AGENDA
REPORT
March 25, 2025
DISCUSSION:
In 1990, the Richmond City Council adopted Ordinance No. 29-90 (Attachment 1), and in 2018, it adopted Ordinance No. 12-18 (Attachment 2), which provides certain sanctuary city protections at the local level for the immigrant community. The City further presented a new ordinance for Council consideration on March 11, 2025, which further demonstrates the City Council’s stance and commitment to Richmond maintaining the relationship of trust between the City of Richmond and all its residents, including its immigration community, and protecting the safety, well-being, and constitutional rights of Richmond residents (Attachment 3).
The City aims to reinforce its commitment to maintaining a safe and inclusive environment. Senate Bill 54, Chapter 495 Implementation Plan, is comprised of the following:
A Limited Assistance and Escalation protocol that defines access levels in City facilities, categorizing them as limited access, restricted access, and public access spaces. This protocol will identify spaces in which federal immigration enforcement has limited access and assistance.
A helpful “Red Sheet” containing FAQs and community resources to empower residents with essential information.
Comprehensive training for key staff members in the City of Richmond to ensure understanding and implementing the new protocol.
Dr. Mia Settles-Tidwell, President of Set-Up for Success, will assist City staff in creating this plan. With her extensive experience in developing effective protocols, including those currently implemented at UC Berkeley, she brings valuable expertise to the project. Collaborating closely with the City Manager's Office, City Attorney’s Office, Police Department, Public Works, and Human Resources – Risk Management, the City will establish a robust safety plan. Therefore, the City is proposing a contract amendment to revise the scope, term, and contract limit of Set-Up for Success’s current contract to enable this important and time-sensitive work (Attachment 4).
This plan's implementation is not intended to prevent the City or its personnel from complying with state or federal law. The City of Richmond will continue to follow all binding legal precedents. Establishing this Implementation Plan embodies the City’s dedication to ensuring community security and due process and creating an environment where all residents feel secure, valued, and supported, regardless of race/ethnicity, ancestry or immigration status.

SYNERGISTIC POLICIES:
Establishing a Limited Assistance and Escalation protocol will complement Richmond's decision to limit the use of local resources for federal immigration efforts, which is established in Ordinance 29-90, Ordinance 12-18, and the proposed Ordinance that had its first reading on March 11, 2025.
FISCAL IMPACT:
The fiscal impact of this amendment is $32,500 for a not to exceed contract amount of $82,500. Funding must be appropriated in the current budget and will be budgeted in subsequent budgets as required.
RECOMMENDATION:
City staff recommend the City Council approve the contract amendment with Set-Up for Success by amending the scope of work, extending the term expiration to December 31, 2025, and increasing the payment limit by $32,500, to an amended not-to-exceed amount of $82,500, and appropriating fund as required.
