A RESOLUTION OF THE COUNCIL OF THE CITY OF RICHMOND, CALIFORNIA,
APPOINTING MARK SCOTT AS THE INTERIM CITY MANAGER
PURSUANT TO GOVERNMENT CODE SECTIONS 7522.56 & 21221(h) WHEREAS, in compliance with Government Code section 7522.56 the City of Richmond City Council must appoint a retiree in an interim assignment; and WHEREAS, Mark Scott is a CalPERS retiree, effective June 2021; and WHEREAS, Government Code sections 21221(h) and 7522.56 requires that postretirement interim employment must not commence without this certification resolution; and WHEREAS, Government Code sections 21221(h) and 7522.56 provides that a retiree can work in an interim assignment on a limited term basis; and WHEREAS, the City Council of the City of Richmond and Mark Scott certify that he retired more than 180 days ago; and
WHEREAS, the City Council hereby appoints Mark Scott as an interim retired annuitant to serve as the Interim City Manager for the City of Richmond under Government Code section 21221(h), effective October 3, 2026; and
WHEREAS, the entire employment agreement between Mark Scott and the City of Richmond has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year for all CalPERS employers; and
WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and
WHEREAS, the maximum monthly base salary for the City Manager position, which performs the most comparable duties, is $31,674.08/month and the hourly equivalent is $182.74, and the minimum base salary for this position is $17,137.10/month and the hourly equivalent is $98.87; and
WHEREAS, the hourly rate paid to Mark Scott will be $182.74; and WHEREAS, Mark Scott will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate.
NOW THEREFORE, BE IT RESOLVED THAT the City Council of the City of Richmond hereby certifies the nature of the appointment of Mark Scott as described herein and detailed in the attached employment agreement and that this appointment is necessary to serve as the Interim City Manager to provide oversight to the City of Richmond because such appointment is essential to maintaining the basic ongoing operations and service delivery.
