A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND
APPROVING CONSTRUCTION AGREEMENT AMENDMENTS WITH BAUMAN LANDSCAPE & CONSTRUCTION, INC. AND CALICO CALIFORNIA
CONSTRUCTORES, INC. FOR THE SOCCER FIELDS-RESTROOMS-PARKS
PROJECT, ACCEPTING THE SHIELDS-REID PARK FIELD AS COMPLETE, AND
AUTHORIZING PROJECT CLOSE-OUT ACTIONS
WHEREAS, as part of the Fiscal Year 2021-22 budget process, the City Council approved the allocation of American Rescue Plan Act (ARPA) funding for park improvements and recreational facilities; and
WHEREAS, on July 11, 2023, the City Council directed City staff to evaluate soccer field and related park improvement opportunities throughout the City; and
WHEREAS, on April 16, 2024, the City Council approved an appropriation of approximately $3.5 million in remaining ARPA funding for the Soccer Fields-Restrooms-Parks Project (Capital Improvement Project No. 23046); and
WHEREAS, on April 22, 2025, the City Council approved a construction agreement with Calico California Constructores, Inc. for improvements at the Shields-Reid Park Field, including demolition and site preparation for an artificial turf youth soccer field, fencing, sports furnishings, and related park improvements; and
WHEREAS, on May 20, 2025, the City Council approved a construction agreement with Bauman Landscape & Construction, Inc. for improvements at Wendell Park, including a multi- use turf field, restroom, play area, fencing, picnic improvements, and related amenities; and
WHEREAS, during construction, additional project scope and related construction requirements were identified at both Wendell Park and the Shields-Reid Park Field; and
WHEREAS, the proposed amendment with Bauman Landscape & Construction, Inc. will increase the agreement amount by $450,000, increasing the agreement amount from $1,685,580.98 to $2,135,580.98; and
WHEREAS, the proposed amendment with Calico California Constructores, Inc. will increase the agreement amount by $300,000, increasing the agreement amount from $2,325,479.61 to $2,625,479.61; and
WHEREAS, the revised agreement amounts include 10 percent change order authority for revised not-to-exceed totals of $2,349,139.08 for Bauman Landscape & Construction, Inc.; and
WHEREAS, the revised agreement amounts include 10 percent change order authority for revised not-to-exceed totals of $2,888,027.57 for Calico California Constructores, Inc.; and
WHEREAS, construction of the Shields-Reid Park Field has been completed in accordance with the approved plans, specifications, contract documents, and applicable City of Richmond standards; and
WHEREAS, following finalization of the PG&E-related change order and provided there are no outstanding liens or stop notices, staff recommends acceptance of the Shields-Reid Park Field improvements as complete and authorization of the associated project close-out actions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Richmond adopts the following:
Section 1. The City Council finds and determines that the facts, findings, and statements contained in the Agenda Report associated with this Resolution are true and correct and are hereby incorporated herein by reference as though fully set forth.
Section 2. Approves Amendment 1 to the construction agreement with Bauman Landscape & Construction, Inc. in the amount of $450,000, for a revised total agreement amount of $2,135,580.98.
Section 3. Approves Amendment 1 to the construction agreement with Calico California Constructores, Inc. in the amount of $300,000, for a revised total agreement amount of $2,625,479.61.
Section 4. Authorizes the Director of Public Works to approve change orders up to 10 percent of the revised agreement amounts for revised not-to-exceed totals of $2,349,139.08 for Bauman Landscape & Construction, Inc. and $2,888,027.57 for Calico California Constructores, Inc., provided the total project cost remains within the approved project budget.
Section 5. Accepts the Shields-Reid Park Field improvements, completed by Calico California Constructores, Inc., as complete in accordance with the approved plans, specifications, contract documents, and applicable City standards.
Section 6. Authorizes the City Clerk to file the Notice of Completion for the Shields- Reid Park Field improvements with the Contra Costa County Recorder’s Office provided there are no outstanding liens or stop notices.
Section 7. Authorizes the City Engineer to release the contractor bonds and retention payment in accordance with applicable laws, regulations, and contract provisions, provided there are no outstanding liens or stop notices.
Section 8. The City Clerk is designated as the custodian of records for all documents and materials related to this Resolution and the Project file, which shall be maintained at the Office of the City Clerk, 450 Civic Center Plaza, Richmond, California 94804.
Section 9. This Resolution shall become effective immediately upon its passage. *****************************
