04-CC-80/580-VAREA: 4W310 Project ID: 0422000136 Agreement No. 04-2911 A-1 1 AMENDMENT NO. 1 TO AGREEMENT 04-2911This Amendment No. 1 (AMENDMENT) to Agreement 04-2911 (AGREEMENT), executed on and effective from _____________________is between the State of California, acting through its Department of Transportation, referred to as CALTRANS, and:City of Richmond, a body politic and municipal corporation or chartered city of the State of California, referred to hereinafter as CITY.RECITALS 1. CALTRANS and CITY, collectively referred to as PARTIES, entered into AGREEMENT on July 18, 2024, defining the terms and conditions for restoring two existing murals at the MacDonald Ave. Undercrossing and the San Pablo Ave. Undercrossing, adding two new murals at the opposite abutment walls at the MacDonald Ave. and San Pablo Ave. Undercrossings, and painting columns and outside girder at the Barrett Ave. Undercrossing in the City of Richmond, referred to as PROJECT. 2. The AGREEMENT established CALTRANS will pay CITY an amount not to exceed $300,000 from Clean California State Beautification Program of 2021 funds (FUNDS)required for PROJECT.3. PARTIES now seek to increase CALTRANS contribution amount to $1,100,000 from (FUNDS).IT IS THEREFORE MUTUALLY AGREED:1. Article 8 in the AGREEMENT is replaced in its entirety to read as follows:CALTRANS will pay CITY an amount not to exceed $1,100,000 from FUNDS required for PROJECT.2. Article 15 in the AGREEMENT is replaced in its entirety to read as follows: CALTRANS and CITY agree that the total amount of FUNDS paid out to CITY will not exceed $1,100,000. 3. All other terms and conditions of the AGREEMENT shall remain in full force and effect.4.
