Industry: Public Entity/Municipality
Date of Loss: February 3rd, 2022
Type of Loss: Illegal dumping & encampment abatement
Total Cost: $91,000
Contact Name & Title: Jason Quinones, Field Operations Manager Contact Info: [email protected] – (925) 723-2295 Background: Sharjo, LLC dba ServiceMaster Restoration Services has been in contract with Contra Costa County Public Works since 2019 for all emergency, water, fire, and other mitigation and restoration services. Under this contract, one of the services requested was to abate four large encampments located between multiple jurisdictions. This job involved the coordination, scheduling, a nd continual communication between multiple public agencies, private businesses, and our company. Once the residents were removed, we were brought in to abate the sites.

Loss Description: The four encampments were in locations that split jurisdiction lines between City of Richmond, City of San Pablo, Contra Costa County, BNSF Railroad and other private businesses.

Factors present that permitted these encampments to expand in size and severity were:
• Located in an area that was mostly out of sight, protected by large walls leaving the main way to view them from the active BNSF rail lines
• There was a small creek flowing down the middle that could easily be crossed by foot, so the two main encampments became more like a small community with an unhoused population of 50+ • The sites were left relatively unchecked/disturbed for multiple years, so they had the opportunity to grow large in size
• The encampments had erected wooden structures that further kept the campers out of sight.

Contained in these structures were large furniture, propane stoves, fire pits, rotten food, biohazardous waste, human waste (urine, feces, vomit and blood) and drug paraphernalia (needles and multiple different chemicals use to make their own drugs) Agencies involved: City of Richmond’s- Code Enforcement, Police Department and Fire Department City of San Pablo’s- Code Enforcement, Police and Public Works Departments, Contra Costa County’s - Public Works, Maintenance, Flood Control, Office of the Sheriff and Health Departments, BNSF Railroad’s Police and Safety Departments

Page 14 of 69 ends

Docusign Envelope ID: 3EEA7ECC-E421-4753-AFAF-0B10C8CDE0EB What made this job unique or challenging: The encampments were large in size with a flood channel splitting it down the middle, BNSF active rail lines crossing to the North and a privately -owned bridge crossing the channel to the South. Much of the trash and debris resided in or near the flood ch annel and removal required it to be sifted and removed by hand. The biowaste and drug paraphernalia within this vicinity had to be properly disposed of to ensure that no one entered the flowing waterway.

The insides of the wooden structures posed biowaste health and safety risk due to the contents and biohazards within. While disassembling and removing these structures, our technicians had to wear full face respirators anytime they were in and around these areas of the worksite. Each structure had to be inspected for any and all hazards prior to commencing abatement. Many of the chemicals found posed a significant inhalation and fire risk. Additionally, multiple propane stoves and tanks were scattered throughout the complex also needing special handling and disposal. Once areas were cleared, we began the dismantling and removal of the structures.

Describe the resources used: Twelve technicians and two supervisors, a front loader, dump truck, 40- yard roll off bins, full PPE (Tyvek suits, steel toe boots, puncture resistant gloves and full -face respirators), small tools used: rakes, shovels, needle grabbers, garbage cans and whe elbarrows.

To assist in the dismantling and removal of these encampments we utilized a heavy -duty front loader that loaded debris into 40-yard roll off bins. We coordinated with Republic Services to provide the bins to be used in tandem with the front loader. When a bin was full, Republic Services would remove the full bin and drop another empty 40-yard bin to be filled. This coordination and partnership helped remove all of the debris in a very efficient and cost-effective manner.

Describe the finished product: 36 tons of debris was removed. All drug paraphernalia and bio waste were collected and disposed of following all applicable laws and regulations. The waterways were cleaned, and nothing was left behind. The final product was a clean, sterile and safe environment.

Contact Name & Title: Bryan Ballardo – Public Works Superintendent Contact Info: [email protected] – (925) 382-5047 Background: Contracted by City of Pittsburg to remove trash/debris, biohazardous waste and drug paraphernalia in a mile long canal tunnel that ran under a housing development.

Loss Description: This tunnel had 15-20 unhoused people occupying the tunnel. Since this location was out of the immediate public eye and provided shelter from the elements it quickly grew in size. This encampment went relatively unnoticed until the trash/debris combined with large metal car parts, bike parts and engines exceeded the tunnels capacity and began to spill out on both ends. At that point, we were contracted to do the encampment abatement and biohazardous cleaning and removal.

