Fact check of council member’s misrepresentation and disinformation negative impact on public safety:
Council
Jimenez latest proposals are another misguided attempt to steer public tax dollars away from essential infrastructure services into “image lifting” Public relation stunts!
Her Reimagining Public Safety initiative reallocated approximately $3 million from the 2021 police budget, eliminated 12 vacant police positions, supported expansion of non- police public-safety programs which to date are barely functioning. The 2025 Contra Costa County Civil Grand Jury, contend that the RPA council actions contributed to long-term police understaffing.
The police department remains below authorized staffing level. Residents lost bike patrol, code enforcement unit, investigators, parking enforcement and beat officers.
The 2021 reallocation was a contributing factor examined by the Grand Jury who recommended actions to strengthen police staffing she voted against.
Voted against establishing fireworks ordinance and fines Voted against traffic improvements reducing fatal accidents Voted against civilian use of ALR technology used by firefighter in emergency and rescue operations
Voted for retaining Cranway Pavilion and adding substantial financial burdens Voted against “Save Walking Zone”
Jimenez and RPA continue to insist and defend it: "This decision didn't decrease the amount of RPD positions in the police department, the eliminated positions were vacant for years because of recruitment and retention challenges and that the budget action did not remove active officers from service.”
Facts Jimenez omit:
1. frequency RPD forced overtime through all ranks in order to avoid mandatory 66.6 % staffing gaps.
2. residents requesting officers to report and investigate crimes like stolen vehicles forced to wait for hours.
3. !!!! Community Crisis Response Program (now ROCK), YouthWORKS, Office of Neighborhood Safety, SOS Richmond, funded in part through the 2021 reallocation, do not possess the statutory authority granted to sworn peace officers and do not perform core law- enforcement functions such as arrests, criminal investigations, warrant service, traffic enforcement, or emergency response to violent crimes in progress.!!!!
AGAIN: None of these civilian non profit organizations are under city government jurisdiction and most importantly do not possess the statutory authority granted to sworn peace officers and do not perform core law-enforcement functions such as arrests, criminal investigations, warrant service, traffic enforcement, or emergency response to violent crimes in progress. As a result, incidents involving weapons offenses, shootings, domestic violence crimes, human trafficking investigations, organized vehicle theft, drug trafficking, robberies, sexual assaults, and other felony investigations continue to require sworn law-enforcement response.
Additionally previous filed grievances about council Jimenez Brown Act violations and governance violations
were never addressed by council members or Jimenez.
1. PROCEDURAL AND CONDUCT VIOLATIONS BY CPRC MARTINEZ, CANTÙ, AND LAWSON were not censured by council liaison Jimenez:
CPRC leadership repeatedly violates required meeting procedures. Disrespectful and inappropriate interruptions during a presentation were extremely unprofessional toward RPD
Representative Tim Simmons and
in violation of
Gov. Code §54954.3(c).
Additionally
selective enforcement of rules to silence certain commissioners, and disregard for parliamentary procedure mandated by the CPRC Handbook are common occurrence.
Brown Act requirement violations for fair, unbiased public meetings.
2. OBSTRUCTION OF PUBLIC COMMENT RIGHTS
were not censured by council
liaison Jimenez:
Public commenters arr cut off, interrupted, or subjected to selective time limits not applied to others. This violates the viewpoint-neutrality requirement of Gov. Code §54954.3(a)
. Any
action taken during meetings where public comment was unlawfully restricted is subject to nullification.
3. FAILURE TO PROVIDE PUBLIC ACCESS TO DOCUMENTS
were not censured
by council liaison Jimenez:
Documents distributed to commissioners were not made simultaneously available to the public as required by
Gov. Code §54957.5. This denies the public the right to review materials considered during meetings and constitutes a direct Brown Act violation.
4. SERIAL MEETINGS AND PRE-MEETING DECISION-MAKING
were not
censured by council liaison Jimenez:
There is evidence of improper coordination between CPRC member Lawson, council Wilson, and select commissioners outside public meetings, especially in conjunction with Reimagine Richmond and RPA steering committees. Any private communication used to control agendas or predetermine outcomes violates
Gov. Code §54952.2(a)
, which prohibits serial meetings
and consensus-building outside publicly noticed sessions.
5. Jimenez requested 1.5. Million emergency allocation to Richmond cannabis industry! In 02.03.26 council consent agenda item N.2.a. This item was never discussed or mentioned prior! Residents encountered strong opposition while attempting to pull this item into new business with arguments like “smoke shops are not the same as cannabis businesses.” Jimenez omitted the fact that the majority were not licensed and therefore not even paying Measure U sales tax.
Jimenez is a main driving force behind dissolving the RPD code enforcement unit and obstructing establishing a civil unit until 2026 under the new RPD chief. The council, including Jimenez, allowing continued operation of unlicensed retailers violated Richmond Municipal Code Chapter 7.106 (3) and California state tobacco licensing requirements under the Cigarette and Tobacco Products Licensing Act (Business & Professions Code §§ 22970– 22980.5) (4), exposing the City to state-law liability. These operations constituted a public nuisance and failed to trigger mandatory abatement enforcement. The council, including Jimenez, issued exemptions and allowed ongoing violations without required findings linking the action to public safety or moratorium objectives, thus voiding police policy decision.
Deliberately delaying to establish permit requirements and allow ongoing illegal operations for multiple years constitute a violation under the California Environmental Quality Act (Pub.
Resources Code §§ 21000 et seq.) (7) if interpreted as enabling continued use rather than a neutral pause. City staff appear to be barred from presenting findings, and votes occurred with no meaningful public discussion, creating procedural defects and potential Brown Act (Gov.
Code §§ 54950 et seq.) (8) exposure. The waiver of long-outstanding license fees without authority or findings amounted to an unlawful gift of public funds under Cal. Const., art. XVI, § 6 (9). Taken together, these failures reflect a systemic, knowing, and multi-layered violation of law, procedure, fiduciary duty, and public safety obligations.
The list goes on, residents unsuccessfully demanded changes:
1. Jimenez council meeting conduct after the vote to establish the ALPR or Flock camera program.
2. Jimenez use of private FB page for city council purposes which prohibits her from blocking constituents access.
3. Jimenez failure to focus on securing finances for essential service improvement at fire department, public work aging infrastructure projects delayed for years.
3. Jimenez abuse of power
and intimidation of staff
as council member in order to
prioritize her nonessential projects.
4. Jimenez intentional refusal to join pledge of allegiance at council meetings.

