RESOLUTION NO. __-__

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND,

CALIFORNIA, AUTHORIZING AN AFTER-THE-FACT CONSTRUCTION

AGREEMENT WITH NEMA CONSTRUCTION FOR THE TRAFFIC CALMING PROJECT IN AN AMOUNT NOT TO EXCEED $236,258

WHEREAS, the Traffic Calming Project, approved by City Council in November 15, 2022, consists of prioritized locations identified as part of the City's traffic calming program, encompassing traffic safety improvements at locations throughout the City, which were packaged and grouped into several distinct work orders to streamline construction; and

WHEREAS, following the termination of a prior Job Order Contracting agreement due to contractor non-responsiveness, Public Works staff engaged NEMA Construction from the City’s On-Call Electrical List to complete assigned electrical related traffic safety locations, including the successful installation of Rectangular Rapid Flashing Beacons at four intersections along Carlson Boulevard on schedule and within budget; and

WHEREAS, as engineering designs for additional traffic calming sites were finalized, City staff authorized NEMA Construction to continue work for the remaining traffic calming locations; however, because the majority of the scope involved general roadway co nstruction rather than electrical services, the tasks fell outside the active on-call electrical agreement, resulting in NEMA Construction commencing work prior to the execution of a formal stand -alone construction contract; and

WHEREAS, NEMA Construction has delivered high-quality work on schedule and within budget, successfully completing traffic safety enhancements at: (1) McBryde Avenue between 24th Street and 27th Street (speed radar feedback signs); (2) Key Boulevard and Barrett Avenue (community-requested crosswalk and curb -ramp modifications); and (3) Carl Avenue and Mariposa Street (lane delineators and speed signage), with only final thermoplastic striping along Cutting Boulevard in Point Richmond remaining in progress; and

WHEREAS, NEMA Construction has submitted two pending invoices totaling $236,258, consisting of: (1) Invoice 1 for $136,258 for labor, equipment, site preparation, concrete work, and physical installations completed across McBryde Avenue, Key Boulevard & Barrett Avenue, and Carl Avenue & Mariposa Street; and will submit (2) Invoice 2 for $100,000 for specialized thermoplastic striping materials, reflective paint, and application labor for Cutting Boulevard in Point Richmond; and

WHEREAS, approval of an After -the-Fact construction agreement in an amount not to exceed $236,258 will satisfy outstanding payment obligations, allow for final roadway striping on Cutting Boulevard to conclude physical construction by September 2026, and officially close out the original Traffic Calming Project; and

WHEREAS, the Public Works Department has established enhanced internal controls — including procurement policy re -distribution to project managers, development of a centralized on-call contract matrix linking scopes and vendor proposals, and man datory Notice to Proceed verification in MUNIS—to prevent future unauthorized or after-the-fact contracting; and

WHEREAS, sufficient funding is available in the approved Fiscal Year 2026 –2027 Measure J Fund budgets across the Neighborhood Safety and Access Program and the Point Richmond Bike Modifications Project accounts, and no additional appropriation is required.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond that the City Council hereby approves an After -the-Fact cons truction agreement with NEMA Construction for the Traffic Calming Project in an amount not to exceed $236,258.

BE IT FURTHER RESOLVED that the total expenditure of $236,258 is hereby authorized from the approved Fiscal Year 2026 –2027 Measure J Fund budget s in the Neighborhood Safety and Access Program (Account String: 20236031 -400653-23088) and the Point Richmond Bike Modifications Project (Account String: 20136031-400642-23081).
