Complete the following checklist
A specific contractor is the only source of the required item because (check all that apply):
The required items are proprietary to the Contractor, and contractor solely transacts (sells) direct to the customer. (There are no dealers or distributors for contractor).
The required items are proprietary to the Contractor, and contractor does not sell direct to the customer. Contractor solely distributes the item or service through only one dealer or distributor in the United States. (There are no dealers or distributors for contractor).
Note: If item or service is available from more than one source, the item or service may be treated as proprietary, but must be competitively solicited from multiple (two or more) sources.
A specific item is needed:

There is a substantial risk in contracting with any other contractor, (e.g., only one contractor has been successful to date in implementing a difficult manufacturing process or the services sought ). In a brief explanation, provide supporting evidence of why other contractors are considered to be unable to overcome the substantial risk.
Continuation of prior Work – Additional item, service or work required, but not known to have been needed when the original order was placed with vendor, and it is not feasible or practicable to contract separately for the additional need. Provide brief explanation and supporting evidence.

I acknowledge the City’s requirements for soliciting competitive quotes/bids for purchases over $3,000.00 and the criteria for justification for Sole Source purchases. I have gathered the required information, have made a concerted effort to review comparable/equal equipment/services (e.g., market research), and further affirm that there is no conflict of interest involved in the selection made.

PROCEDURE
Sole Source purchase/service are exceptions to the normal bidding process and require a detailed justification. In processing Sole Source requests for supplies, services and/or equipment, the Purchasing Division adheres to and is governed by the principles set forth in City of Richmond Municipal Code Section 2.52.326 Sole Source Procurement.
If you are requesting a particular vendor, brand or product, you must make this fact clear on your Sole Source form.
Your request will then be restrictive and non-competitive, and will fall into a sole source category. If the sole source justification is approved, the requisition can be expedited without the normal bidding requirements.
Such a request should not be made unless you are confident that your request is reasonable and appropriately justified to meet the City’s requirements and withstand any possible audit. The City’s requirements and the format for submitting such requests are contained herein. Sole Source form must be signed by authorized department representative(s). The certification will remain on file for audit purposes.
The following factors DO NOT apply to sole source requests and should not be included in your sole source justification. They will not be considered and only tend to confuse the evaluation process.
1. Personal preference for product or vendor.
2. Cost, vendor performance, and local service (these are generally considered award factors in competitive bidding).
3. Features which exceed the minimum department requirements.

SUBJECT: 23030 Boorman Park Site Remediation
On Call Geotechnical Services – Ninyo & Moore
On June 25, 2024, the City entered into a Task Order under the on-call agreement with Ninyo & Moore to provide technical environmental oversight during implementation of the Remedial Action Plan (RAP) and Remedial Design and Implementation Plan (RDIP) for the Boorman Park Site Remediation Project (Capital Improvement Project # 23030). These plans outline required cleanup methods, verification testing, and reporting necessary for DTSC.
The project entered active remediation construction in the Spring 2025, with Ninyo & Moore providing on-site oversight and air/soil monitoring. As the remediation continued, the level of oversight required by DTSC exceeded the original on-call contract authorization. Ninyo & Moore services include the following scope of work:
• Ongoing field oversight and dust/air monitoring
• Confirmation soil sampling and laboratory analysis of metals, VOCs, SVOCs, TPH, and dioxins/furans
• Preparation of DTSC-required reports:
i. Periodic documentation reports
ii. Remedial Action Completion Report
iii. Operations & Maintenance Plan
iv. Post-Remediation Work Plan for long-term monitoring
They were selected to continue providing these services based on the following criteria:
1. Ninyo & Moore is the geotechnical consultant already working on the project.
2. They are familiar with the history, evolution, and complex nuances the project is navigating to remove toxic soils from the site. This is a critical task that requires expert knowledge.
3. In addition, they are integrated into the entire project team and have been the main point of contact with agencies including DTSC.
4. They have experience with similar park projects in the City of Richmond.
5. Ninyo & Moore has availability to complete the work within the time required.

Subtask: Dust Monitoring
Ninyo & Moore has performed and will continue to perform air monitoring during soil disturbance activities to monitor for fugitive dust that may be generated. Air monitoring activities have been and will continue to be conducted in accordance with the Community Air Monitoring Plan (CAMP) presented as Appendix J in the RDIP . Air monitoring has consisted and will consist of placing dust monitors and air sampling cassettes upwind, downwind, and in the vicinity of soil disturbance activities to monitor dust levels and airborne levels of chemicals of potential concern (COPCs), primarily lead and arsenic. A total of approximately 35 days of air monitoring have been and will be performed and a total of approximately 136 air samples have been/will be collected. Air samples have and will be collected on
0.8 micrometer (µm) three tiered cassettes from each air monitoring station.

Samples have been and will be submitted each day on a 3-day turn-around time (TAT).
Subtask: Confirmation Soil Sampling
Ninyo & Moore has collected and will collect confirmation soil samples from excavations once they have been completed to their prescribed depths and in accordance with the RDIP .

The remaining six grids are polygonal and vary in size. One discrete bottom soil sample has been and will be collected from the excavation floor at the center of each grid. If the grid area is greater than 2,500 sf, an additional excavation floor sample has been and will be collected.
Excavation sidewall samples have been and will be collected every 25 linear feet of horizontal sidewall and every 1.5 feet of vertical sidewall. A total of approximately 27 confirmation soil samples have been and will be collected.
Confirmation soil samples have been and will be analyzed for the following:
Title 22 Metals by United States Environmental Protection Agency (EPA) Method 6010/7471;
Total petroleum hydrocarbons (TPH) as gasoline (TPHg) and volatile organic compounds (VOCs) by EPA Method 8260B;
TPH as diesel (TPHd) and motor oil (TPHmo) by EPA Method 8015M; Semi-volatile organic compounds (SVOCs) by EPA Method 8270SIM; and, Dioxins and Furans by EPA Method 8290A.
