This past Saturday morning a suspected pimp, trafficking underage females “to make him some money because he just got out and is running with a stolen “hot” car” crashed a stolen car and fled the scene at 26th/Gaynor. Yes… true!
The City of Richmond faces escalating legal exposure arising from persistent failures to maintain safe neighborhood conditions involving human trafficking, sexual assaults, violent crime, vehicle theft, and unsanitary unhoused encampments. City departments know of recurring criminal activity and hazardous environmental conditions. Your continued inaction is deliberate indifference, gross negligence, breach of mandatory duty, maintenance of public nuisance conditions, and failure to protect public welfare under California law. Official Richmond Police
Department Crime Statistics Reports reflect sustained violent crime and public safety risks, including approximately 139 sexual assaults, 251 robberies, 812 aggravated assaults, human trafficking incidents, and hundreds of vehicle thefts and larceny thefts in recent reporting periods. The data establish foreseeable and ongoing unsafe neighborhood conditions rather than isolated incidents which create unreadable and extreme financial and psychological hardship to Richmond residents.

I. Unsafe Neighborhood Liability Conditions:

All high-risk locations for human trafficking and repeat sexual exploitation connected to organized criminal activity and street drug sale are well documented through police reports, community complaints, and service-providers. The council and mayor fail to focus on reasonable mitigation measures, nuisance abatement, targeted enforcement, lighting improvements, surveillance, and interagency coordination. This constitute deliberate indifference toward minors, women, unhoused individuals, foster youth, and other vulnerable populations.

Sexual assault risk is exacerbated in areas where foreseeable environmental conditions persist, including poorly lit corridors, abandoned structures, isolated pedestrian routes, and encampment-adjacent zones where concealment and underreporting are predictable. Under Government Code §835
, liability arises where dangerous public property conditions present a foreseeable risk of assault, injury, or criminal harm. ->> Unhoused encampments generate chronic unsanitary conditions, public nuisance and public health obligations. Accumulated human waste, syringes, garbage, and biohazards increase exposure risks to disease, injury, and environmental contamination. The council’s failure to act after repeated notice of such conditions constitute public nuisances under Civil Code §§3479– 3480
and mandatory public health duties under state and local health regulations. Dangerous conditions like infrastructure defects, environmental neglect, inadequate lighting, obstructed visibility, abandoned parcels, unsafe intersections, illegal dumping, unmanaged encampments contribute to trafficking, assault, theft, and violent crime risk. ->> Liability exposure is heightened because the City has both actual and constructive notice through:

Police reports and crime data
Emergency calls and incident logs
Resident complaints and public testimony
Prior documented assaults or trafficking incidents
Repeated encampment health and safety violations
II. Systemic Enforcement,

Prevention Public Information Failures:

The persistence of geographically concentrated crime and unsafe conditions is a pattern-and-practice of unsafe
neighborhoods, not isolated operational failures. Foreseeability is reinforced. Harm repeatedly occurs in the same corridors without meaningful corrective intervention. The issue is not absence of legal authority, but failure to enforce existing laws. Transparency obligations under the Brown Act require meaningful public oversight of safety-related governance decisions. Minimization or fragmentation of crime trends, encampment impacts, or enforcement failures undermines lawful accountability. Council continues its irresponsible allocation of public funds toward consultants, administrative expansion, branding initiatives, or nonessential expenditures while violent crime, trafficking activity, sexual assault risk, and unsafe neighborhood conditions remain elevated, supporting claims of fiscal mismanagement and unreasonable prioritization of resources. Failures to act on preventable hazards after notice are unreasonable inaction under established negligence law:

Criminal statutes addressing trafficking, assault, and theft Public nuisance abatement authority
Health and sanitation regulations
Building safety and property maintenance codes
Traffic safety and environmental design standards
Failure to mitigate known crime hotspots
Failure to reduce sexual assault risk through environmental design (lighting, visibility, access control) Failure to abate illegal dumping and hazardous encampments Failure to coordinate enforcement across agencies
Failure to respond to repeated complaints placing the City on notice Failure to preserve or disclose critical safety and enforcement data III. Disparate Impact and Economic Harm/ Erosion of Public Trust/ Oversight Failure:

