In an effort to support cities, organizations, and institutions of learning in operationalizing California Senate Bill 54, chapter 495, the following consultancy is designed to make it simpler to safeguard our communities from being unlawfully targeted, deposed, seized, dehumanized, or questioned based solely on their citizenship status, perceived race/ethnicity, or origin of birth. a. Phase I- Pre-Consultation Meeting (s) and Facilities Assessment [Mar ch 2025]- In the State of California, we do not interfere with immigration enforcement, but we do “limit assistance with im
migration enforcement to the fullest extent possible consistent with federal and state law.” Essentially, we do not assist ICE in their efforts to execute their mission. Meet with key stakeholders: City Manager, City Attorney, Director of Human Resources, Chief of Police and Director of Public Works, Associate Management Analyst, and Executive Director of the Housing Authority to assist with implementation plan of Senate Bill 54, chapter 495. Conduct a facilities assessment (walk through) to identify three types of spaces: limited access, restrict access and public spaces.
b. Phase II- Update Staff Guidance on a Limited Assistance & Escalation Protocol [ March-April 2025]- It is required by Federal and State laws that any Immigration Customs Enforcement (I.C.E.) official must present the proper authorization and documentation to execute any of the work of I.C.E. in relationship to any human-be ing. According to the U.S. Constitution, this work should be executed without discrimination based on race/ethnicity, color, gender, religion, disability, origin of birth, etc. The development of an escalation protocol would include the City Attorney or designated person who can authorize the various types of subpoenas or wa
rrants prior to Immigration Customs Enforcement (I.C.E.) seizing any individual. The protocol would also include role designation for the Chief of Police, Chief of Fire, City Manager, Director of Human Resources, Executive Director of Housing, and Director of Public Works and other designated officials.
