RECOMMENDED ACTION: APPROVE a sole-source contract with ChargePoint, Inc., in an amount not to exceed $32,900, consisting of a base contract amount of $26,400 and a $6,500 contingency,
for network cloud services and warranty coverage for
City-owned electric vehicle charging stations, for the term of June 30, 2025, through November 10, 2028 - Public
Works Department (Gabino Arredondo 510-620-6606).

DISCUSSION:

Since 2013, the City has acquired ChargePoint electric vehicle (EV) charging stations through several purchase contracts made possible by a combination of grant funding received from the Bay Area Air Quality Management District (BAAQMD) and rebate funds from MCE Clean Energy. However, grant funds were not provided for continued operational expenses required after the grant terms expired.

On July 7, 2020, City Council approved entering into an agreement with ChargePoint Inc. to renew network cloud service and warranty coverage for the City-owned electric vehicle charging stations. The contract term was from July 7, 2020, to June 30, 2021, with four one-year renewal options not to exceed $34,970. The first amendment exercised renewal options and extended the agreement until June 30, 2023. The second amendment approved by City Council on June 6, 2023, increased the contract amount by $20,000 for a new total not to exceed amount of $54,970 and extended the term to June 30, 2025.

Currently, ChargePoint EV chargers are in operation with expired warranty coverage and network subscriptions. There is a need to enter into a new agreement to prevent interruption of EV charging services used by the public and City staff and to ensure continued warranty protection and network connectivity.

City staff request City Council approve a new contract with ChargePoint, Inc. for a term of June 30, 2025, through November 10, 2028, in the amount $32,900, which includes the quoted price of $26,400 plus an additional $6,500 to accommodate potential additional stations or unforeseen service needs during the contract term (Attachment 1).

Furthermore, a sole source procurement is appropriate here because ChargePoint is the manufacturer of the parts for the existing charging stations and is the only company that manages the cloud service. Richmond Municipal Code (RMC) Section 2.52.326 provides that a contract may be awarded without competition when it has been determined in writing, after conducting a good faith review of available sources, that there is only one source for the required goods or service (Attachment 2).

Approval of this agreement will ensure continuity of EV charging services for the public and City staff, maintain manufacturer warranty protections, and provide network management necessary for ongoing station functionality.
