RESOLUTION NO. xx-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND
AUTHORIZING AN AMENDMENT TO THE CONSTRUCTION AGREEMENT WITH AZUL WORKS, INC. TO INCREASE THE NOT-TO-EXCEED AMOUNT BY $400,000
FOR THE SHIELDS-REID PARK AND COMMUNITY CENTER PROJECTS (PROJECT), FOR AN AMENDED TOTAL NOT-TO-EXCEED CONTRACT AMOUNT OF $5,297,064.31; AND APPROVE THE PRIOR REAPPROPRIATION OF $100,000 FROM THE GENERAL CAPITAL FUND FY2024-25 UNSPENT FUNDS, AND PRIOR THE REALLOCATION OF $206,795 IN FUNDING FROM THE HEATING,
VENTILATION, AND AIR CONDITIONING PROJECT TO THE PROJECT
WHEREAS, Shields Reid Park, a 5.17-acre park in the North Richmond neighborhood, is in need of renovation; and
WHEREAS, the City of Richmond was awarded $8,000,000 through the Statewide Park Development and Community Revitalization Program (SPP) for improvements to Shields-Reid Park; and
WHEREAS, On May 7, 2024, the City Council awarded a construction contract to Azul Works, Inc. in an amount not-to-exceed $4,088,240.31; and
WHEREAS, on June 4, 2025, the City Council approved Agreement Amendment 1 increasing the contract authority to $4,897,064.31 to address unforeseen circumstances and City- requested changes; and
WHEREAS, Amendment 1 consisted of utility revisions, rubber play surfacing in lieu of fibar, renovating existing basketball courts, public art, and expanding planting and irrigation areas; and
WHEREAS, additional Community Center related improvements have been identified that are ineligible for the remaining SPP grant funding and require supplemental City funding; and
WHEREAS, staff has previously reappropriated $100,000 from the General Capital Fund FY2024-25 Q4 unspent funds; and
WHEREAS, staff has previously reallocated $206,975 in funds from the Heating, Ventilation, and Air Conditioning Project (Project # AR233) to the Shields-Reid Community Center Project (Project # 23080) (Project); and
WHEREAS, City staff recommends amending the construction agreement by $400,000 for additional Community Center related improvements to establish a revised not-to-exceed contract amount of $5,297,064.31; and
WHEREAS, improvements consist of paint, roof repair, gutter installation, sidewalk paving, and various miscellaneous items; and
WHEREAS, by the agenda report (“Agenda Report”) accompanying this resolution the City Council has been provided with additional information supporting this action.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond that:
SECTION 1. The City Council hereby finds the above recitals are true and correct and have served, together with the Agenda Report, as the basis for this action.
SECTION 2. The City Council hereby authorizes an amendment to the construction agreement with Azul Works, Inc. to increase the not-to-exceed amount by $400,000, establishing a revised total not-to-exceed contract amount of $5,297,064.31.

SECTION 3. The City Council approves the prior reappropriation of $100,000 from the General Capital Fund FY2024-25 Q4 unspent funds to the Project.
SECTION 4. The City Council approves the prior reallocation of $206,975 from the Heating, Ventilation, and Air Conditioning Project to the Shields-Reid Community Center Project.
SECTION 4. The City Clerk is designated as the custodian of the documents comprising the record of proceedings relating to this action, which shall be maintained at Richmond City Hall, 450 Civic Center Plaza, Richmond, California 94804.
SECTION 5. This Resolution shall become effective immediately upon its passage and adoption.
