DISCUSSION:

Boorman Park is located near 25th Street and Maine Avenue in Richmond (Attachment 1). The site has a history of prior industrial use that resulted in soil contamination requiring remediation under the oversight of the California Department of Toxic Substances Control. The City established the Boorman Park Site Remediation Project to address contaminated soil conditions and prepare the site for continued public park improvements.

October 18, 2022, City Council authorized the acceptance and appropriation of up to $5 million in Caltrans Clean California Local Grant Program funds for the Richmond Communities Clean Collaborative Project. Grant funds were utilized for Boorman Park Remediation and the 7th Street Bike Project.

On December 1, 2024, the City entered into a construction agreement with Pacific States Environmental Contractors, Inc. for the Boorman Park Site Remediation Project (Attachment 2). The project scope included site clearing, removal and disposal of contaminated soil, excavation and management of contaminated materials, environmental controls, stormwater pollution prevention, dewatering, import of clean fill, grading, compaction, traffic control, and related construction activities necessary to complete the remediation work.

The construction agreement amount was $5,015,434.00. The project was performed as Capital Improvement Project No. 23030.

Pacific States Environmental Contractors, Inc. has completed the construction work required under the agreement. The completed work included site clearing, remediation- related excavation and material management, contaminated soil disposal, clean fill import, grading and compaction, environmental controls, and related work required by the contract documents.

Final inspections have been completed and in compliance with the project documents. and contractual requirements. The project is ready for construction contract close-out.

Acceptance of the project will allow the City to file the Notice of Completion with the Contra Costa County Recorder’s Office and proceed with administrative close-out actions, including release of contractor bonds and retention payment in accordance with applicable laws, regulations, and contract provisions.

The original total project budget was $7,650,642.00 and the final total project cost at the time of acceptance is $6,692,937.00, resulting in a variance of ($1,257,062.75). The variance is attributable to management of soil removal and favorable soil testing results.

This action accepts the completed construction work performed by Pacific States Environmental Contractors, Inc. and authorizes administrative close-out of that construction agreement. There are no outstanding liens, stop notices, claims, disputes, or unresolved contract issues. Record drawings and close-out documentation have been received.

Project reporting to the Department of Toxic Substances Control is ongoing through the City’s environmental oversight process.