Disproportionate concentration of unsafe conditions in neighborhoods raise concerns regarding unequal municipal protection and inconsistent delivery of baseline safety services. Unsafe neighborhood conditions create measurable economic and environmental harm and increase health challenges. Increased insurance costs, declining property values, business displacement and reduced investment returns are negative effects. These conditions may warrant review by the California Department of Justice, the Contra Costa County Civil Grand Jury, and the California State Auditor, particularly where systemic enforcement failures intersect with documented public safety and public health hazards.
->> Courts reject reliance on generalized immunity where evidence demonstrates that a municipality repeatedly ignores foreseeable and preventable dangers after actual notice risks violating duties of care under
Government Code §§815.2 and 835
, public nuisance law under
Civil Code §§
3479–3480, constitutional equal protection and due process principles, and the public trust owed to residents.

Safe neighborhoods are not discretionary policy outcomes—they are a legally enforceable obligation grounded in foreseeability, prevention, and municipal accountability.

Longstanding notice of hazards
Repeated complaints and documented incidents
Identifiable dangerous conditions
Recurring criminal activity patterns
Failure to implement reasonable corrective measures
These impose enforceable duties to mitigate unsafe neighborhood conditions once notice is established:

1. California Government Code:
§815.2 : Liability for acts or omissions of employees within the scope of employmen §815.6 : Liability for failure to discharge mandatory duties imposed by statute or regulation §835 : Dangerous condition of public property creating foreseeable risk of injury §820.2 (limited immunity doctrine) : Discretionary immunity does not protect failure to address known hazards after notice where operational duties are implicated

2. CA Civil Code: §
3479–3480:

Public nuisance liability for conditions injurious to health, safety, or obstructing free use of property

3. CA Penal Code:

Human trafficking offenses (Penal Code §§236.1 et seq. Sexual assault and related violent felony provisions. These heighten municipal duty of known patterns and foreseeable risk environments.

4. CA Constitution:

Equal protection principles (disparate neighborhood safety conditions). Substantive due process (foreseeable preventable harm from known dangers)

5. Municipal Code:

Public nuisance abatement. Property maintenance and substandard housing conditions. Health and sanitation standards. Zoning and land-use enforcement. Abandoned property and hazardous conditions. Encampment-related health and safety regulation

5. As usual: Ralph M. Brown Act: transparency in public safety decision-making; failure to adequately disclose or meaningfully deliberate on crime trends, encampment conditions, or enforcement deficiencies undermines lawful public safety.

Claudia Citroen

Hello, my name is Lauren and I am member of the Richmond Tool Library and the Mobile Tool Library. My rental
home doesn’t include a gardener and with the resources available through the Tool Library my family is able to properly take care of our current landscaping needs. As a renter it doesn’t make sense to purchase these machines bc of storage allowances and the changing nature of our landscape/yard each time we move.

The Richmond Tool Library has been open for 10 years and is currently struggling to meet the rising demands of the community due to limited funding, space, and staff. In 2025, the Tool Library programs conducted a public needs assessment survey and found that most respondents were in favor of expansion.

The Tool Library operates out of a tiny 500 square foot room and needs more funding and a larger, dedicated facility to help support the growth and sustainability of both Tool Library programs. The Mobile Tool Library is in urgent need of a safe, reliable vehicle and a long-term solution to store supplies and a large trailer.

The Richmond Tool Library has been an indispensable resource for Richmond residents, non-profits, and city initiatives like Love Your Block and I Heart Richmond. It is in our best interest to improve this vital community resource by providing more funding and a dedicated facility for sustainable long- term expansion.

Thank you,
Lauren Boyd

N.5.a council consent calendar 05.19.26
The proposed grant award from the Chevron Community Engagement Foundation to the Office of Neighborhood Safety for Enhanced Street Outreach and Mobile Crisis Response must demonstrate measurable public safety outcomes tied to Richmond’s rising crime trends, particularly the reported 28% increase in vehicle thefts and 41% increase in sexual assaults.