What made this job unique or challenging: We had to first remove and clear the massive amounts of trash/debris from each end of the tunnel to safely gain access. The use of a mini excavator was needed to remove the heavy/bulky car parts at the entrance. Once the entrance was cleared of debris, we began to work our way inside to assess. We implemented confined space entry protocols, which included setting negative air pressure. Since the tunnel was too narrow to safely use any equipment inside, we manually hauled all the waste from inside the tunnel to each opening on the ends. After all the trash/debris, drug paraphernalia and biohazardous waste was safely removed from the interior, we then cleaned and sanitized the entire tunnel.

Describe the resources used: We provided eight technicians and one supervisor, mini excavator, 40- yard roll-off bins, small tools used: rakes, shovels, needle grabbers, garbage cans and wheelbarrows.

Describe the finished product: We hauled away 16 tons of waste from inside the tunnel and disposed of it following all applicable laws/regulations.

Background: Peralta Community College acquired a 25,374 SF, three story building for Berkeley City College use, located on a major intersection in downtown Berkeley. The neighborhood is heavily populated with the unhoused population and as the building had been unoccupied for some time, many sought refuges within.

Loss Description: Sharjo, LLC dba ServiceMaster Restoration Services was brought in to do the interior cleaning of the building. Although the windows and doors had been boarded up, it soon became an interior encampment. There were needles and drug paraphernalia, human and bio waste, rotten food and trash scattered throughout the structure. We were called in to provide abatement and cleaning services which included removal of all the trash, biohazard waste and graffiti, sterilization and to get the building safe for demolition and construction.

Docusign Envelope ID: 3EEA7ECC-E421-4753-AFAF-0B10C8CDE0EB What made this job unique or challenging:
• This project involved the coordination of multiple agencies and stakeholders prior, during and after the encampment abatement. The City of Berkeley Police Department conducted the initial site clearance as well as periodic on-site support. Berkeley City College Campus Security was present securing the site throughout the project. Kitchell Corporation, the general contractor doing the demolition and construction, was involved in establishing the scope of work. Peralta Community College District and Berkeley City College owned and operated the facility. Clear communication was needed to keep all parties informed of project timelines, immediate issues, and any other pertinent information.
• The building location provided additional challenges. It is located on a high traffic intersection in downtown Berkeley that is heavily populated with unhoused people. The ground floor’s windows and doors were boarded up and had to remain boarded up throughout the abatement process.

The main door was opened in the morning to let our crews in and then closed behind us. In order to exit, our crews had a radio to communicate with the campus security that was stationed outside the main door, requesting that they remove the barriers. • Although there was electricity, there were very few working overhead lights. An unoccupied building is a haven for a particular sector of the unhoused population. Not only does it protect them from the elements and provide a much more comfortable living environment, more importantly it provides an 'out of public sight' environment that quickly becomes a 'shoot house', especially if there is power. In order to avoid detection, the facility’s lights are dismantled or broken so they won’t be used and seen from outside. Without overhead lights and boarded up windows, portable lights and headlights were used to illuminate the environment. • Security protocol required both the facility and the 40-yard debris box to be secure. Trash and debris needed to be compiled in a designated area within the building and disposed of in mass.

When we were ready to dispose of the trash and debris, the Campus Security team would open up the boarded door, and the City of Berkeley Police Department would secure the area containing the debris box so it would not be accessed by the general population.

Describe the resources used: Four technicians, PPE, portable lights and headlamps, bio disposal containers, shovels, racks, debris removal equipment, 40-yard debris box How long did it take to complete the job: One day

Purpose: The Biohazardous Cleaning Protocol is designed to help employees understand the hazards and follow the safety rules associated with biohazards. This program contains the following:
• Hazard
Identification
• Establishing the Scope of Loss
The compa
ny will follow our Bloodborne Pathogen Exposure Plan and treat all blood and other potentially infectious materials (OPIM) as infectious waste and will use universal precautions while remediating trauma losses. As a result, all human blood and body fluids are treated as if they are known to be infectious for HBV, HIV and other bloodborne pathogens. In circumstances where it is difficult or impossible to differentiate between body fluid types, all bodily fluids are assumed to be potentially infectious.

