RESOLUTION NO. XX-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND,
CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT
POWERS AGREEMENT FOR PARTICIPATION IN THE CONTRA COSTA COUNTY
REGIONAL ALTERNATIVE COMPLIANCE (RAC) SYSTEM
WHEREAS, the City of Richmond is subject to stormwater regulatory requirements under the Municipal Regional Stormwater Permit (MRP), including Provision C.3 requiring implementation of low impact development and green stormwater infrastructure; and
WHEREAS, certain development and municipal projects may face constraints that limit the feasibility of on-site stormwater treatment; and
WHEREAS, the Contra Costa County Regional Alternative Compliance (RAC) System provides an alternative compliance pathway through the use of off-site green stormwater infrastructure projects that generate compliance units; and
WHEREAS, the RAC System has been developed in coordination with participating jurisdictions, the U.S. Environmental Protection Agency, and the Regional Water Quality Control Board; and
WHEREAS, participation in the RAC System does not obligate the City to utilize the program for any specific project; and
WHEREAS, the Joint Powers Agreement establishes the governance structure necessary to administer the RAC System; and
WHEREAS, initial participation is expected to have limited fiscal impact, with long- term program funding supported through compliance transactions and associated fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond as follows:
SECTION 1. The City Council finds that the foregoing recitals are true and correct and incorporates them herein by reference.
