RESOLUTION NO. xx-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND TO APPROVE A CONSTRUCTION AGREEMENT WITH O.C. JONES INC. FOR THE AREA FM TEMPORARY CAP PROJECT WA #5834-06-CM
WHEREAS, the City of Richmond is committed to protecting the public health through the Area FM Temporary Cap Project (WA #5834-06-CM), which will construct a temporary asphaltic cap on the last of nine City-owned deed restricted sites in Marina Bay; and
WHEREAS, the project is supported by the California Department of Toxic Substances Control and completes important environmental cap work in Marina Bay; and
WHEREAS, the project’s scope of work includes grading, installing storm drainage and placement on an asphaltic concrete cap on this approximately 4.4 Acre site that was used in World War II for Richmond Shipyard 2 Operations and this project completes a necessary temporary environmental cap at Area FM that had been relatively unchanged until redevelopment of Marina Bay began in approximately 1980; and
WHEREAS, this project will meet agreed upon goals of a Work Plan established between the City of Richmond and the State of California Department Substance Control; and
WHEREAS, the City publicly solicited bids for the project via BidsOnline on December 9, 2025, and received twelve (12) submissions; bids were opened on January 15, 2026; and
WHEREAS, O.C.Jones Inc. was determined to be the lowest responsive and a responsible bidder following a comprehensive review of all submissions; and
WHEREAS, the contractor is responsive because its bid meets all requirements of the project and the terms and conditions of the contract, and responsible because it possesses the qualifications, experience, reputation, facilities, and financial resources necessary to perform the work; and
WHEREAS, City staff recommend establishing a construction contingency in the amount of $156,700 (20%), to be maintained at the budget level and available for change orders approved by the Director of Public Works; and
WHEREAS, City staff recommend an appropriation in the amount of $450,000 to supplement the construction bid overage, construction contingency, construction management and related costs.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond, as follows:
Section 1: The City Council hereby approves a Construction Agreement with O.C.Jones Inc. for the Area FM Temporary Cap Project (WA #5834-06-CM) in a base contract amount not to exceed $785,350.
Section 2: The City Council hereby establishes a construction contingency in the amount of $156,700 (20%) and authorizes the Director of Public Works to approve change orders, as needed, within this contingency amount, which shall remain at the budget level and is not added to the contract amount.
Section 3: The City Council hereby authorizes the allocation of $450,000.00 to supplement the construction bid overage, construction contingency, construction management and related costs.
Section 4: This resolution shall take effect immediately upon its passage.
