RESOLUTION NO. xx-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND, CALIFORNIA, TO ACCEPT THE YELLOW BRICK ROAD PHASE #2
SUPPLEMENTAL STREET LIGHTING PROJECT (CIP#23032) AS COMPLETE;
AUTHORIZE THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE CONTRA COSTA COUNTY RECORDER’S OFFICE; AND AUTHORIZE THE
RELEASE OF ANY APPLICABLE BONDS AND RETENTION PAYMENTS
WHEREAS, the Yellow Brick Road Project is a multi -phase, community led effort to designate and implement safe walking and bicycling route s for Iron Triangle Neighborhood residents to increase walking and bicycling modes of transportation to and from places of interest including schools, parks, downtown Richmond (including health care facilities, shopping destinations, Post Office, etc.), th e Richmond multimodal station, the Richmond Greenway, and the Bay Trail; and
WHEREAS, the Yellow Brick Road Project Phase 1 included pedestrian safety improvements, bicycle improvements, traffic safety improvements, enhancing landscaping, increasing the tree canopy, plant and tree establishment and maintenance , and was completed in June 2024; and
WHEREAS, the Yellow Brick Road Phase #2 Supplemental Street Lighting Project (CIP#23032) (Project) included the installation of approximately 92 new pedestrian -scale streetlights to improve safety and visibility for people walking and bicycling along 8th Street corridor between Ohio Avenue and Pennsylvania Avenue; and
WHEREAS, on May 21, 2024, the City Council approved a construction contract with Nema Construction, Inc. in an amount not to exceed $1,141,700, which included a ten percent (10%) contingency . This contingency was fully utilized during construction to address unforeseen field conditions; and
WHEREAS, on December 16, 2025, the City Council approved a contract amendment in the amount of $33,900 to cover remaining required repairs along the Yellow Brick Road , resulting in a final amended not-to-exceed contract amount of $1,175,600; and
WHEREAS, Nema Construction has completed the Project in accordance with the approved plans and specifications; and
WHEREAS, by the agenda report (“Agenda Report”) accompanying this resolution the City Council has been provided with additional information supporting this action.
NOW, THEREFORE, BE IT RESOLVED by the Cit y Council of the City of Richmond as follows:
SECTION 1. The City Council hereby finds the above recitals are true and correct and have served, together with the Agenda Report, as the basis for this action.
SECTION 2. The City Council hereby accepts construction of the Yellow Brick Road Phase #2 Supplemental Street Lighting Project as complete, authorizes the City Clerk to record the Notice of Completion with the Contra Costa County Recorder, and a uthorizes the City Engineer to release any applicable bonds and retention payments.
SECTION 3. The City Clerk is designated as the custodian of the documents comprising the record of proceedings relating to this action, which shall be maintained at Richmond City Hall, 450 Civic Center Plaza, Richmond, California 94804.
SECTION 4. This Resolution shall become effective immediately upon its passage and adoption.
