City of Richmond
City Council

Richmond, CA 94804
Re: Agenda Item C.3 – Donation Agreement for Leasehold Interests (Craneway Property) Dear Honorable Mayor and Members of the City Council,
My name is Rachel Hong, and along with my two sons, I am a principal of PB Development Group.

I am writing to respectfully urge the Council not to approve the proposed Donation Agreement for Leasehold Interests at this time, and instead to delay action until critical legal and contractual issues are fully reviewed.

Our company entered into an agreement on February 13, 2024 with entities controlled by Mr.

Eddie Orton, including Orton Entertainment, LLC and Orton Development, Inc., to operate a pickleball facility at the Craneway Pavilion. In reliance on that agreement, we invested significant capital, time, and resources to activate the property and bring a vibrant, community-serving use to life. On May 19, 2025, we were locked out of the facility, which we contend was in violation of our agreement and resulted in significant financial harm, as well as the loss of a successful public-facing project.

As a result of these actions, PB Development Group has filed a lawsuit against entities controlled by Mr. Orton related to our operations at Craneway, with claimed damages in excess of $10 million. This litigation involves, among other things, disputes regarding contractual rights, representations made in connection with our investment, performance obligations tied to the property, and ownership of improvements and operational assets. In addition to these claims, there remain ongoing disputes regarding access to the premises and the return of property belonging to us. Proceeding with a transfer of the leasehold interest while these matters remain unresolved may create complications regarding existing rights and interests. Before accepting any transfer, it is important that the City clearly understand what property is included, what remains in dispute, and whether third-party rights are implicated.

In addition to the potential for this transfer to conflict with these ongoing disputes, the governing Disposition and Development Agreement (“DDA”) and Ground Lease establish the Developer’s (Orton) obligations at Craneway, including maintaining and repairing the property, complying with applicable laws, and fulfilling financial commitments. These agreements also provide a clear framework for addressing non-performance, including the City’s ability to declare a default, enforce financial obligations, and reclaim the property. They do not contemplate voluntary surrender as a substitute for those remedies. In this context, the characterization of this transfer as a “donation” warrants careful consideration, as it may provide financial advantages to the Developer (Orton) while potentially relieving the Developer (Orton) of ongoing obligations and shifting those responsibilities to the City.

For these reasons, I respectfully request that the Council delay approval of this item and conduct a full review of the Developer (Orton)’s obligations, the status of the property, and the pending matters referenced above. It is important to ensure that any action taken is consistent with the governing agreements and fully informed by all relevant considerations.

Thank you for your time and consideration.

Sincerely,
Rachel Hong

To: Esteemed Members of the City Council
Residents of Richmond are getting increasingly concerned about the recently proposed 76% rate hike in 4 years by West County Wastewater District and hope to bring that to your attention.

In their flyer (attached) sent to residents in mid-April,

WCWD
cited deferred maintenance as the reason for the raise needed.

Maintenance is a given and not an unforeseen emergency, and district officials should take responsibility in properly executing their duties instead of shifting their burden to ratepayers in an abrupt rate hike of 12% every successive year.

The notice calls for
comments/protests by residents to be submitted by 6/3/2026 or legal objections by 5/23/2026.

We sincerely hope you will look
into this pressing issue that would have a serious undue financial hardship to the residents of Richmond.

Thank you for your consideration.

The Sewer Service Charge is collected from residential and commercial customers on the property tax bill. Industrial customers are billed on a monthly basis. WCW needs to adjust the Sewer Service Charge in order to generate enough revenue to pay for critical capital improvements including lift station upgrades, pipeline replacement, and address deferred maintenance.

AGING SEWER COLLECTION AND

TREATMENT SYSTEM
Much of WCW’s system is aging and in need of repair or
replacement. Many of the existing facilities were developed in the 1970s and are at or near the end of their useful life.

Many improvements and upgrades have been deferred and need to be addressed immediately. The rate adjustment would allow WCW to catch up with maintenance needed now and plan for future needs. investments required to upgrade infrastructure that is between 40-50 years old and at the end of its useful life. Planning and making critical upgrades now will reduce costs in the future.

WCW’s Capital Improvement Plan (CIP) to
maintain and improve the system includes an
expenditure of $63 million over 5 years. Capital
projects include upgrades to plant processes,
maintenance facilities, the collection system, and
lift stations. WCW is completing a large energy
savings project that will reduce WCW’s energy
expenses by approximately $2 million per year.

Clean & Green Project – The Clean & Green Project
is nearing completion and is 100% funded through

Understanding Your Wastewater Rates
WCW collects most of its rate revenue from residential and commercial customers on the property tax bill. Industrial customers are billed on a monthly basis. WCW’s method of billing follows standard industry practice for wastewater utilities.

WCW charges additional service-based fees that are not impacted by this proposal, such as sewer permits, plan approval and connection fees. For more information, go to wcwd.org/rates-fees.

You don't often get email from [email protected]. Learn why this is important This email originated from outside of the City's email system. Do not open links or attachments from untrusted sources.

