RESOLUTION NO. __-__

RESOLUTION TO AMEND THE FREEWAY MAINTENANCE AGREEMENT (FMA)

WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) AT THE INTERSECTION OF MCBRYDE AVENUE AND STATE ROUTE 80
WHEREAS, the City of Richmond ("City") and the California Department of Transportation ("Caltrans") are parties to a Freeway Maintenance Agreement ("FMA"), originally executed August 14, 1957, establishing maintenance responsibilities for facilities located at the intersection of City streets and State highway facilities; and WHEREAS the City is implementing pedestrian and bicycle improvements at the McBryde Avenue and State Route 80 intersection (PM 3.79) as part of the McBryde Safe Routes to Park project, constructed as a permitted encroachment within Caltrans' right of way; and WHEREAS the proposed amendment to the FMA (“Amendment No. 1”) adds the McBryde Avenue/State Route 80 intersection to Exhibit A of the FMA, identified as “Location 1,” as depicted on new Exhibit A-1, which supersedes and replaces any prior depiction of the McBryde Avenue intersection; and
WHEREAS, Amendment No. 1 adds a new Article 7 to the FMA identifying the City as solely responsible for the operation, maintenance, repair, and replacement of bicycle paths, bicycle lanes, and cycle tracks constructed as permitted encroachments within Caltrans' right of way at the project area, including delineation, drainage facilities, slope, structural adequacy, sweeping and debris removal, and all signing, striping, and pavement markings; and WHEREAS the City Council finds that approving Amendment No. 1 to the FMA is necessary to clearly establish maintenance responsibilities between the City and Caltrans and to facilitate completion of the McBryde Safe Routes to Park project improvements.

THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond, as follows:

Section 1. The City Council finds the above recitals are true and correct and have served, together with the Agenda Report, as the basis for the findings and actions set forth in this resolution.

Section 2. The City Council hereby approves Amendment No. 1 to the Freeway Maintenance Agreement with Caltrans for the McBryde Avenue/State Route 80 intersection.

Section 3. The City Council hereby authorizes the City Manager, or their designee, to execute Amendment No. 1 to the Freeway Maintenance Agreement with Caltrans for the McBryde Avenue/State Route 80 intersection, thereby establishing maintenance responsibilities for the bicycle facilities constructed at that location.

Section 4. The City Clerk is designated as the custodian of the documents and materials that constitute the record of proceedings upon which this decision is based. These records are maintained at the Office of the City Clerk, Richmond City Hall, 450 Civic Center Plaza, Richmond, CA 94804.