Mayor Martinez and City Council Members, City staff have introduced a new proposal for covering shortfalls in four priority capital projects as described in the attached pages.
Of the four projects, the Point Molate Bay Trail project should have the highest priority since it is under construction and will open 2.5 miles of San Francisco Bay Shoreline for public enjoyment where there is no access at all other than at Point Molate Beach Park.
Last week you received about 50 emails from residents citywide, Pogo Parks, Citizens for Eastshore Parks, Save The Bay, TRAC and others supporting full funding of the Point Molate Trail.
Its completion will expand opportunities for walking, biking, wildlife viewing, environmental education, and outdoor recreation for residents and visitors alike. By opening access to a previously inaccessible stretch of coastline, the trail will promote the Richmond City Council Strategic Goal Areas 3 and 6 – improving quality of life and community health, and addressing shoreline and ecological issues.
Although not receiving such strong public enthusiasm and widespread support, the Shields-Reid and Wendell Park projects also are under construction, but face the prospect of change orders that would create funding shortfalls.
Richmond Wellness Trail Phase 2 is aligned with TRAC’s SF Bay Trail mission, because it would provide a mile-long protected bikeway on Marina Way South between Cutting Blvd. and Lucretia Edwards Park, which is part of the Bay Trail alignment.
However, this could be accomplished at much lower cost than the proposed $5.0 million design entailing extensive new landscaping and costly concrete work. The project might be value engineered to reduce costs if necessary. Also, unlike the other three capital projects, it still is in the design phase, rather than under construction. For all of these reasons, RWT2 is of lower priority than the other three capital projects if funding can’t be found to cover the entire $2.676 million shortfall for priority capital projects.
Thank you for considering TRAC’s thoughts on this important topic.

