AGENDA
REPORT

DISCUSSION:
The Boorman Park Revitalization Project (Capital Improvement Plan Project #23030) includes proposed improvements that incorporate a portion of South 27th Street, north of Maine Avenue, into the park (Attachment 1). The 98-foot segment terminates within Boorman Park and is currently used for informal residential parking.
This 2,785 square foot dead-end spur is unnecessary for present or prospective use as a public street (Attachments 2 and 3). If vacated, the west half of South 27th Street’s approximately 28-foot-wide right-of-way will be landscaped, while the east half will be developed as a maintenance access road serving the park.
The California Streets and Highways Code (§§ 8300 et seq.) and Richmond Municipal Code (§12.30.220 et seq.) authorize the City to vacate public rights-of-way. Section 8334(a) permits summary vacation of excess right-of-way not needed for street or highway purposes, while Section 8334(b) allows vacation of streets lying entirely within property under one ownership and not serving other parcels.
Existing public utility facilities are known to exist within the area to be vacated, but such utilities will be unaffected by the vacation as the City will retain the underlying fee title to the property occupied by the street to be vacated.
City staff recommends that the City Council adopt the resolution authorizing the summary vacation of a portion of South 27th Street (Attachment 4). If approved, and in accordance with California Streets and Highways Code Section 8336, the City Clerk will record a certified copy of the resolution with the Contra Costa County Recorder. The vacation will be deemed complete upon recordation.
ENVIRONMENTAL DOCUMENTATION:
The proposed vacation is categorically exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15061(b)(3) (common sense exemption) and 15301(c) (minor alterations of existing public facilities).
It can be seen with certainty that vacating this underutilized public right-of-way and incorporating it into Boorman Park will not have a significant environmental effect. The area is not environmentally sensitive, and no special circumstances exist that would result in a significant impact.
