STATEMENT OF THE
ISSUE:
A legal services agreement with Angelo, Kilday, & Kilduff LLP is needed to ensure that the City has appropriate
legal representation and counsel in future and pending
employment litigation matters.
RECOMMENDED ACTION: APPROVE a new legal services agreement with Angelo, Kilday, & Kilduff LLP, for an amount not to exceed
$200,000, for a term beginning May 1, 2024, to June 30, 2027 – City Attorney’s Office (Kimberly Chin 510-620-
6709/Shannon Moore 510-620-6505).
DISCUSSION:
The City Attorney’s Office is requesting a legal services agreement with Angelo, Kilday, & Kilduff LLP (AKK) to provide legal advice and representation for employment matters.
AKK is a seasoned law firm that has experience defending public entities in a variety of AGENDA

matters, including tort, police liability, and employment cases. Attorney Serena Warner, a partner at AKK, is an experienced employment attorney, who has litigated employment cases encompassing matters including but not limited to discrimination, whistleblower retaliation, employer assessment of non-conviction criminal charges, and defamation. She has defended public entities in employment matters from pre-litigation through trial, and has substantial trial experience, resulting in several defense verdicts for public entity clients. Ms. Warner has the experience and expertise necessary to represent and advise the City in employment matters; therefore, the City intends to retain Ms. Warner for future and pending employment cases, as well as to provide employment advice and counsel.
The rates for AKK are: $275/hour for partner(s); $250/hour for associates(s); and $125/hour for paralegal(s).
The City Attorney’s Office is requesting that the City enter into a contract with Angelo, Kilday, & Kilduff LLP, for a total contract amount of $200,000, for a contract term of May 1, 2024 to June 30, 2027.