My name is Rebeca Garcia-Gonzalez. I am a resident of the north and east neighborhood, and I live close to the corner of Grant Avenue and 25th St. My home sits close to Grant elementary, a favorite location for those who like Illegal Fireworks 365 days of the year. Not all those who like Fireworks near our house are from our neighborhood.

I have observed cars arrive, with the purpose of dropping off people and their fireworks. The same cars pick them up when they're done, before the police arrives. I know they are purchasing their fireworks here in California and I am aware that the influx of illegal fireworks into our state is a huge problem.

This is why I applaud and support the resolution to direct the city clerk to send a letter to the California State Governor Gavin Newsom in support of developing a task force to explore an interstate compact between California and Nevada via a shared database of recorded sales, with the purpose of stopping the illicit importation of illegal fireworks from Nevada and into California.

Thank you for your time,
Rebeca Garcia-Gonzalez

To whom it may concern,
Thank you for bringing the issue of illegal fireworks to the attention of the City Council.

Firecrackers, aerial fireworks, Roman candles, and similar fireworks are illegal in California. Buyers who purchase these fireworks in Nevada are often required to sign a waiver or permit acknowledging that the fireworks will be transported to a place where their use is legal. Purchasing and using illegal fireworks is a deliberate choice. It is a decision made without regard for neighbors, the broader community, veterans, pets, or the risk of fire and injury.

Posting signs in parks or public spaces stating that fireworks are illegal in those locations misses the larger issue. These fireworks are illegal throughout California, not just in parks. Signage in selected locations may unintentionally create the impression that using them on streets or private property is somehow allowed or tolerated by the city.

Educational campaigns alone are also unlikely to solve this problem. Research consistently shows that education by itself rarely changes behavior unless paired with visible and consistent enforcement. Richmond is already significantly understaffed, making criminal enforcement difficult to sustain.

A more practical solution would be to adopt administrative fines and increase penalties substantially. This would create accountability without relying solely on criminal prosecution. Discharging or purchasing illegal fireworks is a conscious choice, and there should be meaningful consequences for that choice.

Administrative fines can also extend to property owners, tenants, or hosts when illegal fireworks are discharged from their property, and with significant fines.

Similar liability standards already exist under Social Host ordinances and other laws, where responsibility can extend to those who allow unlawful or dangerous activity on their premises. For example, businesses that knowingly serve alcohol to minors can face legal penalties, and in some circumstances hosts or establishments may also face liability when they knowingly serve an obviously intoxicated person who later causes harm after driving. The city can adopt a similar administrative enforcement model for illegal fireworks.

Administrative citations also carry a lower burden of proof than criminal charges. Residents should be allowed to submit video evidence of fireworks being launched from or landing on a specific property. The standard would not require proving exactly who lit the fireworks, only clear evidence tying the activity to the property where it occurred.

Richmond residents deserve safe neighborhoods, quiet evenings, and enforcement policies that reflect the seriousness of this recurring problem .

I sincerely hope the City pursues more effective action than educational outreach or reliance on the expectation that Nevada will provide California with records of fireworks purchases made in that state. I encourage the City Council to adopt a practical approach grounded in its own jurisdiction and enforcement authority, rather than relying on measures that are largely superficial and unlikely to produce meaningful change
.

Thank you

Dear Mayor and Members of the Richmond City Council,
Please support agenda item O.3.c on the Council's April 22 consent calendar, a draft letter from the Richmond Mayor and City Council to Governor Newsom requesting help with the street fireworks problem. Whatever can be done to slow down the illegal importation of fireworks into California would help prevent fires, injuries, terror to pets and wildlife and trauma to people with PTSD, autism and dementia.

The unfair enforcement burden on local emergency services personnel has been overwelming.

Governor Newsom needs to develop a task force to address the illegal importation, possibly through a shared database of recorded sales available to California and Nevada law enforcement, DOT and ATF, and in collaboration with the governor of Nevada, to reduce the burden on local emergency services.

Thank you for listening to my concerns,
Janice Haugan

REGULAR MEETING OF THE RICHMOND CITY COUNCIL April 21, 2026 The City of Richmond is spending $450,000 on ROCKS
"O.7.b Purchase of K-Rails and Natural Stone Boulders from First Vanguard Rentals & Sales, Inc. and Blue Angel International, LLC 291 ADOPT a resolution to APPROVE the purchase of K-rails and natural stone boulders for City-wide encampment mitigation, right- of-way protection, and site hardening efforts from First Vanguard Rentals & Sales, Inc. and Blue Angel International LLC, each for a three-year term in an amount not to exceed $450,000, with the option to extend for two additional one-year terms in an amount not to exceed $150,000 per year, subject to city manager approval – Public Works Department (Daniel Chavarria 510-620-5478/ Darin Fitzpatrick 510- 231-3044)."
I strongly object to this item. The trend for cities to spend excessive amounts of money to stop people without a home from having a place to simply put a tent is counterproductive and cruel.

I dislike this so much that I wrote a song about it - Lost Ground

I do not think it is a good use of money to simply fill in spaces. The net result is simply for those individuals to find different spaces and the rock filled public
property simply represents cruelty.

Many many cities are doing it from Oakland to Santa Rosa. It does not work there and it does not work in Richmond. Please do not approve this money.
