SERVICES FOR THE BOORMAN PARK SITE REMEDIATION PROJECT
WHEREAS, the Boorman Park Site Remediation Project, located at 25th Street and Maine Avenue in Richmond, California, is being implemented under the regulatory oversight of the California Department of Toxic Substances Control (DTSC) to address soil contamination resulting from historic industrial activities; and
WHEREAS, the City of Richmond has entered into an on-call professional services agreement with Ninyo & Moore to provide environmental consulting, testing, and oversight services in support of City projects; and
WHEREAS, on June 25, 2024, the City authorized a Task Order under the on-call agreement for Ninyo & Moore to provide environmental oversight and reporting services during implementation of the DTSC-approved Remedial Action Plan (RAP) and Remedial Design and Implementation Plan (RDIP) for the Boorman Park Site Remediation Project; and WHEREAS, as remediation progressed in 2025, DTSC required additional oversight, sampling, and reporting beyond the scope and budget of the existing on-call Task Order, resulting in the need for a sole source agreement to ensure completion of required work; and WHEREAS, Ninyo & Moore has submitted a proposal, dated January 28, 2026, requesting authorization in the amount of $292,700.00 to provide continued environmental oversight, monitoring, sampling, and reporting services through project completion and regulatory closure; and
WHEREAS, Ninyo & Moore, as the engineer and environmental consultant of record, possesses specialized technical knowledge of the site, prior testing results, and DTSC coordination history, and therefore is uniquely qualified to efficiently complete the remaining scope of work; and
WHEREAS, City staff recommends approval of a sole source agreement under City procurement policy due to the technical continuity required and the consultant’s unique qualifications; and
WHEREAS, funding for this sole source agreement is available under the Boorman Park Site Remediation Project (Account No. 20136031-400708-23030), and no additional funding is required; and