The funding should be conditioned upon clear performance metrics, transparency requirements, and documented reductions in violent and quality-of-life crimes. While outreach and crisis intervention programs can provide supportive services, taxpayers and residents deserve evidence-based accountability showing that grant expenditures directly improve neighborhood safety conditions rather than expanding administrative overhead without measurable results.

Key concerns include:

How mobile crisis teams will specifically deter organized vehicle theft activity.

Whether ONS outreach personnel are trained to address sexual exploitation, trafficking indicators, and victim intervention.

What coordination protocols exist between ONS, the Richmond Police Department, victim advocacy organizations, and emergency responders.

Whether grant deliverables include reductions in repeat offender activity, encampment-related crime, and public nuisance conditions.

How success metrics will be independently audited and publicly reported.

Given the substantial increases in vehicle theft and sexual assault, residents require targeted enforcement, rapid emergency response capability, trauma-informed victim services, and proactive intervention strategies — not merely expanded outreach operations lacking enforceable accountability standards.

Any approval of Chevron grant funding shall require:

1. Quarterly public reporting of measurable crime reduction outcomes.

2. Independent financial auditing of all grant expenditures.

3. Mandatory coordination with law enforcement and victim service agencies.

4. Geographic targeting of high-crime corridors and repeat-offense areas.

5. Public disclosure of staffing levels, response times, and intervention outcomes.

6. Demonstrated reductions in vehicle theft, trafficking-related activity, and sexual violence incidents within impacted neighborhoods.

7. Mandatory semi-annual in-person presentations by ONS before the Richmond City Council documenting verifiable performance data, measurable outcomes, expenditure accountability, and program effectiveness. Currently, substantial achievement data and independently verifiable outcome metrics appear largely nonexistent or unavailable to the public despite ongoing funding allocations. Public presentations should include statistical evidence, case outcome reporting, response metrics, neighborhood impact analysis, and documented reductions in crime trends directly attributable to ONS operations.

Without objective benchmarks, transparent oversight, and mandatory public accountability hearings, the program risks becoming another publicly subsidized initiative that fails to address escalating public safety concerns affecting Richmond residents.

Statement in Support of the Richmond Wildfire Preparedness Ad Hoc Committee Recommendations
Mayor and Members of the Richmond City Council,
We strongly support the recommendations put forward by the Richmond Wildfire Preparedness Ad Hoc Committee to improve wildfire prevention, preparedness, and community safety throughout our city.
• The proposed $2,500 home hardening grants to assist
homeowners in making critical safety improvements such as ember- resistant vents, fire-resistant materials, vegetation management, and other protective measures. Many residents want to better protect their homes but need financial assistance to do so. These grants would provide meaningful support while strengthening neighborhood- wide resilience.
• Funding for goat grazing on hillside lots and high-risk vegetation areas as an environmentally responsible and effective wildfire mitigation strategy. Managed grazing reduces dangerous fuel loads, helps control invasive weeds, and complements traditional vegetation management practices.
*Adoption of Board of Forestry Zone Zero requirements with vegetation-free strip within 1 foot of structures and allow healthy trees to remain.

Well- maintained vegetation provides significant
environmental and fire-safety benefits and should not be categorically classified as unmanaged, dried weeds that become highly flammable fuel sources.

• Adoption and enforcement of a strong weed abatement ordinance to ensure that overgrown lots and hazardous vegetation are properly maintained before they become wildfire threats to nearby homes and neighborhoods.

These recommendations represent smart public safety investments that can help prevent devastating losses, reduce emergency response costs, and protect vulnerable communities.

We respectfully urge the Richmond City Council to support and approve these proposed measures and move swiftly toward implementation. Proactive wildfire management today will help safeguard Richmond’s future tomorrow.

Thank you for your leadership and commitment to community safety.

I am Garry Hurlbut, President of the Richmond Tennis Association and Vice President of the Hurlbut Benevolent Foundation:

I want to advocate for increased funding of the Community Services Department.

