DISCUSSION:

The City requires specialized bond counsel to advise the City Council and City staff regarding the legal requirements associated with submitting a general obligation bond measure to the voters at the November 3, 2026, General Municipal Election. Bond counsel will provide legal advice regarding applicable requirements of the California Constitution, Government Code, Elections Code, and the City's Charter, and assist in preparing the documents necessary to place the measure before the voters.

Anzel Galvan LLP (AG) was founded in 2024 by Josh Anzel and Juan Galvan and specializes in serving as bond counsel for tax-exempt and taxable municipal financings.

Juan Galvan leads the firm's governmental finance practice and would serve as the primary attorney responsible for preparing the core election documents, participating in working group meetings, and attending City Council meetings as requested.

Working closely with City staff, the City Attorney's Office, and the City's election consultants, AG would provide legal services including, but not limited to:
 Participating in working group meetings and City Council meetings, as requested;  Preparing the resolutions and ordinance necessary to place the measure on the ballot;
 Assisting in the preparation of the ballot question, tax rate statement, and full text of the measure;
 Coordinating with the City Clerk regarding applicable filing deadlines and submission of election materials to the Contra Costa County Elections Office; and
 Providing legal advice throughout the election process regarding applicable bond and election laws.

The City Attorney's Office recommends that the City Council approve the proposed Legal Services Agreement with Anzel Galvan LLP for a fixed fee of $18,500, with a term ending June 30, 2027, or earlier upon completion of the services described in the agreement.