Identify
ing Hazards:

Hazard Description
Bloodborne Pathogens • Bloodborne pathogens include but are not limited to Hepatitis B and C, AIDs and HIV. These are found in infected blood or bodily fluids
• This operation uses "Universal Precautions." As a result, all human blood and body fluids are treated as if they are known to be infectious for HBV, HIV and other bloodborne
pathogens
Needles or other sharp
material
• Needles or other sharp material have been commonplace for these encampments
• May be contaminated with Bloodborne Pathogens or other OPIM
Weapons • Guns
• Knives
• Any object fashioned in a manner that would cause harm to another
Hazardous Material Four Characteristics of Hazardous Waste:
• Ignitability: Flash point less than 60°C/140°F Ex - Used solvents, propane
• Corrosivity: Strong acids or bases, or that produce acid or alkaline solutions. A liquid waste may be corrosive if it is able to corrode metal containers. Ex- Acid from a lead acid battery
• Reactivity: Are unstable under normal conditions. Can cause explosions or release toxic fumes, gases, or vapors when heated, compressed or mixed with water. Ex - Lithium - Sulfur Batteries, unused explosives

Services Provided: We provide a variety of biohazardous cleaning and removal services, as well as full scale homeless encampment abatement services. The majority of the biohazardous cleanings have been human waste from homeless and have been in everything from clear buckets, so disgusted/unsuspecting containers. When the Canal Patrol Officers come across any biohazards, the
y notify us to assist with the cleaning. Most of the locations where this was discovered are along their many miles of canals. So, we worked very closely with them to allow access, open and closed gates and the Canal Officer’s provide securi ty as needed.

We also partner with them and the City of Antioch to conduct inter-agency encampment abatement services. They have multiple locations where juri sdictional lines are drawn with a chain link fence where one side is Conta Costa Water District, and the other is the City of Antioch. Services Provided: Since 2021, ServiceMaster has been providing routine 2X ’s a week cleaning
at the city’s temporary “open air shelter”. This has been a very interesting approach by a city to try and minimize the encampments throughout the city. They provide a designated safe area where the people can bring their belongings in to safely sleep/live.

They contract ServiceMaster to clean 2X’s a week the common areas, protopodites, eating area and surrounding zones on the
other side of the wooden fence where trash/debris/biohazards are discarded. We also provide emergency services for anything biohazardous and human waste is found on an as needed basis. The majority of the biohazardous waste is fecal matter and urine being discarded in the wrong area, as well as drug paraphernalia.

This is another example where ServiceMaster crews utilize their training and empathy to treat the people with respect and dignity. The crew that provides the routine cleanings knows them all and addresses them by name. Since we have started the routine cleanings, the city has seen a de crease in l arge encampments throughout the city and the number of instances where the police have to get involved diminish as well.

ServiceMaster is properly licensed, trained, and qualified to safely handle and remove any b iohazardous waste. ServiceMaster crews understand the importance of handling and disposing of biohazardous and/ or
hazardous waste following all appropriate laws and regulations. It is extremely i mportant to separate out any combustible liquid/container such as gasoline and propane tanks, m otor oil, paint, lead and asbestos materials, chemicals, and corrosive materials, etc. to ensure they are not disposed of with other nonhazardous waste. Regulatory Guidelines- ServiceMaster is well versed and aligned with the established guidelines of the following agencies:
• Centers for Diseases Control and Prevention (CDC)
• Occupational Safety and Health Administration (OSHA)
• U.S. Environmental
Protection Agency (EPA)
Sharjo, LLC
dba ServiceMaster Restoration Services
195 Mason Circle
Concord, CA 94520
Since we have our Hazardous Waste Transporter Registration Certificate, we can legally transport the biohazardous waste to a disposal facility to be disposed of following all applicable laws and regulations.

We are aware of permits required by the Army Corp of Engine ers, State of California, and/or Contra
Costa County and how to obtain them. Additionally, we are trained in how to complete the CA Uniform Hazardous Waste Manifest required in transporting hazardous waste.

Communication is KEY
When emergency crime scene and biohazardous cleaning services are needed there is no time to waste and important steps need to take place to successfully conduct these types of services. ServiceMaster
has already trained,
licensed, prepared and equipped our work force for these types of jobs well before we get the request for service from a client. Successful preparation, excellent communication and a large work force allow us to respond easily within the four-hour window for any City of Richmond's Police Department requests for service 24/7/365.