The CSD provides vital and direct services to our Richmond residents and youth.

These services provide activities that promote

the healthy and active lifestyles of all
our population. These activities are most important to our youth in ways that help offset some of today's social media and distracting influences. During the school year, CSD oversees

many of the after school activities

like the youth tennis program
at Nicholl Park which includes mentoring and homework assistance along

with
arts/crafts, physical activities and leadership skills at Achieve and Elevate After- School Programs at CSD Community Centers.

Adult programs include Zumba classes, fitness programs, aquatic program support and Senior Nutrition, social interaction and recreational activities.

All these programs provide direct benefit to the wide diversity population that we have here in Richmond and deserve the all financial support

that the city can
provide

As a new property owner in Richmond, the library has been a huge support for me in my home improvement projects so I don’t have to spend money on tools and save for the big projects like the foundation. Along with being a library, it is a community center where Micah and Steven, only two afternoons a week, provide support and a welcoming environment for all.

It

Hello, my name is Luis Rosario Rodriguez, and I have been a member of both the Richmond Tool Library and the Mobile Tool Library since 2024. The Richmond Tool Library has been operating since 2016 and has been an indispensable resource for Richmond residents, local non-profits, and city initiatives like Love Your Block and I Heart Richmond.

As a newer homeowner myself, I cannot emphasize enough how valuable this resource has been to me and to our community. I have used the program at various times while working on projects around my home, and it has been incredibly helpful to have access to tools and support right here in the community. It is such a unique and meaningful service that many other communities simply do not have. Whenever I mention the Tool Library to friends or colleagues, people are genuinely excited and impressed that Richmond offers something like this.

I am always happy to see Micah and the other team members when I visit. They consistently do a great job creating a welcoming environment, helping residents access the tools they need, and supporting people through projects they may not otherwise have been able to complete.

Their dedication truly makes a difference.

Although the Tool Library already does amazing things for the community, it is clear that the program needs a larger space in order to continue growing and meeting the increasing demand from residents. The Richmond Tool Library currently operates out of a very small 500-square- foot room and needs a larger, dedicated facility that can better support the growth and sustainability of both Tool Library programs. The Mobile Tool Library is also in urgent need of a safe, dedicated vehicle and a long-term solution to store supplies and a large trailer.

Due to limited space and staffing, both tool libraries are struggling to meet the growing demands of the community. In Spring 2025, the Tool Library programs conducted a public needs assessment survey and found that most respondents supported expansion of the programs.

Good morning,
This comment is written in support of the expansion of the Richmond Tool Library. The tool library is an invaluable resource in this community. I am a patron of the

tool library and visit
often; staff are helpful and friendly, and the space is well organized. Having this resource saves my family thousands

of dollars every year and allows us to beautify our home, complete projects, and help friends and neighbors with their homes. I have had countless conversations with other Richmond residents who love the tool library and would be thrilled to see its resources expanded further. Whenever

I visit, there is a steady stream of visitors getting
advice, checking out items, and becoming empowered to DIY. I am also engaged in community work, and we often use the tool library as a way to connect more folks to engage with Richmond through publicity and word of mouth.

I am asking that the City Council fully fund the expansion of the Richmond Tool Library's

services. Thank you.

RE: Public Comment for Agenda Item - Q.1 Opposition to Proposed CO2 Waste Dumping Projects & CO2 Pipelines in Richmond, Contra Costa, and Solano Counties.

Dear Mayor Martinez and Distinguished City Council Members,

Thank you for the opportunity to submit public comment on agenda item Q.1. Baykeeper is a California non-profit organization and submits these comments on behalf of its approximately 5,000 members and supporters who live and/or recreate in and around the San Francisco Bay Area. Baykeeper’s mission is to defend San Francisco Bay from the biggest threats and hold polluters and government agencies accountable to create healthier communities and help wildlife thrive.

