DISCUSSION:

Background
The City of Richmond is advancing the “McBryde Safe Routes to Park” project at the McBryde Avenue/State Route 80 interchange. The project includes new pedestrian crosswalks, bicycle lane markings, signing, and striping intended to improve access and safety in the area (Attachment 1). Because portions of the project are located within the State Route 80 right of way, the City and the California Department of Transportation (Caltrans) share jurisdictional and maintenance responsibilities for affected public facilities. These responsibilities are governed by the original Freeway Maintenance Agreement executed by the City and Caltrans on August 14, 1957 (Attachment 2).

Because these improvements include bicycle and pedestrian facilities constructed as a permitted encroachment within Caltrans' right of way, the City and Caltrans must amend the existing Agreement (Caltrans Agreement No. 04-CC-80-PM Var) to formalize the City's ongoing maintenance responsibility for the new facilities, consistent with standard practice for infrastructure that is turned over to the City for maintenance following construction.

Shared-maintenance agreements of this nature are standard throughout California and are intended to ensure consistency, fairness, and equitable distribution of maintenance obligations between agencies. This framework establishes clear responsibilities for infrastructure elements such as bicycle facilities, signing, striping, and other improvements that serve both State and local roadway users.

The proposed Amendment No. 1 makes two changes to the Agreement (Attachment 3).

First, it amends Exhibit A to add the City street intersection at McBryde Avenue and State Route 80 (PM 3.79) in Contra Costa County, identified as “Location 1,” as shown on new Exhibit A-1. Exhibit A-1 supersedes and replaces any prior depiction of the McBryde Avenue intersection within Exhibit A. Second, it adds a new Article 7, Bicycle Paths, Lanes, and Cycle Tracks, which provides that for bicycle paths, lanes, and cycle tracks constructed as permitted encroachments within Caltrans' right of way, the City is solely responsible for all permitted improvements — including delineation, drainage facilities, slope, and structural adequacy — and shall maintain, at its own expense, a safe facility for bicycle travel along the entire length of the path, lane, or cycle track,

including sweeping and debris removal, and all signing, striping, and pavement markings required for the direction and operation of the nonmotorized facility.

By adopting the resolution, the City Council authorizes the City Manager to execute Amendment No. 1, thereby formalizing the City's maintenance obligations for the new bicycle facilities at the McBryde Avenue/State Route 80 intersection. This action is consistent with the City's long-standing obligation under the 1957 Freeway Maintenance Agreement to maintain the public right of way within its jurisdiction and ensures that the City continues to contribute its fair share toward the maintenance of roadway infrastructure at the State highway intersections covered by the Agreement.

City staff recommend that the City Council adopt the resolution to approve first amendment and authorize the City Manager to execute the amendment with Caltrans (Attachment 4).