Request for Service
The City of Richmond's Police Department will be provided our 24/7/365 call center and direct cell phone and emails for all the key players. Both our call center and key players are well versed is dealing with police dispatch centers. Our team will gather
all the required information from the dispatch center
and relay instructions in real time to our team responding. It is vital for both pa rties to have all the
necessary contact information of the other party.

Responding to the Requests
All of ServiceMaster's extensive training and preparation shine through when we get these calls for
service. Our professionalism is apparent when responding to situations where we have to interact with the public, the officers,
the cornier, the city representatives, etc. Our team knows how to conduct their job in a respectful, safe and efficient manner. They are trained to direct any communication/questions/ concern to the dedicated
officer/city representative. We arrive promptly, clean and remove all physical hazards as well as biohazards while following all laws and regulations, and leave the area in a sanitized,
clean and safe for the public/officer/city. Then we transport all physical hazards as well as biohazards for immediate disposal, while following all laws and regulations.

Docusign Envelope ID: 3EEA7ECC-E421-4753-AFAF-0B10C8CDE0EB g) Quality Control Measures
Serv
iceMaster understands the importance of ensuring we will provide the City of Richmond’s Police Department with the high quality of services required to successfully conduct these types of cleaning services on a routine as well as an emergency basis. Biohazardous and crime scene cleaning services, by nature, are dangerous. We fully understand the importance of selecting a vendor that not only can do the work but will do so without issues throughout the life of the agreement. ServiceMaster will implement quality control measures that protect our own people, the public and the City of Richmond’s Police Department.

Quali
ty control measures start at the company level: ServiceMaster is an equal opportunity employer that does not discriminate on the basis of race, color, religion, gender, gender expression, age, national origin, disability, or sexual orientation. We hire a diverse workforce at all levels and take pride in our ability to train and promote from within our company.

On the m
anagement side, we go out of our way to recognize employees that truly embody this mentality and display it at work. Including, but not limited to formal recognitions/awards all the way up to promotions and bonuses. By doing everything we can from a managerial side to provide trainings and foster a safe and respectful company culture for our own employees, it also empowers our employees to bring this same mentality with them to the job sites when interacting with the public and city representatives.

If any
team member finds this type of work beyond what they can emotionally sustain, they will not be asked or required to perform such work. If team members experience any psychological issues after performing this type of work, the company will offer them professional help in understanding and dealing with their experiences.

Service
Master will never make our employees perform job tasks and/or work in situations that they are not fully comfortable and capable of working in. We fully understand that sometimes these trauma and biohazardous cleaning situations are not the right fit for some people. We will never discipline individuals that feel this way. Instead, we empower our staff to voice any/all concerns. That way, we can find the right type of work for them. This also helps us ensure that each person we put on these types of cleaning is the right fit for the job.

Quali
ty control measures on the public interactions level: When performing trauma scene cleanups, team members might meet or interact with surviving family member(s). The sudden loss of a family member is one of the most traumatic events that a person can experience.

Then, at such a disturbing and stressful moment, to have a total stranger come onto the scene to perform cleanup work before the family’s real grieving process has begun makes for a difficult situation. Our team members may need to discuss business matters with an appropriate family member before work can commence. The following are best practices to follow when interacting with grieving family members:

dba ServiceMaster Restoration Services

Concord, CA 94520

Page 45 of 69 ends

Docusign Envelope ID: 3EEA7ECC-E421-4753-AFAF-0B10C8CDE0EB • Have one person be the point of contact who handles all communication with anyone outside the working team.
• Help those affected regain a sense of control of their situation. • Explain in as much detail as needed the cleanup steps to be taken and how long the process will take. Do not be graphic when providing details of the clean-up process. • Leave the customer with contact phone numbers as well as other pertinent documentation.

The following are practices to avoid while interacting with grieving family members:
• Do not ask questions about what happened that do not pertain to getting the info necessary to assess and remediate the loss site
o Should the client wish to recount the story, use active listening skills and have empathy to the situation
• Do not engage in any inappropriate conversation
• Do not make any definitive statements concerning the event Empath
y and understanding of the situation and the emotions that are being felt is mandatory, and this requires a level of compassion and real sensitivity. The lead technician should receive training from a professional in the field of psychology who can explain what the family members are experiencing and how to work with them both to get the cleanup job completed and to be minimally intrusive into their lives during this time of distress.