Esteemed leaders,
Please refer to this SOS Letters of Support document for evidence of our community impact, as told by participants, staff, and partner organizations.
You probably have
received a number of letters independently from community members - I shared three of these letters
near the front of this pdf.
During my public comment, I will reference the letter from Amanda Percy, director of finance.
Note the letter at the very top from the board of directors, which predates this current budget session agenda item.
Of particular interest may be our partnership with ADEii Health, a behavioral health provider, which will embed their staffing with SOS Richmond at our engagement
activities, such as showers and laundry, and enable a more effective Safe Harbour Day Center with these mental health and substance use services.
Starting in
July and at no cost to the city, the services will be billable to Medi-Cal, and which will enable SOS to perform its own billable services - offsetting some local public funding.
Also note that our connection with ROCK will be instrumental.
City funding of a Day Center in central Richmond is a matter of future discussion.
Note the letter from Ralph about us moving the needle forward and toward a RFP reform process for unhoused interventions - not backward to before our Reimagining.
But for now, this is NO to defunding SOS Richmond.
Most of all, remember:
We are family!

Dear Mayor and Councilmembers,
RPD was rarely able to catch and cite firework violators until they began using drones as first responders (DFR) in July of 2025.
Many California cities are using DFR
footage as firework evidence to curb danger to the community, as well as to the user.
Fireworks are not a victimless crime. Black market fireworks have become more powerful and therefore dangerous, not only causing injuries but deaths in California. They start fires; damage vehicles and structures; terrorize people with PTSD, autism, anxiety disorders and dementia, pets, and wildlife; they put toxins in our air and water; they disturb sleep and peace of mind; and the used fireworks litter our streets.
The fireworks block off streets, making passage not only inaccessible to cars but also to emergency service vehicles all the while increasing fire danger. It's a disaster waiting to happen.
When I moved to Richmond 15 years ago I was shocked that illegal fireworks violators were allowed to act with impunity.
Now that RPD has a method to document violations,
please do not take it away as the fireworks culture in Richmond will likely not end if violators can't be caught.
As a reminder, firework violations result in administrative, not criminal, penalties; they will neither go on a violator's criminal record, require jail time, nor tie up the criminal court system.
Thank you.

Dear City Clerk,
I strongly support restoring funding in the budget for the Hilltop Green emergency egress project. More than 900 households in Hilltop Green currently have only one way in and out of the neighborhood, creating a significant public safety risk during emergencies such as wildfires, earthquakes, or other disasters.
After years of work by community leaders, city staff, attorneys, and fire officials, the necessary permissions and agreements are finally within reach. It would be unfortunate to lose momentum now because the project budget was not preserved. While I understand the City's budget is tight, investments like this extra egress will
save lives and property. Ensuring access
will be both a significant
factor in responding to and recovering from disasters.
A secondary emergency exit is a critical safety improvement that could save lives. I urge the City Council to restore funding and move this project forward as soon as possible.
Thank you for your consideration.

Dear Members of the Council and the Budget Committee,
My name is Ada Weller, a resident of Hilltop Green. I am writing to formally express my concern regarding the recent funding reductions for the Hilltop Green Secondary Emergency Egress Route.
This project is a vital safety requirement for our community. I urge the committee to reverse these funding cuts and restore the budget necessary to complete this emergency exit.
Infrastructure planning and budgetary decisions must prioritize public safety and emergency preparedness.
I request that the committee fully restore the funding for this secondary emergency route to ensure the safety of Hilltop Green residents. We must ensure this essential infrastructure is in place before an emergency occurs.
I look forward to your prompt response regarding this urgent matter.