Baykeeper urges this Council to pass the first resolution in the Bay Area to oppose harmful CO2 waste dumping projects and their pipeline infrastructure throughout Contra Costa and Solano Counties. You have heard the reasons why this project can bring harm to Richmond communities and wildlife and this is your opportunity to help protect the health and safety of your community.

Please don’t be greenwashed into thinking this project is helping our climate crisis. Be a real champion for your community and support climate solutions that have been proven to reduce carbon emissions, are safe for people and the environment, and will bring us closer to carbon neutrality. Please vote yes to pass the resolution before you.

Sincerely,

Dear Richmond City Council,
The proposed Montezuma Carbon Hub project has a CO2 pipeline network that would transport compressed carbon dioxide through Bay Area communities, including Richmond.

Richmond residents already live with the cumulative impacts of refinery pollution, diesel emissions, and elevated asthma and respiratory illness rates. Adding a high-pressure carbon dioxide pipeline would impose additional environmental and public health risks on a community that has already carried more than its fair share of industrial burdens.

The project is being presented as a climate solution, but the economics and public policy implications tell a different story. Although Richmond City Council would not have upfront costs, the city and its residents would still bear substantial hidden costs. Pipeline construction degrades land, disrupts neighborhoods, and creates significant dust, truck traffic, vibration, and noise pollution for nearby residents and businesses. These impacts fall especially heavily on lower-income, vulnerable communities that are already disproportionately exposed to pollution. The project would transport compressed CO2 from Chevron and other nearby refineries, with the goal of extending the lifespan of those polluting industries rather than accelerating a transition away from fossil fuels.

California taxpayers already subsidize carbon capture and sequestration projects through federal tax credits, state incentives, and infrastructure support. In practice, the public is being asked to help finance infrastructure that primarily benefits fossil fuel companies by allowing them to continue operating refineries and other carbon-intensive facilities longer than they otherwise could. Carbon capture and storage with pipelines to deliver CO2 for sequestration is an expensive technology that has repeatedly over-promised and under- delivered. Instead of investing billions in risky pipeline systems and underground injection wells, those public funds could be directed toward proven renewable energy investments, energy efficiency, public transit, and community resilience projects that create safer and more sustainable jobs.

The public health risks from CO2 pipelines are especially troubling. Unlike ordinary natural gas [methane], when CO2 leaks occur, the gas forms a dense cloud that stays low to the ground and displaces oxygen. Exposure can cause asphyxiation, seizures, loss of consciousness, and potentially death. A rupture or leak near residential neighborhoods, schools, or transportation corridors in Richmond or surrounding communities could quickly become a major public safety emergency. In 2020, a CO2 pipeline ruptured in Satartia, Mississippi, sending 49 people to the hospital and disabling emergency vehicles because the oxygen displacement prevented fuel combustion. Some victims reportedly continued experiencing symptoms months later.

When accidents happen, local governments bear the substantial costs of emergency response and cleanup responsibilities. Richmond taxpayers could ultimately shoulder significant financial burdens associated with pipeline incidents, while the private companies behind the project retain the profits.

Richmond should not be asked to sacrifice public health, environmental safety, and long-term economic well-being for a project that primarily serves the interests of the fossil fuel industry.

Real climate leadership means investing in renewable energy, electrification, energy efficiency, and community-centered economic transition strategies, and not approving risky infrastructure that prolongs dependence on fossil fuels.

For these reasons, the Richmond City Council should oppose the Montezuma Carbon Hub project and its associated CO2 pipeline infrastructure. The risks to public health, community safety, local ecosystems, and taxpayers far outweigh the uncertain benefits.

Thank you for your attention to this important public health and environmental issue, and for all you do for Richmond,

Hello Mayor and Council Members,
Thank you for the opportunity to speak on this matter.

I urge you to vote for the resolution to OPPOSE
THE PROPOSED CO2 WASTE
DUMPING PROJECTS & CO2 PIPELINES IN RICHMOND, CONTRA COSTA, AND SOLANO COUNTIES.

The reasons for this are manifold.

CO2 capture and sequestration is a false solution to the climate crisis.