It shoul
d go without saying, but everything that occurs at a trauma scene site is confidential.

Nothing should ever appear on social media in any form about what was seen, said or performed as work. Furthermore, all photographs of the scene taken before, during and after cleanup must remain strictly confidential. All photos and documentation must be on company issued devices and not on personal phones.

Quali
ty control measures at the jobsite: Post cleaning testing is conducted utilizing ATP (adenosine triphosphate) – A substance present in all living cells that provides energy for many metabolic processes. Swab testing results in a reading or RLU, Relative Light Units. This refractive measurement indicates the presence or absence of biological matter. As a post cleaning test RLU of 0 is desired.

g) Continued- Reporting Mechanisms
Work Orders & Authorizations
From
the start of a job to completion of work, ServiceMaster will provide the City of Richmond's Police Department with a dedicated administrative team. This team will be responsible for making sure all documentation, certifications, work orders, work authorizations and requests for orders are issued to the correct parties. They will be available to provide you with any documentation needed while a job is underway.

Completion of the Biohazardous Cleaning Project & Invoicing Packet:

At the end of every biohazardous cleaning project, ServiceMaster will notify the City of Richmond's Police Dep
artment of its completion and provide an invoicing packet as early as one week of job completion, but never longer than 30 days. Whichever the preferred delivery time frame of the City of Richmond's Police Department, we can easily accommodate. The invoice packets will include the projects type of debris removed, labor, materia ls and equipment used, before and after high- definition pictures, biohazard/hazmat encountered, disposal costs, summary of agencies involved, and any other information that should be related to the city. The invoice packets will be supplied as pe
r contract requirements and in the client’s preferred delivery method.

Monthly/Quarterly reports will be tracked and presented by Andy Dobbs, National Account Manager.

These
reports can be a running spreadsheet. Each report will include all the specific and i mportant information for each cleaning category. Including, but not limited to number of sites cle aned during that
month/quarter, dates, locations (squad cars, holding cells, facilities, crime scenes), type of cleanings (routine, emergency, disinfecting, crime scene, biohazardous) total amount of waste removed,
specific types of waste removed (routine trash, biohazardous waste, drug paraphernalia etc.) amount of marijuana disposed of and total costs per quarter for each category and/or anything else the City of Richmond's Police Department would like.

These
reports can be easily customized to meet any specific requirements of the and/or anything else the City of Richmond's Poli
ce Department would like.

Follow up
We understand
the importance of our clients and maintaining strong, l ong-term partnerships. To achieve this, we lis ten to what is important to them both in the overall partnership and within each project.

We clearly communicate the scope of work needed on each project, update them as work is be
ing done, let them know if there a re uncovered challenges, do everything we stated we would do, and follow up after completion to make sure they are satisfied. At the completion of every job, we have
a Certificate of Satisfaction document sent to the client. Additionally, every client is asked to complete an NPS survey and track the results so we can modify our training and processes if needed.

If
at any time a client feels we did not meet their expectations, we discuss the issues, determine a re
solution, and correct the issue.

In addition to the more detailed explanation provided in section c) p.21-29, ServiceMaster takes pride in our immaculate safety record while working on biohazardous projects. We have the training, experience, and professionali sm to protect our own employees, the public and the public entity we are contracting.

ServiceMaster Restoration Services has a full-time Safety Manager that presents safety training to each employee as part of their on-boarding and continues it throughout their employment tenure with our company. Every morning starts with a safety meeting. Additionally, every employee that is working on an abatement project is required to wear all appropriate PPE and any other equipment needed to safely perform their task.

Our standard safety programs:

ServiceMaster will make any and all training records, licenses, and certifications available to the City of Richmond's Police Department. When you partner with ServiceMaster, you partner with a vendor that takes safety seriously!

Docusign Envelope ID: 3EEA7ECC-E421-4753-AFAF-0B10C8CDE0EB a) Cleaning and Biohazard Cleaning Services
Over the years ServiceMaster has seen most of the biohazardous waste and crime scene cleanup can be properly conducted with a crew of two to three. While a skilled set of a couple technicians with one vehicle with all the needed materials, tools, PPE, etc. should be able to accommodate a large number of these requests for services, ServiceMaster wanted to include our full prevailing wage price sheet (see. p. 54-59) in addition, for your review.

