DISCUSSION:
The Engineering Division of the Public Works Department is requesting that the City Council approve a second contract amendment with Ninyo & Moore, an engineering firm that provides material testing services to ensure quality and compliance with contract specifications, for as-needed construction materials testing for various City projects. The firm has advanced laboratory facilities that are fully equipped and staffed by professionals, with laboratory testing services supervised by a registered professional engineer. Ninyo & Moore can perform a wide range of construction materials testing, which includes soil, concrete, asphalt, masonry, steel, and more. All testing equipment is annually calibrated by representatives who use equipment traceable to the National Institute of Standards and Technology and inspected by the Cement and Concrete Reference Laboratory (CCRL) regularly.
This is an on-call contract, and work will be allocated as the City issues task orders (also known as Work Authorizations) for Ninyo & Moore to provide services. Materials testing services will be provided on an as-needed basis for projects funded through various sources, and Work Authorizations will be issued based on identified funds prior to service performance. No additional appropriation of funds will be required for the approval of this contract amendment.
Public Works Engineering staff will oversee the contract with the materials testing service, which was initially approved by the City Council in October 2021 for $250,000, and amended on April 18, 2023 in the amount of $600,000. Public Works staff is requesting a second contract amendment in the amount of $500,000 for a new total payment limit $1,350,000 and exercise the option to increase the term of the contract to September 30, 2026, per the Resolution 121-21 (See Attachment 2).