It is a waste of taxpayers money because it doesn't mitigate the effects of the climate crisis to the levels promised.

It is also potentially very dangerous to the public and to the environment as was experienced in Sataria, Mississippi and Lake Nyos, Cameroon.

And finally, given, as the current CO2 sequestration projects have proved, it is a technology that does not work.

Your vote will be heard throughout the county, state, and country.

Your vote will empower other communities.

And just to let you know the Illinois General Assembly passed legislation (Senate Bill 1723) to explicityly prohibit underground injections and long-term story of carbon dioxide in geologic formations beneath the Mahomet Aquifer and Governor JB Pritzker signed it into law on August 1, 2025.

Thank you, Take Care, Lou Flores

I am a Richmond resident and I support this resolution in opposition to CO2 waste dumping projects.

In particular,
the proposed CO2 pipeline is a potential threat to our residents’ health and safety.

We have seen what happens to
people and animals when a CO2 pipeline bursts, and we should say “Not in Richmond”!

With so many programs
and protections that benefit working and middle class families being demolished, we have to do locally whatever we can to make sure that our families and neighborhoods are protected.

I total agree with Sheila Tarbet's comments regarding the CO2 sequestration Hub project and am deeply concerned about the issues she brought up in her letter to you... I copy that response below:

I am writing in opposition to the project to be discussed under agenda item #Q1. The proposed Montezuma Carbon Sequestration Hub is a seriously flawed plan. Transporting dangerously compressed

CO2 from facilities across the Bay Area by barge and pipeline

opens
up our Bay Area communities, including the City of Richmond, to catastrophic risks of CO2 leaks. Such leaks can lead (and have led, in other communities) to asphyxiation, loss of consciousness, seizures, even death. We know from state EnviroScreen data that Richmond and other communities along the Carquinez Strait are already subjected to high levels of pollution and other environmental threats. The proposed injection well and pipelines are to be built near the Montezuma Wetlands restoration project. These wetlands are very important to the Bay Area and California ecosystems. And what will be gained by this project,

in return for
all this risk to

human health and

our natural resources? Likely not much. Carbon Capture and Sequestration technologies have not proven to be viable solutions to our carbon pollution crisis. They are expensive, inefficient, and

do not deliver on their promises to reduce carbon
pollution. We need to focus on implementing the proven technologies available to us. Please oppose this project.

Dear Honorable Mayor and Members of the Richmond City Council,

On behalf of the Contra Costa Community College District, a member of the Richmond Promise Board since inception, and a community member, I write to express my deep gratitude for your steadfast support of Richmond Promise which has been a vital initiative since its inception by transforming the lives of Richmond residents to and through higher education pathways.

Your early vision and continued commitment have made it possible for Richmond Promise to become a nationally recognized model for college access and success. Since its launch in 2016, the program has supported more than 4,200 Richmond students in pursuing higher education and has provided approximately $11 million in scholarships to help make college attainable.

Each year, Richmond Promise serves roughly 1,300 scholars, offering not only financial assistance but also critical wraparound supports—including college advising, mentorship, and career readiness programming—that significantly strengthen persistence and completion outcomes.

The impact is visible across our region: hundreds of high school graduates throughout the city of Richmond each year are enrolling in colleges and universities with the confidence that their community believes in their potential. As you well know, the vast majority of the students are first-generation college students, future workforce leaders, and community builders who will contribute to Richmond’s long-term economic vitality. I have had the opportunity to interact with many of our brilliant scholars as they have taken on student leadership roles at Contra Costa College as well as Diablo Valley and Los Medanos.

As Richmond Promise transitions beyond its initial funding phase, continued municipal partnership is essential to sustain and expand this proven investment in our youth. Stable, ongoing support will ensure that future generations of Richmond students have the same opportunity to pursue higher education and achieve their goals.

Thank you again for your leadership and for your unwavering commitment to Richmond’s students and families. I respectfully urge your continued financial support of the Richmond Promise so that this transformative work may endure for years to come.

With appreciation,

Mojdeh Mehdizadeh
