RECOMMENDED ACTION: HOLD a public hearing and ADOPT a resolution approving the Engineer’s Report for the Marina Bay
Landscaping and Lighting Maintenance District for Fiscal Year 2024-2025, providing for a three percent increase in annual assessments – Public Works Department (Daniel
Chavarria 620-5478/Robert Armijo 620-6920).

DISCUSSION:

On July 28, 2009, the City Council adopted Resolution No. 83-09, approving the formation of the Marina Bay Landscaping and Lighting Maintenance District (MBLLMD), the founding Engineer’s Report, the assessment rate, and authorized annual increases.

The MBLLMD was established to fund the ongoing maintenance and improvements of various public landscaping and lighting facilities within the Marina Bay area, deemed to provide special benefits to the properties within its boundaries. Each year, the assessment rate for MBLLMD must be confirmed by the City Council.

The City Engineer caused the preparation of the Annual Levy Report for the Marina Bay Landscaping and Lighting Maintenance District for Fiscal Year 2024-2025. The Engineer’s Report describes the existing and proposed improvements, as well as substantial changes to be made to existing improvements within the MBLLMD. It also estimates the costs associated with these improvements. To meet these costs, the City Engineer recommends that the City Council increase assessments from those levied in Fiscal Year 2023-2024 by an inflation rate of 3%, as permitted under Resolution No. 83-

09. On June 4, 2024, the City Council approved the preliminary Engineer’s Report and adopted a resolution stating its intention to increase assessments and announcing that a public hearing on the proposed assessments would be held at the City Council’s regular meeting of June 25, 2024, at 6:30 p.m. The City Council’s Resolution of Intention was mailed to all property owners within the Marina Bay Landscaping and Lighting Maintenance District.

The proposed improvements for FY 2024-2025 include continued maintenance of public landscaping areas, including parks, trails, and medians, upkeep and servicing of public lighting facilities within the MBLLMD, and the implementation of minor repair and rehabilitation projects as needed to maintain the health and aesthetics of the landscaped areas.
