Meyers Nave for Confidential Personnel Investigations
FINANCIAL IMPACT: The proposed $75,000 expenditure is available within the approved Fiscal Year 2025–2026 Human Resources and

PREVIOUS COUNCIL
ACTION:

July 1, 2025

STATEMENT OF THE
ISSUE:

The City requires outside legal services to conduct
confidential personnel investigations involving
discrimination, harassment, retaliation, and other

providing these services under a legal services
agreement with the City, and an increase to the
agreement’s payment limit is needed to allow the firm to continue handling ongoing confidential investigations.

RECOMMENDED ACTION:

APPROVE the first amendment to the legal services
agreement with Meyers Nave to increase the payment
limit by $75,000, for a total amount not to exceed amount of $150,000 for a term ending June 30, 2027, for
confidential personnel investigation services – City
Attorney’s Office/Human Resources Department
(Shannon Moore/Sharrone Taylor 510-620-6803).

DISCUSSION:

The City is responsible for addressing complaints of discrimination, harassment, and retaliation by promptly conducting thorough and unbiased personnel investigations.

Additionally, the City investigates other workplace issues, including employee complaints, when necessary. When an external personnel investigation is required, the City enlists the services of specialized firms which have highly skilled employment law attorneys to conduct personnel investigations, such as the Meyers Nave.

The City Attorney’s Office and Human Resources Department executed a legal services agreement (LSA) with Meyers Nave on July 1, 2025. Since then, Meyers Nave has handled confidential investigations, which are ongoing. The City now seeks a first amendment to increase the payment limit.

The City Attorney's Office and the Human Resources Department are requesting approval of a legal services agreement amendment with Meyers Nave to increase the payment limit by $75,000 for total not to exceed amount of $150,000.