Labor Rates: The below labor rates include all health, dental, vision, paid vacations, and 401K
options, overhead and profit and will be the total labor costs the City of Richmond's Police Department.

Restoration Technician= $125 an hour, per Tech or $187.50 an hour, per Tech (OT/Weekend) o The Restoration Technicians will be responsible for doing any cleaning requests of us.

Project Manager= $135 an hour, per Project Manager
o Responsible for supporting the Technicians in the field with everything needed to safely and efficiently conduct the cle anings. Would be brought in on any larger, or challenging cleaning projects.

Admin. Asst./Clerical= $47 an hour, per Admin. Asst./Clerical o An average of one hour total needed per cleaning project.

National Account Manager= $0 charge to the City of Richmond's Police Department. Andy Dobbs will serve as the main point of contact for the City of Richmond's Police Department. Even though there is not going to be a charge for his time, he will also commit to managing the contract, be available to receive new job requests, provide updates on job progress, communicate any issues, and ensure accurate billing invoice packets are sent to the client.

Andy will also be available to attend any monthly/quarterly meetings needed. At these monthly/ quarterly meetings he will present a report on all request for services from the previous term, the cost, and any other information the client would like. These reports are easily customized to meet any contract and client preferences.

Branch Manager, Regional Manager, or Chief Operating Officer= $0. the City of Richmond's Police Department will not incur a charge for any time spent on a project from these roles.

Administrative Costs: We provided the cost for any possible charge that is separate from the labor rates. Further explanation is needed because not all of these will be charged each day and will vary based on the size and severity of a specific job. If there is a large biohazardous cleaning job that would require a large labor force/more labor hours and would as well require more mate
rials, equipment and amount of disposal charge s in comparison to smaller jobs, so we hope this explanation helps add further clarification.

Gloves, Latex Disposal= $37.50 for a box of 100. The City of Richmond's Police Department w

To add a little more clarity on the vehicles, here are the most common ways they are used for this type of work: Smaller jobs that only need two technicians would only need one vehicle. As the jobs increase in size and severity, where more labor force is required so would the need for additional vehicles. We will perform best practices and use only the required vehicles for the day/specific job.

H
azardous Material Disposal= $250 for a 55-Gallon Drum.

Disposal Charge (Non-Hazardous)= Disposal cost plus 20%. The City of Richmond's Police Department would only be charged the daily disposal used for the day and our invoice packet would also include the actual dump receipt as proof of accurate charge to the client.

Equipment Considerations

1. The listed rates are to be applied to all equipment used in the performance of the work for any calendar day or portion thereof in which the equipment is used.

5. Equipment that is held at the customer’s request, but not in use, will be invoiced at the full daily rate (or weekly rate if applicable to the type of equipment being held). In the event the equipment is from a 3rd party vendor then the equipment will be charged at cost plus 20%.

7. SRM shall invoice the customer for the transportation of equipment and materials to the project, and for the return of equipment and materials back from the project at cost plus 20% for 3rd party vendors. Transportation by SRM staff will be invoiced at the scheduled rates, plus applicable mileage charges.

2. During the course of work, SRM may find it necessary to purchase equipment not scheduled under the Daily Rate. In those situations, the Daily Rate shall be an acceptable industry daily rental rate determined by SRM.

3. The rental rate and associated charges for any item of equipment rented from a third party vendor, used in the performance of the Work, whether it is on the schedule or not, shall be billed at cost plus 20%.

Note: Please note that costs reflect 2024 pricing, and these are reviewed and adjusted annually.

8. Equipment Terms: *Applicable Equipment Terms will be applied based on the following defined rule – Each Piece of Equipment must run for 7 days to qualify for weekly rate and run for 30 days to qualify for Monthly Rate. Weekly rate is 5 x Published Daily Rate and Monthly is 20 x Published Daily rates. The first seven days will not be eligible for terms.

4. If any company owned, leased or rented asset is damaged or rendered unfit for use by the actions or inactions of the customer, its agents or representatives, the customer if negligent, shall be responsible for replacing such asset at their expense.

6. SRM reserves the right to add to the equipment schedule during the course of the work.