Dispite Council member Jimenez’s lack of support for RPD she has referred me to them to deal with my complaints about fireworks. I have email documentation, where she cced Captain Lopez and former Police Chief French last November
As a reminder, firework violations result in administrative, not criminal, penalties; they will neither go on a violator's criminal record, require jail time, nor tie up the criminal court system.

Dear Mayor and Councilmembers,
RPD was rarely able to catch and cite firework violators until they began using drones as first responders (DFR) in July of 2025. Many California cities are using DFR footage as firework evidence to curb danger to the community, as well as to the user.
The fireworks block off streets, making passage not only inaccessible to cars, but also to emergency service vehicles, which increases fire danger. It's a disaster waiting to happen.
When I moved to Richmond, I was shocked that illegal fireworks violators were allowed to act with impunity. Now that RPD has a method to document violations, please do not take it away as the fireworks culture in Richmond will likely not end if violators can't be caught.
As a reminder, firework violations result in administrative, not criminal, penalties; they will neither go on a violator's criminal record, require jail time, nor tie up the criminal court system.
Thank you reading my comments.

Dear Mayor and Councilmembers,
I urge you to continue supporting the Richmond Police Department's use of drones to document illegal fireworks violations. Before drones were deployed, enforcement was extremely difficult. Now, RPD has an effective way to identify violators and hold them accountable.
Illegal fireworks can cause fires, injuries, property damage, and dangerous street blockages that can delay emergency vehicles. They also create significant distress for veterans and others with PTSD, people with autism, anxiety, or dementia, as well as pets and wildlife. The noise, pollution, and debris affect the quality of life of the entire community.
When I moved to Richmond, I was surprised by the widespread use of illegal fireworks and the lack of meaningful enforcement. Without the ability to document violations, this dangerous activity is likely to continue.
From a practical standpoint, fireworks violations carry administrative—not criminal— penalties. Enforcement does not result in jail time, criminal records, or added burden on the criminal court system.
Thank you for your consideration and for helping keep Richmond residents safe.
Sincerely,
Hanna Rifkin, zip code

Public Comments Agenda Item Z.1
Public Comments Agenda Item Z.1
I am Julie Freestone, a Richmond resident for more than three decades. I worked with American Friends and Ashby Village’s Elder Action group to encourage Richmond to implement AB 481. The point of that legislation was to provide more transparency about what military-type equipment police departments use.
As a
former reporter, I especially treasure transparency.
That said, I want to support the
Richmond Police Department’s use of drones to serve as first responders when illegal fireworks are being used in the community.
Item Z.1 on today’s agenda asks the City Council to adopt a resolution approving the Richmond Police Department’s 2025 Annual Military Equipment Use Report and authorizing the continued use of approved military equipment. A section of the report addresses Drones as First Responders, also referred to as DFR.
It
describes DFR as “a public safety program that deploys unmanned aerial systems in advance of, or in coordination with, responding officers during calls for service. Operated by trained personnel, DFR provides real time aerial imagery and situational awareness to officers, supervisors, and dispatch personnel, allowing for more informed decision making before officers arrive on scene.”
The report says the DFR program is “intended to enhance officer and community safety, improve response, efficiency, and support effective deployment of resources by providing an immediate overhead perspective of unfolding incidents. DFR may be used in incidents where enhanced situational awareness can improve safety and response outcomes (DFR).”
A chart in the
report shows that June and July had the highest rates of DFR deployment.
That
makes sense because drones have proven to be the most effective tool the police department has to address illegal fireworks.
Other cities report similar success.
So here is my story about why I support the use of drones by Richmond police to address illegal fireworks:
Every year on
July 4 and sometimes days before, I stand
terrified in my backyard, watching embers rain down from fireworks. When I call the police department non-emergency number to ask for help, the dispatcher naturally asks me where the fireworks are.
I am 81 years old.
I try to imagine going outside in
the dark to pinpoint exactly who is shooting off the fireworks and where. It is incredibly important to me to know that the police can deploy a drone to check out my neighborhood and figure out where the hot spot is before they dispatch officers.
Please approve the report and continue to ask the Police Department to provide timely reports in the future.
