molate, it is
imperative to make a budget appropriation by transferring unspent funds from Fiscal Year 2022-2023 to the Fiscal
Year 2023-2024 General Fund budget. This reallocation
will provide the necessary financial resources for City staff to continue ensuring the ongoing safety and
protection of the area.

RECOMMENDED ACTION:

ADOPT a resolution appropriating $237,677.50 to the
Fiscal Year 2023-2024 budget to continue security
services provided by Universal Protection Service, LLC
d/b/a Allied Universal Security Services at Point Molate – Police Department (Chief Bisa French 510-621-1802).

DISCUSSION:

Under the Guidiville Rancheria vs United States et al. Amended Judgment, the City is responsible for bearing the costs of securing the property until the development areas are sold to a third party. The budget appropriation to Fiscal Year 2023-2024 will allow the City to continue paying the agreed upon security contract from the original account string in the General Fund, non-departmental, security account. The security company, Universal Protection Service, LLC d/b/a Allied Universal Security Services (“Allied”), has been providing security services without interruption during the times between the transition of developers.

The Police Department has been designated to oversee and manage the contract with Allied Universal for the Point Molate location, consistent with the department’s existing role in managing the contract for services performed at the Civic Center Plaza (City Hall), Library, and Booker T. Anderson properties. The funding for the Civic Center and Library is sourced from the non-department security account string based on prior year appropriations, without any specific recommendation by Police Department staff.

The budget appropriation for the Fiscal Year 2023-2024 Point Molate services was unintentionally overlooked due to the unique project code associated with the site. It was not until setting up the purchase order that it was realized that the account string did not have an appropriated budget for Fiscal Year 2023-2024. Once realized, Police Department staff worked with Public Works staff to promptly communicate the discrepancy to Finance staff. The objective was to ensure that the funds remain outside of the fund surplus calculations to guarantee the appropriate amounts can be correctly appropriated in Fiscal Year 2023-2024 with minimal impact on surplus funding totals.

City staff believes the remaining funding of $237,677.50 will adequately cover the security services based on the original annual estimate of $230,811.46, which does not include holiday pay, overtime, or extra coverage, or special event coverage. The budget appropriate difference of $6,866.04 should cover the unplanned cost difference.

City staff recommends City Council approve this re-appropriation of funds to continue with the contract services provided by Universal Protection Service, LLC d/b/a Allied Universal Security Services through the contract end date of June 30, 2024.
